Kathua: J-K CB presses perjury charges against witness

Jammu, Nov 8: The Jammu and Kashmir crime branch has initiated the process of pressing perjury charges against a witness in the case of rape and murder of an eight-year-old girl after he had retracted from a "confessional statement" recorded in front of a magistrate, officials said on Thursday.

A show-cause notice has been served to Ajay Kumar alias 'Ajju' by the sessions judge of Pathankot, Tejwinder Singh, asking him to explain on Monday "why an action under section 479-B of Jammu and Kashmir Criminal Procedure Code may not be initiated against him".

This section provides summary procedure for trial of witnesses deposing contrary to statements recorded under Section 164-A (evidence of material witnesses to be recorded by Magistrate in certain cases).

Kumar had recorded his statement before a judicial magistrate in Jammu on February 27 this year in which he had claimed that Parvesh Kumar alias 'Mannu' had given a graphical description about the rape and subsequent murder of the girl belonging to a nomadic minority community.

The notice served on Kumar says "whereas an application has been filed by prosecution for initiating action against you for voluntary and knowingly retracting from your statement under section 164-A CrPC during your deposition as a prosecution witness before court, a show-cause notice is issued to you as to why an action under section 479-B of CrPC may not be initiated against you."

"You may appear before this court in person or be represented by a counsel on 12.11.2018," the notice from the sessions court of Pathankot said.

The session judge is holding trial for the gruesome Kathua rape-and-murder case on directions of the Supreme Court.

The trial was assigned to the district and sessions court in Pathankot by the Supreme Court earlier this year after the victim's family approached with a plea to transfer the case from Kathua.

The eight-year-old girl, belonging to a nomadic tribe, was allegedly kidnapped on January 10 and her body was found on January 17. It is alleged that she was gang-raped and later murdered. The crime branch has arrested eight people, including a juvenile in the case.

The charge sheet has been filed against Sanji Ram and his juvenile nephew, his son Vishal, special police officers Deepak Khajuria and Surender Verma and friend Parvesh Kumar alias Mannu.

The charge sheet also names head constable Tilak Raj and sub-inspector Anand Dutta -- who allegedly took Rs 4 lakh from Sanji Ram and destroyed crucial evidence.

The district and sessions court in Pathankot framed charges of rape and murder against the seven accused in the case on June 8.

Sanji Ram, considered the main accused, is alleged to have hatched the conspiracy with the other accused for kidnapping the girl as part of a strategy to remove the minority nomadic community from the area.

May 28: Congress President Sonia Gandhi on Thursday asked the central government to unlock its coffers and help the needy affected by the coronavirus-induced lockdown.

In a video message posted as part of the Congress' 'Speak Up India' campaign, she lamented that even though the country is passing through a serious economic crisis with loss of livelihood due to the pandemic and the lockdown, the central government has not heard the cries of pain and trauma of people.

"We again urge the Centre to unlock its coffers and help the needy. Put direct cash of Rs 7,500 per month in the account of every family for the next six months and provide Rs 10,000 immediately; ensure safe and free travel of labourers back home, employment opportunity and rations; and also increase the number of work days under MNREGA to 200 days to facilitate jobs in villages," Gandhi said.

"Instead of loans, provide financial relief to small and medium industry so that crores of jobs are saved and the country progresses," she said in her video message on the party's social media handles.

Washington, Jul 18: The Foreign Direct Investment (FDI) from the US to India has crossed the $40 billion mark so far this year, reflecting the growing confidence of American companies in the country, the head of an India-centric business advocacy group has said.

The American companies, during the Covid-19 pandemic, which has battered the world economy, have shown great confidence in India and its leadership, said Mukesh Aghi, president of the US-India Strategic and Partnership Forum (USISPF), which keeps a track of the major US FDIs in India.

“Year to date investment from the US, including the recent ones, is over $40 billion,” Aghi said.

In recent weeks alone, the announcement of the FDI into India has been over $20 billion, he said, referring to the announcements made by some of the top companies like Google, Facebook and Walmart.

“Investors’ confidence in India is high. India still remains a very promising market for global investors. If you look at the $20 billion… not just the US, but (investment) has also come from other geographies such as the Middle East and the Far East.

“So, India still remains a very, very bullish market for the investor community,” Aghi said in response to a question.

The USISPF has been working with New Delhi to bring in FDI into India… playing a key role in encouraging American companies planning to move their bases out of China, he said, adding that the move was going on in the last three years of the Trump administration, but gained momentum during the coronavirus pandemic.

“We feel that Prime Minister (Narendra Modi’s) intention is very high. The challenges lie on the execution side. Efforts are being made to encourage manufacturing… I've never seen it so better. The policy framework is moving in the right direction,” he said.

Early this week, Larry Kudlow, the White House Economic Advisor, told reporters that the US tech giants like Google and Facebook announcing big investments in India shows that people are losing trust in China and India is emerging as a big competitor.

At the same time, he rued that India continues to be a protectionist country.

“The question is how do you define protectionism... the administration here is saying America first and India is saying vocal for local…,” Aghi added.

Mumbai, May 10: Air India, which is operating flights to evacuate Indians stranded in foreign countries, have asked its pilots to undertake coronavirus test before they operate such flights, the sources said.

"Five Air India pilots have tested positive for coronavirus. These pilots were tested one after one. We suspect it could be a case of faulty testing kit as well," one of the sources said.

The five pilots fly Boeing 787 planes, the second source said.

Air India spokesperson did not offer any comment.

A senior airline official said the five pilots had not operated any flight in the last three weeks.

"These pilots had operated cargo flights to China prior to April 20," the official said.
