Bengaluru, Sept 18: A division bench of the Karnataka high court on Tuesday dismissed as not maintainable a batch of writ appeals filed by former minister DK Shivakumar and four others in relation to summons issued by the Enforcement Directorate in a money-laundering case.

The bench, headed by chief justice Abhay Shreeniwas Oka, granted interim protection from arrest for four weeks to four aides of Shivakumar — businessman Sachin Narayan, transporter Sunil Kumar Sharma and two Karnataka Bhavan employees, Anjaneya Hanumanthaiah and N Rajendra — to allow them to file appeals.

However, they have to appear before the ED when summons are issued and cooperate with the investigation, the bench said. It noted that since a single bench considered their petitions under Section 482 of the Code of Criminal Procedure (CrPC), an intra-court appeal was not available to them under the HC Act.

At the same time, it noted that the single bench could not have rejected the prayer of interim protection as they have been under interim protection since February 22.

On August 29, a single bench had dismissed the petitions of Shivakumar’s associates. On August 30, the same judge rejected applications seeking interim protection from arrest by the ED.

Case against CM put off to September 26

The Kalaburagi bench of the Karnataka high court on Tuesday adjourned to September 26 the hearing of a case against chief minister BS Yediyurappa and three others in connection with the audio tape controversy.

Devadurga police lodged a case against then BJP state president Yediyurappa, BJP MLAs Preetham Gowda, and Shivanagouda Naik, and journalist MB Maramkal based on a complaint by Gurmitkal JD(S) MLA Naganagouda Kandakur’s son Sharanagouda.
