Indian-American Lawyer Preet Bharara Fired After Refusing To Quit

Washington, Mar 12: Preet Bharara, one of the most high-profile federal prosecutors in the country, said he was fired Saturday after refusing to submit a letter of resignation as part of an ouster of the remaining U.S. attorneys who were holdovers from the Obama administration, according to people familiar with the matter.

PreetBharara's dismissal was an about-face from President Donald Trump's assurances to the Manhattan-based prosecutor in November, weeks after the election, that he wanted him to stay on the job following a meeting at Trump Tower, according to Bharara.

Two people close to Trump said the president's chief strategist, Stephen Bannon, and Attorney General Jeff Sessions wanted a clean slate of federal prosecutors and were unconcerned about any perception that the White House changed its mind about Bharara. The removal of former president Barack Obama's federal prosecutors is about asserting who's in power, the two said.

The departure of Bharara, the U.S. attorney for the Southern District of New York, capped a confusing sequence of events, beginning Friday, when acting deputy attorney general Dana Boente began making calls to 46 prosecutors asking for their resignations by the end of the day. Requests for resignation are a normal part of a transition of power from one administration to another, although both the Bush and Obama administrations let their U.S. attorneys leave gradually.

During Friday's call with Bharara, the New York prosecutor asked for clarity about whether the requests for resignations applied to him, given his previous conversation with Trump, and did not immediately get a definitive answer, according to a person familiar with the exchange.

When asked Friday whether Bharara was also being asked for a resignation letter, one White House official not authorized to speak publicly said, "Everybody's gone," and would not engage further on the issue.

On Saturday morning, when the administration had still not received Bharara's resignation, Boente attempted to call the U.S. attorney to find out why, but the two men did not immediately connect, according to people familiar with the discussions.

When they finally did speak shortly before 2:30 p.m., Boente informed Bharara that the order to submit his resignation indeed applied to him because he was a presidentially appointed U.S. attorney, according to a Justice Department official with knowledge of the conversation.

Bharara asked Boente if he was firing him and Boente replied that he was asking him to submit his resignation, the official said.

Minutes later, Bharara announced on Twitter that he was out. "I did not resign," Bharara said. "Moments ago I was fired. Being the US Attorney in SDNY will forever be the greatest honor of my professional life."

Bharara sent an email to his staff, asserting again that Boente had removed him from his job.

"Needless to say it is personally very sad for me," the note said. "This is the greatest place on Earth and I love you all. Even on a day when your U.S. Attorney gets fired it is still Thanksgiving because you all still get to do the most honorable work there is to do."

Bharara added that the office "could not be in better hands" than with the deputy U.S. attorney for the Southern District of New York, Joon Kim, whom he called "a tremendous leader and public servant and who loves the office just as much as I do."

Within the Justice Department, some are questioning whether a recent phone call from Trump to Bharara may have contributed to the decision to remove the Obama holdovers, according to a person familiar with the matter.

On Thursday, a White House aide called and left a message for Bharara, saying the president wanted to speak with him, though the prospective topic of discussion was unclear. Bharara consulted his staff and determined that it would probably be a violation of Justice Department protocols for him to speak directly to the president, this person said. That protocol exists in order to prevent political interference - or the appearance of political interference - with Justice Department work.

Bharara then contacted the chief of staff for the attorney general, Jody Hunt, told him of his own determination, and the two agreed that it would be a violation of the Justice Department protocol for Bharara to call the president back. Bharara then called the White House staffer who had left the message and said he wouldn't be talking to the president, and explained why, this person said.

It's unclear whether the Trump call and its aftermath had anything to do with Friday's decision.

Bharara, who was born in India and came to the United States as a child, had a particularly powerful perch in the criminal justice system. The Southern District of New York has 220 assistant U.S. attorneys, making it one of the largest federal prosecutors' offices in the country.

During his tenure, Bharara indicted 17 prominent New York politicians for malfeasance - 10 of them Democrats. Along with his bipartisan prosecutions, Bharara developed a reputation for being tough on insider trading, although he was criticized for the lack of prosecutions that followed the financial crisis.

Bharara was an outspoken man in a job that has been held by vocal and politically aspirant predecessors, including former New York mayor Rudolph Giuliani, FBI Director James Comey and former Supreme Court justice Felix Frankfurter.

There is no indication that the ouster of Bharara stems from a disagreement about a particular case or investigation. While the FBI has been conducting a counterintelligence inquiry looking for evidence of contacts between agents of the Russian government and Trump campaign advisers, and a former campaign adviser to Trump has been part of an investigation into possible overseas corruption, there have been no signs that Bharara's office has been involved in either of those probes or any other inquiries that might touch on the president or people close to him.

On Wednesday, watchdog groups asked Bharara to probe whether Trump has received payments or other benefits from foreign governments through his business interests in violation of the Constitution's emoluments clause, which prohibits top officials from receiving favors or payments from foreign governments.

The president complained on Twitter earlier this month that Obama had ordered wiretapping of Trump Tower during the election season - an accusation that multiple federal law enforcement officials have said is untrue - partly because presidents cannot order the FBI to wiretap Americans, and also because no such surveillance was undertaken. But Bharara was not drawn into that debate, which principally revolved around the Justice Department and FBI headquarters.

Initially after Trump won the presidency, it looked as if Bharara's position was safe. Trump brought up Bharara's name in November during a phone conversation with Sen. Charles Schumer, D-N.Y., whom the president-elect was calling to congratulate on becoming the leader of the Senate Democrats, according to people familiar with the matter. In that conversation, Trump said he was thinking of keeping Bharara in his job, these people said. Schumer praised Bharara and Trump then arranged a meeting with Bharara at Trump Tower.

During the conversation, Trump told Bharara to call Sessions, his nominee for attorney general, who also asked Bharara to stay, people familiar with the conversation said.

When Bharara was leaving, according to one person, he asked the president-elect what he should tell the reporters in the lobby. Trump told Bharara to tell them he was staying on, this person said.

Bharara told reporters afterward that the president-elect, "presumably because he's a New Yorker and is aware of the great work that our office has done over the past seven years," asked to meet with him and discuss whether he would remain in his position.

"We had a good meeting," Bharara said. "I agreed to stay on."

New York, Jun 4: The Minneapolis police officer who used his knee to pin down George Floyd's neck before his death was the most experienced of the four officers involved in the arrest, with a record that included medals for bravery and 17 complaints against him, including one for pulling a woman out of her car during a speeding stop.

New details about Derek Chauvin and the other now-fired officers emerged Wednesday after prosecutors upgraded Chauvin's charge to second-degree murder and charged the others with aiding and abetting in a case that has convulsed the nation with protests over race and police brutality.

Heavily redacted personnel files show that Chauvin, a 19-year veteran of the force, was initially trained as a cook and served in the Army as a military police officer.

Eleven-year veteran and native Hmong speaker Tou Thao began as a community service officer and was the subject of six complaints.

The other two officers were relative newcomers to the department, including Thomas Lane, a former juvenile detention guard who did volunteer work with Somali refugees, and J. Alexander Kueng, who got his start in law enforcement by patrolling his college campus and a department store.

The files were notable for what they didn't include. Only one of the 17 complaints against Chauvin was detailed, none of the six against Thao were mentioned and there was no further detail about a 2017 excessive force lawsuit against Thao.

Records show that the 44-year-old Chauvin initially studied cooking before taking courses in law enforcement and doing two stints in the Army as a military police officer in the late 1990s, serving at Fort Benning, Georgia, and in Germany.

Chauvin became a Minneapolis police officer in 2001 and the lone reprimand in his file involved a 2007 incident when he was accused of pulling a woman out of her car after stopping her for going 10 mph (16 kph) over the speed limit.

Investigators found it was not necessary for Chauvin to remove the woman from the car and noted that his squad car video was turned off during the stop.

But Chauvin was also singled out for bravery. Files show he won two medals of valor, one in 2006 for being part of a group of officers who opened fire on a stabbing suspect who pointed a shotgun at them, and another in 2008 for a domestic violence incident in which Chauvin broke down a bathroom door and shot a suspect in the stomach.

He also won medals of commendation in 2008 after he and his partner tackled a fleeing suspect who had a pistol in his hand, and in 2009 for single-handedly apprehending a group of gang members while working as an off-duty security guard at the El Nuevo Rodeo, a Minneapolis nightclub.

Since his arrest, the former owner of the club, Maya Santamaria, said Chauvin and Floyd both worked as security guards there at various times but that she wasn't sure if they had known one another.

She said Chauvin was unnecessarily aggressive on nights when the club had a black clientele, quelling fights by dousing the crowd with pepper spray and calling in several police squad cars as backup, a tactic she called “overkill.”

Chauvin's wife, Kellie, a Laotian immigrant who became the first Hmong winner of the Mrs. Minnesota pageant, said shortly after his arrest last week that she intends to divorce him.

Before news of the upgraded charges, an attorney for Chauvin said he was not making any statements at this time. Lawyers for the others did not return messages seeking comment.

In cellphone video of the May 25 arrest of Floyd, Chauvin is shown pressing his knee onto Floyd's neck for more than eight minutes while Floyd cries out “I can't breathe” and eventually stops moving.

During much of the arrest, Kueng and Lane were helping Chauvin restrain Floyd. Thao was standing nearby keeping onlookers back.

According the complaint, at one point during the arrest, as Chauvin held Floyd down with his knee, Lane asked Chauvin twice whether they should roll Floyd over.

“No, staying put where we got him,” Chauvin replied, “I am worried about excited delirium or whatever,” Lane said. And Chauvin replied again, “That's why we have him on his stomach.” None of the three officers moved from their positions.

Lane joined the police early last year as a 35-year-old cadet — much older than most rookies — and became a full-fledged officer last December. He had no complaints in his file during his short time on the force.

On employment forms, the University of Minnesota graduate said he done volunteer work tutoring Somali youth and as a mentor helping at-risk elementary school students with reading and homework.”

Kueng, at 26 the youngest of the four officers, was also a recent recruit to the police force. He completed his year's probation just three months before the Floyd arrest.

His personnel file, which notes that he speaks, reads and writes Russian, did not include any commendations or disciplinary actions during his short time on force.

Kueng was a 2018 graduate of the University of Minnesota, where he worked part-time as part of the campus security force. He also worked nearly three years as a theft-prevention officer at Macy's.

Thao joined the police force part-time in 2008 while attending a community college. Before that, he worked as a security guard, a supermarket stocker and trainer at McDonald's.

City records show six complaints were filed against Thao, but there was no mention of that in the records released Wednesday. There also was no mention of a 2017 federal lawsuit accusing him and another officer of excessive force.

According to the lawsuit, Lamar Ferguson claimed that in 2014, Thao and his partner stopped him and beat him up while he was on his way to his girlfriend's house. The lawsuit was settled for $25,000 ___

Wuhan, Apr 15: In the six days after top Chinese officials secretly determined they likely were facing a pandemic from a new coronavirus, the city of Wuhan at the epicenter of the disease hosted a mass banquet for tens of thousands of people; millions began traveling through for Lunar New Year celebrations.

President Xi Jinping warned the public on the seventh day, Janaury 20. But by that time, more than 3,000 people had been infected during almost a week of public silence, according to internal documents obtained by The Associated Press and expert estimates based on retrospective infection data.

That delay from Jan 14 to Jan. 20 was neither the first mistake made by Chinese officials at all levels in confronting the outbreak, nor the longest lag, as governments around the world have dragged their feet for weeks and even months in addressing the virus.

But the delay by the first country to face the new coronavirus came at a critical time — the beginning of the outbreak. China's attempt to walk a line between alerting the public and avoiding panic set the stage for a pandemic that has infected almost 2 million people and taken more than 126,000 lives.

If they took action six days earlier, there would have been much fewer patients and medical facilities would have been sufficient. We might have avoided the collapse of Wuhan's medical system.

Other experts noted that the Chinese government may have waited on warning the public to stave off hysteria, and that it did act quickly in private during that time.

But the six-day delay by China's leaders in Beijing came on top of almost two weeks during which the national Center for Disease Control did not register any cases from local officials, internal bulletins obtained by the AP confirm. Yet during that time, from Jan 5 to Jan 17, hundreds of patients were appearing in hospitals not just in Wuhan but across the country.

It's uncertain whether it was local officials who failed to report cases or national officials who failed to record them. It's also not clear exactly what officials knew at the time in Wuhan, which only opened back up last week with restrictions after its quarantine.

But what is clear, experts say, is that China's rigid controls on information, bureaucratic hurdles and a reluctance to send bad news up the chain of command muffled early warnings. The punishment of eight doctors for rumor-mongering, broadcast on national television on Jan. 2, sent a chill through the city's hospitals.

Doctors in Wuhan were afraid, said Dali Yang, a professor of Chinese politics at the University of Chicago. It was truly intimidation of an entire profession. Without these internal reports, it took the first case outside China, in Thailand on Jan 13, to galvanize leaders in Beijing into recognising the possible pandemic before them. It was only then that they launched a nationwide plan to find cases distributing CDC-sanctioned test kits, easing the criteria for confirming cases and ordering health officials to screen patients, all without telling the public.

The Chinese government has repeatedly denied suppressing information in the early days, saying it immediately reported the outbreak to the World Health Organization.

Allegations of a cover-up or lack of transparency in China are groundless, said foreign ministry spokesman Zhao Lijian at a Thursday press conference.

The documents show that the head of China's National Health Commission, Ma Xiaowei, laid out a grim assessment of the situation on Jan. 14 in a confidential teleconference with provincial health officials.

A memo states that the teleconference was held to convey instructions on the coronavirus from President Xi Jinping, Premier Li Keqiang and Vice Premier Sun Chunlan, but does not specify what those instructions were.

The epidemic situation is still severe and complex, the most severe challenge since SARS in 2003, and is likely to develop into a major public health event, the memo cites Ma as saying.

The National Health Commission is the top medical agency in the country. In a faxed statement, the Commission said it had organised the teleconference because of the case reported in Thailand and the possibility of the virus spreading during New Year travel. It added that China had published information on the outbreak in an open, transparent, responsible and timely manner," in accordance with important instructions repeatedly issued by President Xi.

The documents come from an anonymous source in the medical field who did not want to be named for fear of retribution. The AP confirmed the contents with two other sources in public health familiar with the teleconference. Some of the memo's contents also appeared in a public notice about the teleconference, stripped of key details and published in February.

Under a section titled sober understanding of the situation, the memo said that clustered cases suggest that human-to-human transmission is possible. It singled out the case in Thailand, saying that the situation had changed significantly because of the possible spread of the virus abroad.

With the coming of the Spring Festival, many people will be traveling, and the risk of transmission and spread is high, the memo continued.

Jun 24: The coronavirus tally in Pakistan reached 188,926 with the detection of 3,892 new cases in the last 24 hours, the health ministry said on Wednesday.

Sixty more people died due to the viral infection, taking the death toll to 3,755.

As many as 3,337 patients are in critical condition across the country, the ministry said.

With the detection of 3,892 new cases in the last 24 hours, the coronavirus tally in the country now stands at 188,926, it said.

Sindh reported the maximum number of 72,656 cases, followed by 69,536 in Punjab, 23,388 in Khyber-Pakhtunkhwa, 11,483 in Islamabad, 9,634 in Balochistan, 1,337 in Gilgit-Baltistan and 892 in Pakistan-occupied Kashmir (Pok).

Health authorities have so far conducted 1,150,141 coronavirus tests, including 23,380 in the last 24 hours.

A total of 77,754 patients have recovered so far from the disease.
