Karnataka HC quashes order discharging G Janardhana Reddy of life-term offence

Bengaluru, Oct 19: Former minister G Janardhana Reddy, the main accused in the multi-crore illegal mining and transportation of iron ore case, will have to stand trial for offences under IPC section 409 (criminal breach of trust by a public servant) which entails life sentence.

The Karnataka high court on Friday set aside orders passed by a special court for elected representatives, which discharged Reddy from the offence in three cases.

"The trial court has put the cart before the horse and proceeded to pass orders under challenge, that too after recording evidence of several witnesses," Justice BA Patil observed, while quashing orders passed by the special court in September last year.

The judge also noted that natural resources which were in the custody of representatives of the people and the officials concerned were illegally extracted.

Illegal mining

The case goes back to when Reddy was minister for t ourism and also minister in charge for Ballari district. The prosecution contends that between January 1, 2009 and May 31, 2010, the accused excavated iron ore illegally from various mines and forest areas and sold it to M/s Eagle Traders and Logistics and others, which was then illegally transported to Belekeri port for export.

"If persons who are duty bound to protect public properties indulge in such illegal acts, it is very serious and it cannot be held that ingredients of section 405 and 409 of IPC are not existing," Justice Patil said.

The CBI had contended that though the trial court has wide powers, there is no question of discharge midway during a trial after examining witnesses under IPC section 409.

On the other hand, it was argued on behalf Reddy that as the basic ingredients of section 405 (criminal breach of trust) of IPC are not made out against him, the charge under 409 of IPC doesn't survive.

Mangaluru, July 29: Justifying the transfer of Dakshina Kannada deputy commissioner Sindhu B Rupesh, district in-charge minister Kota Shrinivas Poojari has accused Mangaluru MLA U T Khader of politicizing the issue. 

The IAS officer was transferred by the Karnataka government on July 28, a day after a saffron activist issued a death threat against her on social media after she warned of legal action against the miscreants who attack cattle traders.

Condemning the development, Mr Khader had tweeted that the state government has punished the deputy commissioner instead of punishing the culprit, who issued death threat.

Responding to Mr Khader’s tweet, Mr Poojari said that the transfer of the officer was on administrative ground. “It is unfortunate that Khader politicized a transfer carried out by the government on administrative ground. This is not Khader’s time to protect any accused,” tweeted Mr Poojari. 

It is worth mentioning here that Mr Khader was the district in-charge minister of Dakshina Kannada before Mr Poojari taking over the position. 

Meanwhile, police has arrested a person in connection with the death threat against the IAS officer.

Bengaluru, Jan 2: Accusing Prime Minister Narendra Modi of "neglecting" Karnataka ahead of his visit on Thursday, the state Congress questioned why he did not give adequate relief and pay a visit to the state, when most of its parts were affected by severe floods last year.

Modi will begin his two-day visit to the state on Thursday afternoon.

The Congress' Karnataka unit in a series of tweets also questioned the Prime Minister about not conferring the "Bharat Ratna" on Shivakumara Swamiji of Siddaganga Math, who passed away last year at the age of 111 years.

"Why you did not visit the state, when it was affected by floods? Despite the damage of over Rs 1 lakh crore why you did not declare it as a national disaster? Why you did not give interim relief? When the state government has given a report that the damage caused was to the tune of Rs 35,300 crore why did you sit quiet by giving just Rs 1,200 crore," the state Congress tweeted.

As many as 103 taluks in 22 districts of Karnataka were affected due to unprecedented floods in August, in which over 80 people were killed.

Around seven lakh people were shifted to safe areas during the deluge and thousands of houses were damaged.

In October, various parts of the state faced a deluge for the second time in two months, killing over 13 people and damaging thousands of houses.

Asking as to why the Centre was not giving the state's share of GST amount adequately, the Congress questioned as to why dues under MNREGA programme were not paid so far, and why Karnataka was being neglected while allocating grants.

Questioning Modi as to why he did not visit Tumakuru when Shivakumara Swamiji of Siddaganga Math passed away, the principal opposition party in the state Assembly, also sought to know why the seer was not conferred with the Bharat Ratna yet.

It also pointed out that former Chief Minister Siddaramaiah had written a letter in this regard in January 2018.

The Congress has also hit out at the BJP-led Central government over imposition of Hindi language by neglecting regional languages and mother tongue.

The Prime Minister will kickstart his visit to the state by paying tributes to the late pontiff's 'Gadduge' (final resting place) at the Math premises near Tumakuru.

Later, he will attend an event organised to give away Krishi Karman awards and to distribute fishing equipment at the government college ground in Tumakuru, before leaving for Bengaluru where he will be attending a DRDO event.

On Friday he will be inaugurating 107th Indian Science Congress here.

Mangaluru, Feb 20: A wild tusker was spotted in Kukke Subrahmanya town here, in the early hours of Thursday.

Range Forest Officer (RFO), Kukke Subrahmanya Tyagaraj said that it was seen walking from Kashi Kattte in the town to Nuchila around 0530 hours without creating any havoc.

The same elephant was spotted some days ago at Harihara, a small village town near Kukke Subrahmanya.

It has been roaming around in the forests nearby for some time now. So far, it had not caused disturbance to people nor had it damaged any property, Mr. Tyagaraj said.

Kukke Subrahmanya is on the foot of the Western Ghats.
