Kathua temple rape: Sedatives left victim unable to resist sexual assault

Jammu/Pathankot, Jul 30: The eight-year-old girl from Kathua, who was gang-raped and killed, was overdosed with a cocktail of sedatives through her captivity, "rendering her incapacitated" to resist sexual assault and murder, states the supplementary charge sheet filed by Jammu and Kashmir's Crime Branch on Monday.

The charge sheet filed in the Pathankot sessions court sums up the investigation of the Jammu and Kashmir Police's Crime Branch team and also gives details of the analyses of calls and bank accounts that led it to the eight accused of the brutal crime in January this year.

The supplementary charge sheet was submitted by a Crime Branch team -- led by Senior Superintendent of Police R K Jalla and special public prosecutors J K Chopra and Santokh Singh Basra, Bhopinder Singh and Harminder Singh -- before Pathankot District and Sessions Judge Tejwinder Singh.

"We have submitted the supplementary charge sheet, giving details of call analyses, bank details and medical reports," special public prosecutor Chopra told PTI.

The charge sheet lists in chilling detail the sedatives, including cannabis, forcefully given to the child from a minority nomadic community, who was abducted on January 10 and allegedly kept in captivity for three days. She was killed on January 14 and her body was found in a forested area near Kathua on January 17, officials said.

During the course of the investigation, "it has been established that the victim was administered sedatives by accused during her captivity", the charge sheet states.

She was given 'mannar' (believed to be local cannabis) as well as Epitril 0.5 mg on an empty stomach, it says.

"She was forcefully administered five tablets of Clonazepam of 0.5 mg each on January 11, 2018, which is higher than the safe therapeutic dose. Subsequently, more tablets were given...The signs and symptoms of an overdose may include drowsiness, confusion, impaired coordination, slow reflexes, slowed or stopped breathing, coma (loss of consciousness) and death," according to the medical expert's report submitted along with the charge sheet.

The peak concentration of Clonazepam is achieved in the blood after "one hour to 1.5 hours" of oral administration and its absorption is complete "irrespective of (whether it is) administered with or without food", states the report.

It says the tablets given to the eight-year-old could have pushed her into a state of shock or coma.

"... the expert opinion coupled with other evidence that has come on record prima-facie establishes that the victim child was continuously administered an overdose of Clonazepam (Epitril) rendering her incapacitated to resist rape and murder," the charge sheet says.

The Crime Branch has arrested Sanji Ram, custodian of a temple where the child was allegedly confined, his son Vishal and his juvenile nephew, two special police officers Deepak Khajuria alias 'Dipu' and Surender Verma and friend Parvesh Kumar alias Mannu. All of them were named in the first charge sheet on April 9.

It also arrested head constable Tilak Raj and sub-inspector Anand Dutta, who allegedly took Rs 4 lakh from Ram and destroyed crucial evidence. Raj and Dutta have since been dismissed from service.

The supplementary charge sheet highlights the efforts of Vishal and his father Ram, alleged to be the mastermind behind the crime, to create an alibi. They were allegedly trying to show that Vishal had never visited Kathua was actually taking an exam on January 15.

It says Kumar was not only in constant touch with Khajuria but also in contact with Raj, who is alleged to have played a pivotal role in striking a deal between the police and Ram for destruction of evidence.

The charge sheet has submitted Kumar's detailed call analysis to show he shared a common location with other accused on crucial dates of the crime and immediately thereafter.

The duration of the calls made and their frequency increased after the rape and murder, leading to "irresistible conclusion of knee deep involvement of accused Surinder Kumar with other accused...", the charge sheet says.

The Crime Branch also conducted an analysis of the two bank accounts of Ram and found he had made huge cash withdrawals.

Witness statements recorded by the Crime Branch confirmed the accused had undertaken no constructional activity and had no social obligation either, the document says.

The Crime Branch alleged in its charge sheet that the withdrawals were made to bribe the police officers for the destruction of evidence.

A copy of the supplementary charge sheet has been handed to the defence counsel.

Earlier this month, the Crime Branch informed the Supreme Court that it would be submitting a supplementary charge sheet in the case.

The apex court bench, comprising Chief Justice of India Dipak Misra and Justices D Y Chandrachud and Indu Malhotra, had on July 9 given it eight weeks to file the document.

The district and sessions court in Pathankot framed charges of rape and murder against the seven accused in the case on June 8, after the Supreme Court transferred the case from Kathua on a plea of victim's family.

Ram, considered the main accused, is alleged to have hatched the conspiracy with the other accused for kidnapping the girl as part of a strategy to remove the minority nomadic community from the area.

The fate of the eighth accused, a juvenile, was yet to be decided after the Crime Branch moved an application in the high court claiming him to be an adult.

Mumbai, Jun 1: Singer-composer Wajid Khan of music director duo Sajid-Wajid, popular for their work on superstar Salman Khan's films such as "Wanted", "Dabangg" and "Ek Tha Tiger", died in early hours of Monday in a city hospital due to complications arising from a kidney infection. He was 42.

Music composer Salim Merchant, who confirmed the news of Wajid's death, said the composer was hospitalised few days ago at Surana Hospital, Chembur where his condition deteriorated.

"He had multiple issues. He had a kidney issue and had a transplant a while ago. But recently he got to know about kidney infection... He was on the ventilator for the last four days, after his situation started getting worse. Kidney infection was the beginning and then he got critical," Salim told PTI.

The music composer duo made their Bollywood debut with Salman's 1998 movie "Pyaar Kiya Toh Darna Kya" and went on to work on actor's various films including "Garv", "Tere Naam", "Tumko Na Bhool Payenge", "Partner" and the popular "Dabangg" franchise.

Wajid also did playback for Salman in chartbusters like "Mera He Jalwa", "Fevicol Se" and for Akshay Kumar in "Chinta Ta Chita Chita" from the film "Rowdy Rathore", among others. He recently co-composed Salman's songs "Pyaar Karona" and "Bhai Bhai", which the actor released on his YouTube channel.

Wajid along with his brother Sajid served as mentor on singing reality shows "Sa Re Ga Ma Pa 2012" and "Sa Re Ga Ma Pa Singing Superstar".

The composer duo also scored IPL 4 theme song, "Dhoom Dhoom Dhoom Dhadaka", which was sung by Wajid.

Soon after the news of the composer's demise broke, many from the film fraternity took to Twitter to pay tributes.

Actor Priyanka Chopra said she will always remember Wajid's smile.

"The one thing I will always remember is Wajid bhai's laugh. Always smiling. Gone too soon. My condolences to his family and everyone grieving. Rest in peace my friend. You are in my thoughts and prayers," she posted on Twitter.

Actor Parineeti Chopra said Wajid was one of the "nicest" men in the industry.

"Always singing. All heart. Always positive. You will truly be missed Wajid bhai," she tweeted.

Actor Varun Dhawan shared a picture of his filmmaker-father David Dhawan with Wajid and remembered the musician as one of the most positive people in Bollywood.

"Shocked hearing this news @wajidkhan7 bhai was extremely close to me and my family. He was one of the most positive people to be around. We will miss you Wajid bhai thank you for the music," he wrote.

Music composer-singer Vishal Dadlani said he was "heartbroken" after hearing the news.

"Both @SajidMusicKhan and @wajidkhan7 have been close & true friends. The kind who might see the light on and show up at our studio in the middle of the night just to meet and talk and share a laugh. Can't believe Wajid and I will never speak again," he wrote.

Singer-composer Shankar Mahadevan said he was still unable to come to terms with the news of Wajid's demise.

"Shocking ! Good bye dear brother.. love you .. till we meet on the other side ! Prayers for your peaceful journey Wajid bhai," he tweeted.

Singer Javed Ali posted, "Feeling Deeply Saddened after hearing shocking news of the sudden demise of Wajid Khan. May his Soul Rest in Peace. My heartfelt condolences to his family. May Allah give strength to the family."

Aug 3: Iqbal Ansari, who was a litigant in the Ayodhya land dispute case, has decided to gift a 'Ram nami' stole and a copy of the Ramcharitmanas to Prime Minister Narendra Modi when he attends the bhoomi pujan ceremony for the Ram temple here on Wednesday.

"Yes, I have received the invitation from Shri Ram Janmabhoomi Teerth Kshetra Trust for the bhoomi pujan ceremony. I will certainly attend it. The dispute is over now after the court's verdict," Ansari, 69, told .

"Our Prime Minister is coming. I will meet him and give him a 'Ramnami' stole (with Ram's name written on it) and Ramcharitmanas as a present," Ansari said.

His father Hashim Ansari, the oldest litigant in the Babri Masjid-Ram Janmabhoomi land dispute case, died at the age of 95 in 2016 after which the son started pursuing the case in the court.

Talking about Wednesday's ground-breaking ceremony to mark the beginning of the construction of a grand Ram temple here, Ansari said, "I belong to Ayodhya. All this (temple's construction) will change the fate of Ayodhya. We all want our child to get better opportunities".

He further said, "I respect sadhus and saints. I am happy to have received the invitation for the ceremony. I think it is Lord Ram's will that I attend it".

When asked what he would have done had the court decided the case in his favour, Ansari said he had wanted the construction of a school and a hospital on the disputed land.

"I feel the city needs development. The future of our children should be safe and secure and they should get employment. Dispute in the name of religion should end now and we should let the city witness a new beginning," he said.

The Supreme Court had in November last year paved the way for the construction of a Ram temple by a Trust at the disputed site of the Babri Masjid's demolition in Ayodhya, and directed the Centre to allot an alternative 5-acre plot to the Sunni Waqf Board for building a new mosque at a "prominent" place in the holy town in Uttar Pradesh.

The state government has allotted a five-acre land in Dhannipur village in Sohaval Tehsil of Ayodhya for the mosque's construction.

New Delhi, Apr 24: The Jamia Coordination Committee (JCC) on Friday accused Delhi Police of framing two of its members - Meeran Haider, Safoora Zargar, along with student leader Umar Khalid, as part of "an imaginary conspiracy behind the recent North East Delhi riots".

While Haider was arrested on April 2, Zargar was taken in custody on April 10 for their alleged involvement in fuelling the riots.

"These arrests by the police have little ground, and the charges seem to have no rhyme or reason. Safoora was even granted bail in the case she was initially arrested in, following which she was arrested and had heavier charges placed against her," the JCC said in a statement.

Meeran, Safoora and Umar have been charged under the Unlawful Activities (Prevention) Act (UAPA), which allows curbing of fundamental rights in order to protect the sovereignty of India. The JCC, however, claimed that in this case, the Act is being used to suppress their voices.

"This Act has been used against many activists working to protect constitutional morality, a list which now includes members of the JCC, a wholly constitutionalist collective of students and alumni," the JCC said, defending its members.

JCC maintained it had no role in Delhi riots, but apprehended that more people will be arrested by the Delhi Police as part of its conspiracy against students and protestors.

"It is almost certain that more protesters will be framed and arrested in the conspiracy invented by the Delhi Police. JCC reiterates that it played no part in the riots, and this fact will be proved before any court of law," it said in a statement.

It also demanded political parties, and university administration take a stand for the two accused JCC members and student leader Umar Khalid.

The JCC came into existence after a violent face-off between Delhi Police and unruly anti-CAA protestors left Jamia Millia Islamia vandalised. It was after this, that a group of students from the Jamia Millia formed it to decide upon the future course of actions in protest against the CAA and the police action.
