INX Media case: Chidambaram sent to CBI custody till August 26

New Delhi, Aug 22: A special anti-corruption court on Thursday sent former Union Finance Minister P Chidambaram to CBI custody till August 26 in the INX Media corruption case.
In a 10-page order, Special CBI Judge Ajay Kumar Kuhar conceded CBI's plea for custodial interrogation of Chidambaram, observing that considering all facts and circumstances of the case, police remand is justified.

The court, however, allowed family members and lawyers to meet the Congress leader for 30 minutes every day and that a medical examination should be done every 48 hours.

"I have considered the rival submissions made by the learned Solicitor General as well as learned counsels for the accused regarding grant of five days police custody of the accused. The allegations made against the accused are serious in nature and there cannot be a dispute with the fact that a detailed and in-depth investigation is required in the present case," the order said.

"The allegations of payment being made to the accused in the year 2007-08 and 2008-09 are specific and categorical. The trail of this money if so paid is to be ascertained. No doubt it is a case to a large extent based on documentary evidence but those documents need to be traced and their value and their worth for the purpose of the investigation, in this case, is to be ascertained," it added. 

The court said the enormity of money allegedly involved in this case and the persons who are accused necessitate an in-depth investigation.

"It was submitted that the investigation agency did not call the accused for investigation after June 6, 2018, but in my view that cannot be a ground to deny the investigating agency and opportunity to conduct an effective investigation now," the order said.

It said the investigation needs to be brought to a logical end and for that purpose, the custodial interrogation is sometimes found useful and fruitful.

The Congress leader was taken to the court on Thursday afternoon after he was arrested by the CBI from his residence in New Delhi late on Wednesday.

Solicitor General Tushar Mehta, who argued for the CBI, had moved an application seeking 5-day custody of the Congress leader.

Mehta argued that custodial interrogation of the Congress leader was required as the former Finance Minister was "evasive" and "non-cooperative" in the investigation.

He said that the case, which is a classic example of money laundering, is in the pre-charge sheet stage.

Earlier, the court had reserved its orders after arguments were made by Chidambaram's counsel Kapil Sibal and Abhishek Manu Singhvi and Mehta.
Sibal said this "is the case which has nothing to do with evidence but with something else".

Chidambaram rejected the CBI charge that he was not cooperating and told the court that he had told the CBI that he has no overseas bank account while his son Karti has an account abroad.

"Please look at the questions and answers. There are no questions which I have not answered. Please read the transcript. They asked if I have a bank account abroad, I said no. They asked if my son has an account abroad, I said yes," Chidambaram said.

During the proceedings when Chidambaram said he wanted to speak, Mehta objected to his plea saying he is being represented here by two senior advocates.

Singhvi said there is a Delhi High Court judgment that allows the accused to make a representation on his behalf.

Opposing the CBI's plea for a five-day remand, Chidambaram's counsel told the court that he had cooperated with the investigating agency and has never skipped interrogation.

"Last night, the CBI said that they wanted to interrogate Chidambaram. They did not start the interrogation till 12 noon (today) and asked him only 12 questions. By now they should know what questions to ask. The questions had nothing to do with Chidambaram," Sibal told the CBI judge.

Sibal argued that the accused in this case Chidambaram's son Karti Chidambaram was granted regular bail by the Delhi High Court on March 2018 while the other accused, Peter and Indrani Mukerjea, were on default bail.

"Investigation (is) complete as draft charge-sheet is ready," he said adding that six secretaries were involved in the process of giving Foreign Investment Promotion Board approval in the INX Media case but none has been arrested.

"This is a case of documentary evidence. He (Chidambaram) has never skipped interrogation," he argued.

Referring to the Delhi High Court judgment rejecting the anticipatory bail of Chidambaram, Sibal argued, "If a judge has taken seven months to deliver the judgment, then is that the protective umbrella Chidambaram got? We are aggrieved."

Chidambaram's other counsel Abhishek Manu Singhvi argued that the CBI's entire case is based on Indrani Mukherjea's evidence and a case diary.

"Non-cooperation is if the probe agency calls me five times and I don't go. Non-cooperation is not giving the answer they like to hear. They called Chidambaram once and he went. Where is non-cooperation?" he said.

The order citing arguments of the CBI's lawyers said that Chidambaram was evasive to the question put to him after his arrest and did not cooperate with the investigation. 

They said the former minister did not respond to various documents which were shown during the probe and there were documents and material which had not been shown to the accused.

They also said that he was given protection by High Court through its order of May 31, 2018 "of which he has taken advantage of by being evasive" in the investigation.

Mehta argued that the accused has to be interrogated for the trail of money and submitted that during the interrogation on June 6, 2018 documents were required from the accused but he failed to produce them.

On Wednesday, the former minister failed to get relief from the Supreme Court over the CBI and the ED's pursuit of him as the matter was not heard by the court despite repeated efforts of his lawyers.

The CBI and the ED had filed caveats in the Supreme Court over Chidambaram's plea seeking protection from arrest in the INX Media case.

The Congress leader's lawyers had moved the apex court against Tuesday's Delhi High Court order dismissing his anticipatory bail plea regarding cases filed by the CBI and the ED related to the alleged INX Media scam. The Delhi High Court had in its order said that the grant of bail in cases like this will send a wrong message to the society.

New Delhi, Jan 22: Defence Minister Rajnath Singh on Wednesday said Indian values consider all religions equal, and that is why the country is secular and never became a theocratic state like Pakistan.

Speaking at the NCC Republic Day Camp in Delhi, Singh said: "We (India) said we would not discriminate among religions. Why did we do that? Our neighbouring country has declared that their state has a religion. They have declared themselves a theocratic state. We didn't declare so."

"Even America is a theocratic country. India is not a theocratic country. Why? Because our saints and seers did not just consider the people living within our borders as part of the family, but called everyone living in the world as one family," the minister said.

Singh underlined that India had never declared its religion would be Hindu, Sikh or Buddhist and people of all religions could live here.

"They gave the slogan of 'Vasudev Kutumbakam' -- the whole world is one family. This message has gone to the whole world from here only," he added.

New Delhi, Jan 19: Reacting to a tweet by ace lawyer Indira Jaising urging her to forgive the four men on death row for brutally raping that finally took her life, Nirbhaya's mother said on Saturday: "Even if God asks me, I won't forgive them."

Speaking to news agency, over the phone, the mother who had been fighting for seven long years to send her daughter's killers to the gallows, said, "...even if god comes and asks me to forgive them, I will not. People like these (Jaising) are a blot on the society."

Commenting on Jaising's tweet, she said: "Who is she to tell or suggest to me to forgive them. What relation does she have with me. I have nothing to do with such people. She can be a relative of those (the convicts) that she is having a soft corner for."

"She is an insult to women. She is running a business in the name of human rights. She is a veteran, she should give a message to the society. But she instead will go against her own kind," she added.

Earlier in the day, Jaising had requested Nirbhaya's mother to follow the example of Congress president Sonia Gandhi, who had moved for the clemency of a woman, Nalini Murugan convicted for the assassination of her husband and former Prime Minister Rajiv Gandhi.

"While I fully identify with the pain of Nirbhaya's mother I urge her to follow the example of Sonia Gandhi who forgave Nalini and said she didn't want the death penalty for her. We are with you but against death penalty," Jaising tweeted on Friday.

A Delhi Court on Friday issued fresh death warrants against the four convicts -- Akshay, Pawan, Mukesh and Vinay in the Nirbhaya gang rape and murder case.

Additional Sessions Judge (ASJ) Satish Kumar Arora fixed 1 February as the date of execution of the four death row convicts. They will be hanged at 6am.

The move came after the prosecution moved an application seeking issuance of fresh death warrants following the rejection of the mercy plea of one of the convicts Mukesh by President Ram Nath Kovind.

The 23-year-old victim was brutally gang-raped and tortured on December 16, 2012, which later led to her death.

All the six accused were arrested and charged with sexual assault and murder. One of the accused was a minor and appeared before a juvenile justice court, while another accused committed suicide in Tihar Jail.

Four of the convicts were sentenced to death by a trial court in September 2013, and the verdict was confirmed by the Delhi High Court in March 2014 and upheld by the Supreme Court in May 2017, which also dismissed their review petitions.

New Delhi, April 5: The number of coronavirus cases in India has surged past 3500 with 505 new cases in the last 24 hours from across the country.

According to the Union Ministry of Health and Family Welfare, the total number of COVID-19 positive cases in the country has gone up to 3,577 as on Sunday. So far, 83 people have died of the coronavirus.

Among States, the tally in Maharashtra stood at 690. According to Maharashtra Health Minister Rajesh Tope, till now Mumbai has reported 29 positive cases, Pune 17, PCMC 4, Ahmednagar 3, Aurangabad 2 among others.

Here are the top developments of the day related to the pandemic.

1) Four new COVID-19 positive cases reported in Uttarakhand today, taking the total number of positive cases in the State to 26. Four persons have been treated and discharged till date, according to the Directorate of Health Services, Uttarakhand.

2) Prime Minister Narendra Modi today called up two former Presidents -- Pranab Mukherjee and Pratibha Patil and had a discussion on COVID-19 related issues. He also called up two former Prime Ministers -- Manmohan Singh and HD Deve Gowda -- to discuss COVID-19 situation.

3) The Prime Minister also called up leaders of various political parties like Sonia Gandhi, Mulayam Singh Yadav, Akhilesh Yadav, Mamata Banerjee, Naveen Patnaik, K Chandrashekar Rao, MK Stalin, Parkash Singh Badal and Mayawati.

4) Total coronavirus positive cases rose to 68 in Punjab after three more cases were reported today --- one each in Ludhiana, SAS Nagar and Barnala. The person found positive in Ludhiana had attended the Tablighi Jamaat event in Delhi.

5) No evidence of COVID-19 being airborne yet, according to the Indian Council of Medical Research (ICMR).

7) With 14 new cases in Kashmir division, the total number of positive cases in Jammu and Kashmir now at 106. Active cases in Kashmir -- 82 and Jammu -- 18, said Rohit Kansal, Principal Secretary, Planning, UT of Jammu and Kashmir.

8) "There is an insufficiency of Personal Protective Equipment (PPE) kits and N95 masks. We are in touch with the Centre and other agencies for supply. Receiving 15,000 PPE kits today. Requested Centre for 5 lakh PPE kits received 4,000 only," said Bihar's Principal Secretary, Health, Sanjay Kumar.

9) The total number of positive cases in Indore, Madhya Pradesh, till now is 122 after 9 more positive cases were found today, according to Indore Chief Medical and Health Officer Dr Praveen Jadia.

10) Union Health Minister Dr Harsh Vardhan visits AIIMS dedicated centre for COVID19 in Jhajjar, Haryana. He said: "All 162 patients admitted here are in stable condition."

11) 86 COVID-19 positive cases reported in Tamil Nadu today out of which 85 had attended the Tableeghi Jamaat event at Markaz Nizamuddin, Delhi, according to Beela Rajesh Tamil Nadu Health Secretary. There are 571 COVID positive cases in Tamil Nadu out of which 522 cases are from the people who had attended the religious function in Delhi, she said.

12) The Congress party on Sunday posed nine questions to the Centre, demanding compensation to the family of those, who died after battling with the coronavirus.

13) 47 new coronavirus positive cases reported in Rajasthan today, taking the total number of positive cases in the state to 253.

14) 8 new COVID-19 cases reported in Kerala, which include 6 imports and 2 contact cases, said Chief Minister Pinarayi Vijayan.

15) "PPE kits are imported. So there was a shortage initially in the country but the government started taking action in this regard from January. Domestic manufacturers have started production. We have also started procuring PPE kits from other countries," said Lav Aggarwal, Joint Secy, Health Ministry.
