Lesbians, gays and bisexuals not third gender, clarifies SC

New Delhi, Jul 1: The Supreme Court on Thursday clarified that its verdict — recognising transgenders as a third category, other than male or female — does not include lesbians, gays and bisexuals.

“Our judgment is self-explanatory. Why should we not dismiss the application with cost,” the bench asked Additional Solicitor General Maninder Singh, who, representing the Centre, submitted that it was required to state that the term transgender did not include lesbians, gays and bisexuals.

The law officer contended that it would create difficulty if no modification was issued, as transgenders were to be treated as OBC, giving them reservation in jobs and admission to educational institutions. He cited a paragraph from the 2014 judgment underlining that the term ‘transgender’ can be construed in a wider sense to connote the entire lesbian, gay, bisexual and transgender (LGBT) community.

Senior advocate Anand Grover submitted that the Union government has not been implementing the judgment for the past two years.

The bench disposed of the application by observing that the judgment, at more than one place, clearly stated that transgenders would not mean lesbians, gays and bisexuals.

In its modification application, the government had resisted the direction to classify all transgenders as OBCs. But on Thursday, the Centre confined itself to the plea of clarification only.

With the court’s order on Thursday, the Union government would be left with no option than to implement the historic verdict recognising transgenders as third gender and considering them as socially and economically backward classes.

Notably, a separate matter, also concerning the rights of lesbians, gays, bisexuals and transgenders, is pending adjudication before the apex court, wherein the activists sought a direction to de-criminalise gay sex among consenting adults.

In 2014, acting on a PIL by National Legal Services Authority, the apex court had said, “Each person’s self-defined sexual orientation and gender identity is integral to their personality and is one of the most basic aspects of self-determination, dignity and freedom, and no one shall be forced to undergo medical procedures, including sex re-assignment surgery, sterilisation or hormonal therapy as a requirement for legal recognition of their gender identity.”

The discrimination faced by transgenders, also known as ‘Hijras’, eunuchs, ‘Kothis’, ‘Aravanis’, ‘Jogappas’, ‘Shiv-Shakthis’ etc, was “unimaginable” and their rights had to be protected, the court had said.

New Delhi, Feb 13: The BJP's Amit Shah today said statements like "goli maaro" and "Indo-Pak match" should not have been made by BJP leaders ahead of the Delhi elections.

The BJP may have suffered in the elections because of hate statements made by party leaders, he said, reported news agency Press Trust of India.

The party, he said, had distanced itself from such remarks.

New Delhi, Mar 7: No country in the world says everybody is welcome, External Affairs Minister S Jaishankar said on Saturday, hitting out at those criticising India over the Citizenship (Amendment) Act.

Jaishankar criticised the United Nations Human Rights Council (UNHRC) for its criticism on the situation in Jammu and Kashmir, saying its director had been wrong previously too and one should look at the UN body's past record on handling the Kashmir issue.

"We have tried to reduce the number of stateless people through this legislation. That should be appreciated," he said when asked about the CAA at the ET Global Business Summit. "We have done it in a way that we do not create a bigger problem for ourselves."

"Everybody, when they look at citizenship, have a context and has a criterion. Show me a country in the world which says everybody in the world is welcome. Nobody says that," the minister said.

The external affairs minister said moving out of the Regional Comprehensive Economic Partnership (RCEP) was in the interest of India's business.

Asked about the UNHRC director not agreeing with India on the Kashmir issue, Jaishankar said: "UNHRC director has been wrong before.

"UNHRC skirts around cross-border terrorism as if it has nothing to do with country next door. Please understand where they are coming from; look at UNHRC's record how they handled Kashmir issue in past," he added.

Kochi, Apr 14: Reacting to the extension of the nationwide lockdown till May 3, Kerala Finance Minister Thomas Issac on Tuesday maintained that his state needs money more than appreciation for the work it has done to mitigate the impact of the lockdown and contain coronavirus spread.

"The only additional money that Kerala received is mere Rs 230 crore and that too for Covid-19 work. The funds we received to tide over revenue deficit is different -- we would have got it anyways," said Issac, who has been demanding more liberal financial assistance from the Centre.

"The need of the hour now is for the Centre to immediately hold a videoconference meeting with all state Finance Ministers. The Centre should borrow more money from the RBI and give it to the states. Otherise, things will be very bad, as the economy, especially rural economy, is tumbling. It needs to be checked," said the Kerala Minister.

Devasom and Tourism Minister Kadakampally Surendran said the state Cabinet will meet on Wednesday to decide how to go about things till May 3.

"The coronavirus figures reveal that Kerala has done quite well. The Cabinet will decide on how we move forward after looking into the guidelines of the Centre," said Surendran.

Local Self Government Minister A.C. Moideen said that local farm produce has to reach markets as rural economy revolves around this. The Cabinet will look into this issue as well.

Health Minister K.K. Shailaja stressed the need for maintaining social distancing and asked all to see that the lockdown guidelines were strictly followed.

"Our advantage is that we have been able to contain the spread, but we still have a long way to go. Singapore is the best example -- after a slowdown in positive cases, it picked up there. So, let us all continue to maintain strict vigil and wait till Wednesday's Cabinet meet," said Shailaja.
