Interaction with Hadiya should not be held in open court: Father’s new demand

Asokan K M, an ex army man from Kerala’s Kottayam district, who reportedly tortured daughter Akhila alias Hadiya for converting to Islam and marrying a Muslim man, has now moved the Supreme Court, urging that the interaction with his daughter be held in-camera (privately) and not in the open court.

The application in this regard was filed after a bench headed by Chief Justice Dipak Misra had on October 30 directed that the woman be produced before it on November 27 for an interaction in open court.

Asokan, who had created the rumour of ‘love jihad’ to convince the Kerala high court to annul his daughter’s marriage with her husband earlier this year, now referred to the “communally sensitive nature of the case” and sought in-camera interaction on some grounds including that so called radical elements could jeopardise the safety and privacy of his daughter and the family.

The top court had on August 16 said it would speak to the woman in-camera before taking a final decision on the matter. It has later modified the order saying "We may further add that this court shall speak to her not in camera but in open court."

Asokan, in his application, claimed that since the matter "involves sensitive issues involving the security and physical safety of the parties and communally sensitive issues in the backdrop of the involvement of radical/extremist elements, it is genuinely believed that in-camera interaction is necessary in the interest of the safety and privacy of respondent number one and his family."

The plea has also referred to the apex court's judgement declaring right to privacy as a fundamental right and urged the top court to consider the impact of privacy of not only the woman, but also her family.

"Further, given the extent of religious indoctrination by extremist elements, wherein the respondent number one's daughter is already spewing narratives of hell and the torment meted out to sinners, she may be subject to undue pressure which could be an obstacle to truth seeking and dispensation of justice," it said.

Hadiya, who is forced to stay with her father against her will, recently in a video had revealed the brutality of her father. “My father hits and kicks me when I walk… He may murder me anytime…You need to get me out...” the helpless Hadya said in the video.

Asokan is also not allowing any of Hadiya’s friends to meet her. In last few months, many Snagh Parivar activists have visited their house and tried to convince her to convert back to Hinduism, but in vain.

Kasaragod, Jul 22: An accused in a POCSO case jumped into the sea at Kasaba Coast near here on Wednesday.

Sources said the accused Mahesh (28), resident of Soorlu Kanhangad, was brought to the groyne ('pulimuttu' in Malayalam) at the coast for collecting evidence.

He escaped from the police and ran around 200 meters towards the sea and jumped into it. The effort to rescue him also failed.

Police, Fire & Rescue officials and fishermen are searching for the body of the accused.

Mahesh was arrested on charge of capturing the video of a minor girl in a washroom on his mobile. 

During interrogation, he had told the copse that he had hidden the mobile, which was used to video record the act, near the groyne. Accordingly, the police had brought him to this place.

Shivamogga/Hubballi, Feb 10: Chief minister BS Yediyurappa on Sunday reiterated portfolios for all new ministers will be distributed on Monday and the exercise was not completed sooner only because of weekend holidays.

“I had completed all the formalities on the portfolio allocation,” Yediyurappa said, appearing to rubbish rumours that the delay was caused due to a tussle over portfolios. “However, considering it was a weekend, I decided to postpone handing them out. On Monday all portfolios will be announced.”

The CM also promised to induct loyalists into his council of ministers, admitting Umesh Katti, Hukkeri legislator, should not have been left out. Speaking in Shivamogga earlier in the day, Yediyurappa said Katti was scheduled to take oath last week along with the 10 defectors, but the decision was scrapped at the last minute due to “unavoidable reasons”. “But I have discussed the issue with Katti. Considering he is from North Karnataka and that we have worked together for many years, he will be included in the cabinet soon,” Yediyurappa said.

When questioned on more prominent legislators from his home district missing out — especially Thirthalli Arag Jnanendra — he said a “different responsibility” has been given to him and has already explained why he could not be inducted.

Yediyurappa refused to react to comments by former chief ministers Siddaramaiah and HD Kumaraswamy on government’s survival, saying he would rather concentrate on the state’s development. “It is common for the opposition to criticize the government, but I’m busy preparing for the budget, which will be presented on March 5. I am concentrating on my work,” he said.

In Davangere, Yediyurappa said he is committed to increasing internal reservation for the Valmiki community under the ST quota from 3% to 7.5%, apart from considering a separate department for the community to address their issues. Speaking at a Valimik community event, Yediyurappa said Justice Nagamohan Das has been asked to submit his report at the earliest to bring in reservation.

In Mysuru, chief minister Yediyurappa’s son and BJP Yuva Morcha general secretary BY Vijayendra on Sunday said the district will get representation in his father’s cabinet soon, pointing to the six existing vacancies. He said former minister AH Vishwanath will be made a minister as Yediyurappa is known for delivering on his promises. Speaking to reporters, he said his father has expanded his council of ministers, ensuring there were no complaints and he will include more legislators given that there are six more vacancies.

Bengaluru, Mar 7: Customs officials intercepted a Guatemalan national at Kempegowda International Airport here on March 2 and recovered cocaine.

The accused confessed that she had swallowed 150 cocaine capsules and concealed a tube-like structure in her vagina.

The passenger egested the total 1.385 kg of cocaine (150 cocaine capsules) over a period of two days, under medical supervision. She has been arrested.

Further, an investigation is underway.
