Irony dies a thousand deaths as Jio slams Trai's IUC review as ‘anti-poor’

Mumbai, Oct 20: Mukesh Ambani-led Reliance Jio has alleged that review of call connect charges by Trai "sabotages" the Prime Minister's vision for Digital India, and will hit not only the regulator's credibility but also investor confidence as the move protects vested interests of some old operators.

Continuing its relentless attack on the regulator and old operators over the contentious IUC (interconnect usage charge) issue that has polarised the industry, Jio alleged that Trai's move is arbitrary, bad in law, unwarranted, and anti-poor.

Any change in the implementation of the original timeline of January 1, 2020, will end the free voice regime and is likely to increase tariffs which are against consumer interest, Jio claimed.

Typically, a telecom operator pays for completing calls made by its subscribers to a rival network. This is done by paying the rival network an to interconnect usage charge, which currently is 6 paise per minute.

Trai's move to reopen the deadline for ending charges for terminating calls on rival networks beyond January 2020 had forced Jio to levy a 6 paisa per minute charge on its users recently, effectively ending its free call regime.

Submitting its official response to the Telecom Regulatory Authority of India (Trai) on the IUC matter, Jio alleged that "certain incumbent telcos" want their large body of 2G customers to forever remain digitally disempowered and deprived of the fruits of the digital revolution. Trai's consultation paper "protects and perpetuates the vested interests" of such players, it added.

Jio accused certain old operators of exploiting their 2G customers by charging "extortionist rates" for voice calls, which are offered free to all Jio's 4G-only customers.

"The Consultation Paper...undermines and sabotages Prime Minister's Digital India vision and mission," Jio said in its comment to Trai's consultation paper.

It is unfortunate that instead of profiting the poor and marginalised sections of Indian society, the consultation paper has chosen to help profiteers in the telecom business, Jio alleged.

The discussion paper wants India to remain technologically stagnant and backward, the company said.

The move contradicts the authority's past decisions where it was represented that the zero termination charge regime would come into effect for all types of calls from January 1, 2020, Jio said.

It added that the ongoing review, which violates the principles of regulatory predictability, has been initiated with pre-determined mind.

"...the present Consultation Paper has not been issued to address traffic asymmetry, but to address the claimed financial stress of one or two operators at the cost of the interests of the subscribers and the telecom sector, and also the credibility of the authority," it said.

The latest entrant, known for its disruptive tariffs, argued the present trend indicates that traffic asymmetry (one of the key reasons for Trai's rethink on IUC) is expected to be reversed in a few months and the present receivers will become payers, and so deferring stated timelines is not going to steer any operator away from the purported financial stress. Moving to zero termination charge regime will reduce overall tariffs for customers, Jio said.

Jio said that had Trai "recalculated termination charges, it would be less than 1 paise per minute at this stage", and added that the small residual value by itself fully justifies the need for moving to zero termination charge regime.

Jio cautioned that Trai's move will have a "chilling effect" on any new investments and future new entrants who will be deterred by this entry barrier, and even as the advanced world will move towards 5G, India will continue promoting 2G and keep millions of users out of Digital India.

"There exists no rationale for changing the date of implementation of BAK (bill and keep) regime from January 1, 2020," Jio added.

New Delhi, Feb 28: The Congress on Friday reacted sharply to the petition in the court seeking registration of a First Information Report against Sonia Gandhi, Rahul Gandhi and Priyanka Gandhi Vadra for alleged hate speeches. It said the petition was to save BJP leaders Pravesh Verma, Anurag Thakur and Kapil Mishra, referring to the trio as "PAK".

Congress leader Jaiveer Shergil told news agency, "It is political interest litigation to hide the failure of the government and to put a lid on the BJP's involvement in fuelling the fire in Delhi riots.

"This is to hide and save BJP's PAK -- Pravesh, Anurag and Kapil," said Shergil.

The BJP has two parameters, the laws for the common man and citizens of the country are different from those for the BJP leaders, added Mr Shergil.

The Delhi High Court on Friday issued notices on a petition for the registration of an FIR against Sonia Gandhi, Rahul Gandhi, Priyanka Gandhi Vadra and others on charges of delivering hate speeches.

Congress said that the PIL was politically motivated and the inaction on the hate speeches made by the BJP leaders, which led to the riots, was shocking.

"When there are 48 cases registered, why three cases against the BJP leaders are not registered," asked Mr Shergil.

A Bench of Chief Justice DN Patel sought responses from the Central and Delhi governments apart from Delhi Police on a petition filed by Lawyers Voice. The matter will again be heard on April 13.

The petition also sought a case against Aam Aadmi Party leaders Manish Sisodia and Amanatullah Khan, All India Majlis-e-Ittehadul Muslimeen leaders Akbaruddin Owaisi and Waris Pathan, and lawyer Mehmood Paracha.

"Issue directions to constitute an SIT to look into these hate speeches and take appropriate action. Issue direction to register an FIR against those named in the petition," the petition said.

Srinagar, Jan 15: The Jammu and Kashmir administration on Tuesday evening allowed mobile Internet in parts of Jammu region and broadband in establishments providing essential services, days after the Supreme Court ordered a review of the curbs imposed in the Union Territory.

The order comes into effect from January 15 and shall remain in force for seven days, a government communication said.

In a three-page order, the administration asked Internet service providers to offer broadband facility (with Mac binding) to all institutions dealing with essential services such as hospitals, banks and government offices.

In order to facilitate tourism, the broadband Internet services would be provided to hotels and tour and travel establishments, the order said.

Mac Binding essentially means to enforce a client machine to work from a particular Internet Protocol address.

"Prior to giving such facility, the service providers have been asked to install necessary firewalls and carry out white-listing of sites that would enable government websites and website dealing with essential services like e-banking," the order said.

However, all social media sites remain out of bounds. "There shall be complete restrictions on social media applications allowing peer-to-peer communication and virtual private network applications for the time being," the order said.

The institutions and government offices that are being provided Internet access shall be responsible to prevent misuse, according to the order.

It said the 2G mobile connectivity on post-paid mobiles for accessing white-listed websites including e-banking will be allowed in districts of Jammu, Samba, Kathua, Udhampur and Reasi -- all in the Jammu region.

The order said that the police has brought material relating to the terror modules operating in Jammu and Kashmir including handlers from across the border who are attempting to aid and incite people by transmission of fake news and targeted messages through use of Internet.

The relaxation came days after the Supreme Court said access to the Internet is a fundamental right under Article 19 of the Constitution.

The SC verdict had come on Friday on a batch of pleas challenging the curbs imposed in Jammu and Kashmir after the Centre's abrogation of provisions of Article 370 on August 5 last year.

The court had also asked the Jammu and Kashmir administration to review within a week all orders imposing curbs in the Union Territory.

It had asked the J-K administration to restore Internet services in institutions such as hospitals and educational places providing essential services.

The J-K administration's Tuesday communication said that in view of the Supreme Court directions, the situation has been reviewed and Internet has been opened whereever it was possible keeping in view the security consideration.

In Kashmir, 400 additional Internet kiosks will be established, besides the 900 terminals which are already operational in the Valley.

Bhadohi, Feb 11: With just two days left for the State Budget Session, a widow from Uttar Pradesh''s Bhadohi district has accused BJP MLA Ravindranath Tripathi and six others of sexual harassment over the years, the police said.

The incident is likely to cause considerable embarrassment to the ruling Yogi Adityanath government.

Bhadohi Superintendent of Police (SP) Ram Badan Singh said: "The woman, whose husband died in 2007, met the BJP MLA Ravindranath Tripathi''s nephew in 2014. She said that she was physically exploited by him for many years on the pretext of marriage."

The complainant also said that the nephew then got her lodged in a Bhadohi hotel for about a month during the 2017 Uttar Pradesh Assembly elections, "where she was raped by the MLA and his other family members".

The case has been handed over to the Additional Superintendent of Police for further investigations.

A case is yet to be registered.

The Uttar Pradesh Budget Session starts from Thursday.
