Jethmalani quits as Kejriwal's counsel, seeks Rs 2 crore fee

New Delhi, Jul 26: Ram Jethmalani has quit as chief minister Arvind Kejriwal's counsel in the civil and criminal defamation cases filed by Union finance minister Arun Jaitley against the CM.jethmalani

Following Kejriwal's denial of having instructed the lawyer to use derogatory language against Jaitley during court proceedings on May 17, the lawyer has written a letter to the CM, accusing him of using even more offensive language against Jaitley during private discussions on the case.

Jethmalani has asked Kejriwal to settle his legal fees amounting to more than Rs 2 cro5re. The lawyer used an offensive word, amounting to accusing Jaitley of being a criminal, during proceedings of the Rs 10-crore defamation case against Kejriwal and five other AAP leaders.

Jaitley asked Jethmalani if the word was spoken on his client's instruction. The lawyer replied in the affirmative and Jaitley filed another Rs 10-crore defamation suit against the CM.

Stung by the fresh defamation suit, Kejriwal filed an affidavit in Delhi high court and wrote a letter to Jethmalani saying he had not given any instructions for use of the derogatory word.

In his affidavit, Kejriwal said it was " inconceivable that he would even think of instructing the senior counsel to use such objectionable words". "Neither the defendant (Kejriwal) nor the counsel (Anupam Srivastava) briefing the senior counsel (Jethmalani) gave instructions to the senior counsel to use the objectionable words on May 17, 2017," Kejriwal said in the affidavit.

In response, after conveying his decision to quit as the CM's advocate, Jethmalani also told the CM to settle his legal fee, which, by a conservative estimate, would be over Rs 2 crore. The Delhi government had, this February, cleared a payment of Rs 3.5 crore to Jethmalani, which included Rs 1 crore as retainer and Rs 22 lakh as fee for each appearance in court.

However, the chief minister's office refused to comment on the matter, saying they "have no intimation on Jethmalani withdrawing from the case so far".

Jethmalani said, "Kejriwal has written a letter to me. I have replied to that. I am not going to divulge the details of either of the letters. You ask Kejriwal to make public both the letters. I have promised him not to make it public."

Sources said, in his letter, Jethmalani reminded Kejriwal about many conferences they had at the lawyer's residence and during which he had informed the CM about how PM Narendra Modi, impressed by his relentless fight against black money, had asked him to join BJP in 2010.

The letter also said the CM had shared the lawyer's anguish about BJP doing nothing to keep its election-eve promise to get back black money and deposit Rs 15 lakh in every Indian's bank account and how Jethmalani held Modi and Jaitley responsible for this.

During such conversations, Jethmalani alleged in his letter, Kejriwal had used even more objectionable words against Jaitley. The alleged use of derogatory words by Kejriwal during the conference appeared to have made Jethmalani repeat them during the May 17 proceedings before the HC registrar in the first defamation suit.

Jaitley had filed an application for expediting the recording of evidence in an orderly and fair manner in the first Rs 10-crore defamation suit against Kejriwal and the five AAP leaders for making allegations of corruption against him by them.

New Delhi, Jan 17: Airports in Srinagar and Jammu are to be “immediately” brought under the security cover of the CISF in view of the arrest of DSP Davinder Singh, a Jammu and Kashmir government order has said.

The two sensitive airports are to be “handed over” to the CISF by January 31, the order of the Jammu and Kashmir Home Department to the Director General of Police (DGP) said.

“This issue (CISF security at Srinagar and Jammu airports) has acquired immediacy in view of the recent developments relating to the arrest of Davinder Singh, DSP airport security, for trying to assist militants to travel to other parts of the country,” the order issued on Wednesday said.

Police had arrested Singh, a deputy superintendent of police, at Mir Bazar in Jammu and Kashmir’s Kulgam district on Saturday, along with Hizbul Mujahideen terrorists Naveed Baba and Altaf, besides a lawyer who was operating as an overground worker for terror outfits.

The two airports are guarded by the CRPF and the J-K Police at present.

The Union government had last year decided that the Central Industrial Security Force (CISF) will be handed over security of these two airports along with the one in Leh in view of their sensitive and strategic location and the threats it faced related to possible terrorist and hijack attempts.

CISF is the national civil aviation security force and at present it guards 61 airports including the ones at Delhi and Mumbai.

News agency had on January 13 reported that the Union home ministry sanctioned about 800 personnel to the CISF in order to take over security duties at the three airports of the newly created Union Territories of Jammu and Kashmir and Ladakh.

As per the original plan, the CISF was to take over Jammu airport by next month and the Srinagar and Leh airports after the spell of severe cold ends.

However, officials said, keeping in mind the arrest of the DSP and his alleged links, the latest order has been issued which also directs the J-K Police to make arrangements for accommodation, transport and other logistical requirements of the armed contingent of the CISF on a quick basis.

Once inducted at the most-sensitive Srinagar airport, the CISF will secure access control at both city and air side (tarmac area) while the CRPF will be responsible for securing the outer periphery. At the Jammu airport, the peripheral security duties will be rendered by the JK Police.

An assortment of surveillance and security gadgets like CCTVs, observation monitors, hand-held metal detectors, bullet-proof patrol vehicles and bomb detection and disposal equipment are also being provided by the airport operator, the Airports Authority of India (AAI), to the CISF.

The Union government sometime back made it clear that CISF will be the only civil airports guarding force and all such facilities in the country will be gradually brought under its command to bolster aviation security and tighten anti-terror and anti-hijack protocols.

New Delhi, Apr 28: Outstanding loans amounting to Rs 68,607 crore of top 50 wilful bank loan defaulters in the country including firms of Mehul Choksi and Vijay Mallya have been technically written off till September 30, 2019, the Reserve Bank of India said in a RTI reply.

Absconding dimantaire Choksi's company Gitanjali Gems tops the list of these defaulters with a whopping amount of Rs 5,492 crore, according to the list.

This is followed by REI Agro with Rs 4,314 crore and Winsome Diamonds with Rs 4,076 crore.

Rotomac Global Private Limited has funded advances of Rs 2,850 crore which have been technically written off and Kudos Chemie Ltd with Rs 2,326 crore, Ruchi Soya Industries Limited, now owned by Ramdev's Patanjali, with Rs 2,212 crore and Zoom Developers Pvt Ltd with Rs 2,012 crore being the other companies.

Mallya's Kingfisher Airlines figures in the list at number 9, with outstanding of Rs 1943 crore which have been technically written off by the banks.

Forever Precious Jewellery and Diamonds Private Limited has loans of Rs 1,962 crore written off while Deccan Chronicle Holdings Limited have Rs 1915 crore written off loans.

Choksi's other firms Gili India and Nakshatra Brands also have loans of Rs 1,447 and Rs 1109 crore respectively written off.

REI Agro of Jhunjhunwala brothers is already under the scanner of ED. The CBI and ED are also probing alleged fraud by the owners of Winsome Diamonds.

Vikram Kothari's Rotomac is the fourth in the list. He and his son Rahul Kothari were arrested by the CBI for bank loan default.

In the last Parliament session, Rahul Gandhi had asked the government to provide a list of top 50 bank loans defaulters in the country, leading to sharp exchanges and uproar in the Lok Sabha.

"The information on top 50 wilful defaulters and their sum of funded amount outstanding and amount technically/prudentially written off as on September 30, 2019 reported in CRILC by banks, is provided," the RBI said in its written response dated April 24.

In his application, RTI activist Saket Gokhale had sought the list of defaulters as on February 16, but the RBI said the requested information is not available.

The RBI said that according to section 8 (1)(a) of RTI Act 2005 read with para 77 of Supreme Court judgement of December 16, 2015 in Jayantilal N Mistry case, information on overseas borrowers is exempted from public disclosure.

"Data is as reported by banks and RBI will not be held responsibly or accountable for any misreporting and/or incorrect reporting by the reporting entities," the RBI said in the written reply to the RTI query.

New Delhi, Jul 23: With the highest single-day spike of 45,720 cases, India's coronavirus count crossed 12 lakh mark on Thursday.

The Union Ministry of Health and Family Welfare informed that 1,129 deaths were recorded in the last 24 hours.

The total number of coronavirus cases stand at 12,38,635 including 4,26,167 active cases, 7,82,606 cured/discharged/migrated. The cumulative toll has reached 29,861 deaths.

Maharashtra has reported 3,37,607 cases, highest in the country followed by Tamil Nadu with 1,86,492 cases. Delhi coronavirus count has reached 1,26,323 cases.

According to the Indian Council of Medical Research (ICMR), 1,50,75,369 samples were tested till July 22 out of which 3,50,823 samples were tested yesterday.
