Mallikarjun Kharge to be on CIC selection panel

New Delhi, Nov 4: Leader of Congress in Lok Sabha Mallikarjun Kharge has been inducted into the three-member selection committee which will select the Chief Information Commissioner.

Mallikarjun KhargeAs per file notings, Prime Minister Narendra Modi, who heads the panel, has nominated Defence Minister Arun Jaitely besides Kharge to the committee.The decision to include Kharge has been taken on the advice of Law Ministry as there was lack of clarity on the Leader of Opposition in Lok Sabha.

The RTI Act requires that selection of the Chief Information Commissioner be done by a three-member panel comprising the Prime Minister, who shall be the Chairperson of the committee, Leader of Opposition in Lok Sabha and a Cabinet Minister to be nominated by the Prime Minister.

"For the purposes of removal of doubts, it is hereby declared that where the Leader of Opposition in the House of the People has not been recognised as such, the Leader of the single largest group in opposition of the Government in the House of the People shall be deemed to be the Leader of Opposition," the Act says.

The file notings accessed by activist Commodore (Retd) Lokesh Batra show that the Lok Sabha Secretariat had conveyed to DoPT on June 19, 2014, that "as on date, there is no Leader of Opposition in Lok Sabha. Indian National Congress with a strength of 44 mmbers is, however, the single largest party in opposition to the Government in Lok Sabha.

"As per the information received from the party, Mallikarjun Kharge is the Leader of Indian National Congress in Lok Sabha which is the single largest party in opposition in Lok Sabha."

After receiving the response, DoPT had referred the matter to Law Ministry seeking to know whether leader of single largest party can be "treated" as leader of "single largest group" in the Lok Sabha for the purpose of the RTI Act?

"Our answer to the query is in the affirmative. We, however, clarify that this answer is only for the limited purpose of the RTI Act [explanation below Section 12(3)] and not for any other purpose," the Law Ministry said in its advice to Department of Personnel and Training.

The Law Ministry had also made it clear that the term "single largest group in opposition", as mentioned in the RTI Act, is not defined either in the RTI Act, Acts pertaining to functioning of MPs and Parliament and compilations of "Directions by the Speaker of Lok Sabha".

It said it relied on the response of the Lok Sabha Secretariat saying Kharge was the leader of Congress which was the single largest party in opposition.

The Department of Personnel and Training (DoPT), the nodal ministry for RTI matters, has invited applications from the people in a given format before November 24.

According to the Act, the Chief Information Commissioner (CIC) shall be a person of eminence in public life with wide knowledge and experience in law, science and technology, social service, management, journalism, mass-media or administration and governance.

All the CICs appointed so far have been retired bureaucrats. The position has been lying vacant after Rajiv Mathur, former Chief of Intelligence Bureau, retired on August 22.

New Delhi, May 21: The Airports Authority of India (AAI) issued a standard operating procedure (SOP) to airport operators on Wednesday for recommencement of domestic flights from May 25 onwards, saying Aarogya Setu app is not mandatory for children below 14 years of age.

"Passengers shall compulsorily walk through screening zone for thermal screening at a designated place in the city side before entering the terminal building," the AAI said in its SOP, which has been accessed by news agency.

Airport operators must make appropriate arrangements for sanitisation of a passenger's baggage before his or her entry into the terminal building, said the SOP dated May 20.

The AAI manages more than 100 airports across the country. However, major airports like Delhi, Mumbai, Bengaluru and Hyderabad are managed by private companies. 

Civil Aviation Minister had announced on Wednesday that domestic flight services would resume from May 25 onwards in a calibrated manner.

New Delhi, Jun 25: The Congress on Thursday asked Prime Minister Narendra Modi why has not India gained anything from the "strange bonhomie" which it claimed he shared with China.

Seeking to turn the tables on the ruling party, Congress spokesperson Pawan Khera said the BJP also shared bonhomie with the Communist Party of China (CPC) with several party-level exchanges taking place in the past.

He sought to know whether India's borders have become safe after these exchanges in the last many years.

The Congress leader asked what has the country gained out of these exchange delegations and why are the borders insecure despite the bonds that the two ruling parties of India and China share with each other.

"There is a strange kind of bonhomie between Narendra Modi and China, a two decade old bonhomie. Why doesn't the country get the benefit of that bonhomie," he asked at a virtual press conference.

Khera said all that the Congress will continue to question is about the political will that just does not get visible when it comes to China.

"Whatever is happening on the border today, is it despite the bonhomie which you have with China, or is it because of the bonhomie which you have with China. The country needs to know," he asked.

"We do want to ask you, if as president of the party, Rajnath Singh, Nitin Gadkari and Amit Shah have been sending delegations,  strengthening the bonds between the Communist Party of China and the BJP. What has the country gained out of these bonds? Why are the borders insecure despite these bonds that you have," he also asked.

The ruling has hit out at the Congress for signing an MoU with China's Communist Party and has questioned its "bond" with the ruling party in China.

Khera also asked what role did the India Foundation, an organisation run by National Security Adviser Ajit Doval's son has in strengthening the bonds with China.

"Why does India Foundation keep visiting these countries? Who do they meet? What's the outcome? What's the role of NSA Ajit Doval's son- Shaurya Doval? He keeps attending these meetings through India Foundation? These are important questions in the light of what is happening," he asked.

Khera said the prime minister is showing "red eyes" to those who are asking him questions instead of showing them to the enemy.

"It is time to stand with the Army and show red eyes to China," he said.

The Congress leader said questions will be asked to Modi especially when there are definitive reports, satellite images of incursions in the Ladakh region of India by the Chinese.

He alleged that China laps up the comment of Modi and uses it across the world that the Indian prime minister says that China is in its own territory and Galwan is theirs.

"After a lot of pressure, PMO contradicted what the prime minister said. This kind of a goof up is unpardonable," he alleged.

New Delhi, Jun 4: India's Defence Secretary Ajay Kumar tested positive for COVID-19 on Wednesday, following which the defence ministry carried out a massive contact-tracing exercise, official sources said.

Kumar's condition is stable and he is currently under home-quarantine, they said.

At least 35 officials working at the ministry's headquarters in South Block in the Raisina Hills have been sent on home quarantine after reports of Kumar testing positive for the infection emerged on Wednesday morning.

There was no official comment on Kumar's health condition. The defence ministry spokesperson refused to comment on the issue.

It is learnt that Defence Minister Rajnath Singh did not attend office as part of a precautionary measure.

The offices of the defence minister, the defence secretary, the Army Chief and the Navy Chief are on the first floor of the South Block.

The sources said all laid down protocols on contact-tracing and quarantining of people are being scrupulously followed.
