Lok Sabha passes triple talaq bill after Cong, AIADMK stage walkout

New Delhi, Dec 27: Lok Sabha on Thursday passed the bill which criminalises the practice of instant triple talaq, with the government rejecting the contention that it was aimed at targeting a particular community.

The opposition, which had been demanding that the bill be referred to a joint select committee, staged a walkout when its demand was rejected by the government.

The Muslim Women (Protection of Rights on Marriage) Bill 2018 was passed by the Lower House with 245 voting in favour and 11 opposing the legislation.

The bill will now go to Rajya Sabha for approval.

Piloting the bill, law minister Ravi Shankar Prasad said that there should be no politics on the bill, stressing that it was not against any particular community.

"Don't weigh the bill on the scales of politics. The bill is about humanity and justice," he said, urging lawmakers of different parties to speak in one voice to support the legislation.

He regretted that opposition parties were creating hurdles in its passage due to "vote bank politics".

The fresh bill will supersede an earlier bill passed in the Lok Sabha and pending in the Rajya Sabha.

The bill to make the practice of triple talaq among Muslims a penal offence was introduced in Lok Sabha on December 17 to replace an ordinance issued in September.

Under the proposed law, giving instant triple talaq will be illegal and void, and will attract a jail term of three years for the husband.

In view of the opposition by some parties in the upper house, the government had then cleared some amendments, including introduction of a provision of bail, to make it more acceptable.

Congress, TMC, AIADMK and RJD staged walkout soon after Prasad concluded his reply. Several amendments moved by opposition were negated by a division that was insisted by opposition members.

Responding to demand of opposition parties, including the Congress and the Trinamool Congress, that the bill be sent to a select committee for study, Prasad said the government has already taken note of concerns expressed by members earlier and amended the bill accordingly.

Prasad said the bill has made the offence compoundable, meaning that the case can be withdrawn if the man and his estranged wife reach a compromise, and that only the wife and her close relatives can file an FIR, ruling out the law's misuse.

He said as many as 477 cases of triple talaq have been reported since January 2017 and cited a case where a professor gave talaq to his wife over Whatsapp.

Whereas another muslim man gave talaq to his wife for attending the Prime Minister Narendra Modi's rally, the Union law minister said, urging if the House unitedly can pass a bill for capital punishment for rape of girls below age of 12 years, then why not this legislation.

Leader of Congress party in Lok Sabha, Mallikarjun Kharge, said that bill was against the spirit of the Constitution and has violated several articles dealing with the rights of individuals.

Congress MP Sushmita Dev said the real purpose of the bill was not to empower Muslim women but to "penalise" Muslim men.

Demanding that the bill be referred to the joint select committee of Parliament, Dev said criminalisation of triple talaq goes against the Supreme Court verdict.

AIADMK leader P Venugopal, TMC's Sudip Bandhopadhyay, AIMIM's Asaduddin Owaisi and Supriya Sule (NCP) also made similar demands.

Union minister Smriti Irani said if Parliament can enact laws to ban dowry and the practice of sati, it can also approve the bill to ban instant triple talaq.

Defending the penal provisions in the bill, Union minister Mukhtar Abbas Naqvi said it was important to instil fear in the minds of those still practising it and rejected suggestions that it was against any religion.

New Delhi, Mar 5: A Delhi court Thursday issued fresh death warrants for execution of the four convicts in the Nirbhaya gang rape and murder case for March 20 at 5.30 am.

Additional Sessions Judge Dharmendra Rana fixed March 20 as the new date of execution after it was told by the Delhi government that the convicts have exhausted all their legal remedies.

The lawyer for the four death row convicts also told the court that there was no legal impediment for the court to proceed in fixing the date of execution.

Pune, Jul 4: Now that wearing mask in public places has become the new normal, a resident of Pimpri-Chinchwad of Pune district, Shankar Kurade has got himself a mask made of gold worth Rs 2.89 lakhs amid the COVID-19 pandemic.

"It's a thin mask with minute holes so that there is no difficulty in breathing. I am not sure whether this mask will be effective," said Kurade.

Kurade loves wearing gold ornaments and his hands and neck are loaded with jewellery.

This unique idea struck him soon after he saw a man wearing a silver mask on social media.

"I saw a video on social media of a man in Kolhapur wearing a silver mask and then an idea struck me to have a mask of gold. I talked to a goldsmith and he gave me this five and a half pound gold mask in a week," said Kurade.

"All my family members love gold, if they too demand it, then I will get it designed for them too. I do not know if I will be infected with coronavirus wearing a gold mask or not, but following all the rules of the government can prevent the spread of virus," he added.

Since childhood, Shankar is very fond of gold ornaments, that is the reason he wears gold rings in all the fingers, gold bracelets on his wrist and huge gold chains around his neck.

Kolkata, Jan 2: In what could spark fresh tensions between West Bengal Chief Minister Mamata Banerjee and the BJP-led centre, the Union Ministry of Defence on Wednesday rejected her state's tableau proposal for the Republic Day parade on January 26.

"The tableau proposal of West Bengal government was examined by the expert committee in two rounds of meetings. The tableau proposal of the West Bengal government was not taken forward for further consideration by the committee after deliberations in the second meeting," the ministry said in its statement.

Twenty two proposals comprising 16 states and union territories and six ministries and departments have been shortlisted for the parade. The shortlist was compiled from as many as 56 tableau proposals - 32 from states and union territories and 24 from various ministries and departments - received by the central government.

"The expert committee examines the proposals on the basis of theme, concept, design and visual impact before making its recommendations. Due to time constraints arising out of the overall duration of the parade, only a limited number of tableaux can be shortlisted for participation in the parade," the statement read, adding that West Bengal was shortlisted for the 2019 Republic Day parade through a similar process.

"The rejection of the West Bengal tableau for the Republic Day parade is discriminatory. It has been done because West Bengal has been opposing the centre's CAA (Citizenship Amendment Act) and the NRC (National Register of Citizens) plans," Trinamool Congress MP Saugata Roy told news agency.

"West Bengal is known to be living state as far as culture, including arts, music and other things are concerned. So obviously, this is a discriminatory step taken by the central government against West Bengal," Mr Roy added.

The Trinamool Congress-led Bengal government is at loggerheads with the central government over several issues, and the expanding presence of the BJP in the eastern state ahead of the 2021 assembly elections has further intensified their rivalry.

Mamata Banerjee has repeatedly said that she will not allow Bengal to be a part of the proposed nationwide National Register of Citizens, an assertion that the BJP claims is proof of her minority appeasement strategy. Last month, a four-member delegation of Trinamool Congress politicians that visited BJP-ruled Uttar Pradesh to meet families of those killed in violent protests against the Citizenship Amendment Act were stopped by police personnel at the Lucknow airport.

The BJP leadership has now decided to launch a campaign blitzkrieg in West Bengal to counter what it claims is the Trinamool's "misinformation programmes" against the amended citizenship law and reach out to refugees. Protests across the country have currently put the party on the backfoot.

The Citizenship Amendment Act, for the first time, makes religion the test of citizenship in India. The government says it will help minorities from three Muslim-dominated countries get citizenship if they fled to India because of religious persecution before 2015. Critics say it is designed to discriminate against Muslims and violates the secular principals of the Constitution.

Brazilian President Jair Bolsonaro will be the chief guest at the Republic Day celebrations.
