Indian woman wins gender discrimination lawsuit against Wipro in London

Bengaluru, May 5: Shreya Ukil, a 40-year-old Indian woman who was formerly a senior techie at the Wipro back office in London, claimed to have won a lawsuit in a British tribunal against the IT major for sacking her on the grounds of gender discrimination, unequal pay and victimisation. Wipro, however, said the tribunal upheld the dismissal as appropriate and rejected claims of adverse cultural attitude towards women in the organisation.

The judgment of the London Employment Tribunal found that the direction (to sack her) had come from the very top and was followed through with considerable resolve.

“Ukil was victimised by Wipro’s leadership for speaking up about sex discrimination, unequal pay and a culture of sexism,” the statement asserted.

Wipro, however, contradicted Ukil’s claim, and said in a statement later that “it was pleased the tribunal had upheld the dismissal of the complainant from the services of the organisation as appropriate and rejected claims of adverse cultural attitude towards women in the organisation”.

In an e-mail response to Wipro’s statement, Ukil said that she had won on her claim for equal pay, as she did same work as her male peers in same grade and that she was paid significantly lower than her male colleagues.

“The court also ruled in my favour on sex discrimination, victimisation and unfair dismissal,” Ukil reiterated, adding that the verdict on her charges was published on April 18, while the verdict on equal pay was published on July 7, 2015.

Enclosing parts of the judgment’s operative portion to contest Wipro’s counter-claim, Ukil said the tribunal found that the company’s rejection of her resignation in September 2014 was an act of victimisation and that she was dismissed unfairly.

“The tribunal found that I was a victim of acts of sexism and racism, as the company did not upheld the well-founded complaints of discrimination against me,” Ukil said.

The tribunal also accepted that Ukil was asked to sign an indemnity to prevent from bringing claims against the company in October 2013 as an act of victimisation.

“The court verdict is in public domain. There is no out-of-court settlement,” she affirmed.

Ukil, who worked with Wipro for almost 10 years and won multi-million-dollar contracts for it, started raising concerns in 2012, which went unheeded.

Instead of addressing Ukil’s concerns, a series of decisions were made by the management behind the scenes, including chief legal counsel Inderpreet Sawhney, human resources global head Saurabh Govil and Kurien in a bid to remove her from her role in London.

Ukil sued the Bengaluru-based outsourcing firm in October 2015, seeking one million pounds compensation for gender discrimination, unequal pay and harassment.

“Compensation (referred to as ‘remedy’) will be decided at a later date,” Ukil noted.

Sacking Ukil and her superior Manoj Punja, 54, the company said then that they were relieved from service after an internal inquiry established that they were into a relationship but did not report about it to the company as a policy.

Ukil, who was sales and market development manager for the back office operations in London, filed the lawsuit with the tribunal, claiming she was forced into an affair by Punja, a married man, who was head of its business process outsourcing (BPO) office in London.

Having lost all faith, Ukil raised her final grievances with Wipro chairman Azim Premji, who assured her of a fair and impartial investigation.

When she resigned from her role in September 2014 in an e-mail to Premji, her resignation was not accepted and she was fired four days later whilst still on sick leave.

The tribunal found that comments made by Wipro employees, Sid Sharma and George Joseph on separate occasions reflected an “extra undercurrent of sexism in their attitudes” towards Ukil, with remarks that aceplainly conveyed a sexist innuendo”.

“I hope that following this judgment, companies will again reconsider their treatment of female employees, ensuring they are treated fairly and equally,” Ukil added

Kolkata, May 21: Around 300 nurses have left Kolkata for Manipur after resigning from their jobs, said JS Joyrita, Deputy Residence Commissioner, Manipur Bhavan, Kolkata on Wednesday.

"Around 60 more nurses will be leaving tomorrow. We are getting many calls from people who want to go back to Manipur," she said.

Earlier, it was reported that 185 nurses have quit their job from hospitals in Kolkata and returned to Imphal. Cristella, a nurse said: "We are not happy that we left our duties. But we faced discrimination, racism and people sometimes spit on us. Lack of PPE kits, and people used to question us everywhere we went."

According to the latest information available on the website of the Ministry of Health and Family Welfare, 2961 cases of the virus have been reported from West Bengal 1074 cured/migrated/discharged and 250 deaths.

India's COVID-19 tally reached 1,06,750 on Wednesday, according to the Union Ministry of Health and Family Welfare. As many as 140 deaths have been reported in the last 24 hours, taking the total number of deaths to 3,303. Out of the total cases, 61,149 are actives cases and 42,298 patients have been cured/discharged/migrated.

New Delhi, Jan 1: Union Minister Prakash Javadekar launched a scathing attack on the Aam Aadmi Party and the Congress for allegedly inciting violence in Delhi against the Citizenship (Amendment) Act. Mr Javadekar said the violence over the amended citizenship law that broke out in areas like Jamia Nagar, Seelampur and Jama Masjid "cannot be forgiven".

"In Jamia, the Congress' Asib Khan and AAP's Amanatullah Khan delivered inciting speeches. They spread disinformation. The law is to give citizenship to people and not take citizenship away," Mr Javadekar told reporters.

He said the people of India understand the plans of the Congress and the AAP and both parties should apologise.

"We will bring out the truth. The fight is between anarchists and those who oppose them. Our agenda would be wholesome development of Delhi. The AAP strangulated municipal corporations' attempt on development. Rs 900 crore was not given. Today, the people of Delhi are surprised that the AAP slept through all these 4.5 years and in the remaining six months they have launched schemes," Mr Javadekar said.

"The work is done by someone else and the credit is taken by a different individual," the Union Minister said, referring to allegations that the government led by Chief Minister Arvind Kejriwal took credit for work done by BJP-ruled municipal agencies.

"Who did fogging in dengue season? Our corporations organised an awareness drive against water accumulation and dengue cases went down. During corporation polls, Kejriwal said don't choose BJP as dengue will claim lives. Now he is also claiming credit for decrease in dengue cases because of the work done by these corporations," Mr Javadekar said.

"I am an environment minister. We worked on pollution control. There is no limit to their (AAP's) lies. About unauthorised colonies, the AAP says we have not regularised it. We made a law signed by the President, yet they spread lies," Mr Javadekar said.

The election in Delhi will be held before the end of February.

Mumbai, Jun 6: Republic TV Editor-in-Chief Arnab Goswami faces a new complaint, this time under the Cable Televisions Network (Regulation) Act, 1995, for allegedly running the television channel "to create communal hatred, religious polarisation and threatening national integrity".

Social activist Nilesh Navlakha last month lodged a criminal complaint with the Commissioner of Police, Pune, through his lawyer Asim Sarode, under Section 2 of the Act.

"We have narrated six prominent, recent debate shows conducted by Goswami in which his arguments and words used were communal in nature which he kept repeating in his shows. The words and tonality are intended to promote communal attitudes and news is based on religious innuendos and half-truths," Sarode contended.

This leads to propaganda based on hatred, religious polarization and communal divide, said Navlakha in a statement.

He further said that the misuse of freedom of expression by Goswami and his channel posed a serious threat before the independent media as it violates the freedom of expression of the viewers, as it is the viewers' right to get correct, complete and true information.

Elaborating about Goswami's behaviour, Navlakha said that he has created what is termed 'Impulse Control Disorder' in psychiatry.
Sarode said: "Intermittent Explosive Disorder is a kind of 'impulse control disorder' which involves sudden episodes of impulsive, aggressive, violent behaviour or angry verbal outbursts in which you react grossly out of proportion to the situation."

They said that there are some more media persons displaying such tendencies in Hindi and English journalism, showing whatever is convenient and blow it out of proportion to give meanings which are out-of-context and disrupts the fabric of democracy while not fitting into journalism's ethics.

The complaint also alleged that Goswami and his channel are actually into "brainwashing" the viewers in a way that they will get converted into haters of some communities and terror for some religions.

"This is not less than running an organised crime syndicate of making the human minds to follow a fanatic terrorist thought process. When WhatsApp group admins are being booked under the law, then why the CTNRA provisions are not being invoked against such tendencies," Sarode asked.

In the complaint, it is pointed out how eminent persons have walked out of Goswami's shows because of his name-calling tactics, like labelling cricketer Sachin Tendulkar "anti-national" in one of his shows.

Navlakha and Sarode claimed that Goswami has violated the Programme Code under the CTNRA, the channel has indicated it is against sovereignty, integrity and security as also against public order, decency and morality, making it a serious issue and a cognizable offence.

It urged the Pune police chief to take suitable action against the wrongs committed to disturb the peace, law and order in society and book Goswami under the CTNRA Section's 16, which attracts a jail term of two years plus fine.
