Man gets death penalty in Dalit student rape case

Kochi, Dec 14: A city court has awarded death sentence to Ameerul Islam, the lone convict found guilty in the rape and murder case of a 30-year old Dalit law student in Kerala last year.

Ernakulam Principal Sessions court judge N Anil Kumar awarded death penalty to Islam, a migrant labourer from Assam, for committing murder of the law student at nearby Perumbavoor.

Islam has been awarded life imprisonment for committing the rape of the woman after he was also found guilty under Indian Penal Code Section 376 (A) (causing death or causes the woman to be in persistent vegetative state while committing rape).

The court on Wednesday heard the versions of defence and prosecution in awarding the quantum of punishment in the case. The defence counsel had moved an application seeking a fair probe, arguing that Islam, who only understands his mother tongue Assamese, was not given a fair treatment by the Kerala Police, which probed the case. The court, however, had rejected the application, saying that the one submitted by the accused for further investigation was not in accordance with law.

The prosecution narrated the brutal manner in which the 30-year-old law student was raped and murdered, and argued that it was a rarest of the rare case. They had argued that a death sentence should be awarded to the convict, who, they said was a pervert. The diabolic and barbaric manner in which the crime was committed on the unarmed woman was almost like that committed on Nirbhaya, victim of the gangrape and fatal assault in New Delhi in 2012, the prosecution said.

Islam's counsel had said he was not guilty and that the police had framed him in the case. Referring to various judgements by the Supreme Court and high courts, he had argued there was no eyewitness to the crime and the death penalty cannot be awarded merely on the basis of circumstantial evidence.

Islam was found guilty by the court on Tuesday under various sections of the IPC, including 449 (house trespass in order to commit offence punishable with death), 342 (punishment for wrongful confinement), 302 (murder), 376 (rape) 376 (A) (causing death or causes the woman to be in persistent vegetative state while committing rape).

The Special Investigation Team probing the case had used DNA technology and verification of call record details to prove Islam's involvement in the crime. The court had on December 6 completed hearing in the case and posted for Thursday the pronouncement of the quantum of punishment.

Islam was charged with raping and murdering the woman at Perumbavoor on April 28, 2016. He was booked under various sections of IPC and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Rules. As many as 100 witnesses were examined during the trial, which commenced in April last. The woman, who hailed from a poor family, was brutally assaulted using sharp-edged weapons before being murdered at her house. Islam, who had left Perumbavoor soon after committing the crime, was arrested from Kancheepuram in neighbouring Tamil Nadu, 50 days after the gruesome incident. More than 100 police personnel questioned over 1,500 people in the case. Fingerprints of over 5,000 people were also examined by the SIT personnel, who went through over 20 lakh telephonic conversations before reaching Islam.

New Delhi, Feb 5: AIMIM chief Asaduddin Owaisi on Wednesday expressed his suspicion over the government using force to clear the Shaheen Bagh stretch where an agitation has been ongoing for over 50 days against Citizenship Amendment Act (CAA).

While speaking to ANI over the phone, Owaisi was asked that there are indications from the government that after February 8, Shaheen Bagh will be cleared.

In reply, he said, "Might be they will shoot them, they might turn Shaheen Bagh into Jallianwala Bagh. This might happen. BJP minister gave a statement to 'shoot a bullet'. The government must give an answer as (to) who is radicalising."

Further speaking about NPR and NRC, Owaisi said, "Government must give a clear cut answer that till 2024 NRC will not be implemented. Why are they spending Rs 3900 crore for NPR? I feel this way because I was a History student. Hitler during his reign conducted census twice and after that, he pushed the jews in a gas chamber. I don't want our country (to) go in that way."

New Delhi, Jan 8: Jawaharlal Nehru University Students Union (JNUSU) President Aishe Ghosh has filed a complaint over the violence that took place at the varsity campus on Sunday.

"I am filing this complaint for the incident in which a mob conspired and acted with common intention to assault, intimidate and attempt to murder me, and request you to register an FIR and apprehend culprits at the earliest," the complaint read.

She said that on January 5, in the afternoon, she received information from students in the campus that some students affiliated to ABVP along with other unidentified men and women had gathered with weapons like rods, sledgehammers and lathis near Ganga Bus Stop.

"I along with Nikhil Mathew (MA Labour Studies) who was also present there, were surrounded by a group of persons of that mob most of whom were wearing masks. The mob of 20-30 persons dragged me behind a car standing near the 24*7 and surrounded me and despite my pleading did not let me go and attacked me with rods while I had fallen down. I remember that one of the people was of medium height wearing a brownish-red sweatshirt with UCLA written on it. I saw his face as he was facing me and did not have a mask on and can identify him if I see him," Ghosh wrote in her complaint.

"I was attacked by the above-mentioned persons collectively and was hit on the head multiple times with iron rods. I fell to the ground and my head started bleeding, and some of them kicked me and hit me with the rod on my hand and rest of the body including my head, chest and back."

"I am attaching with this complaint a copy of the MLC which details my injuries. Nikhil Mathew tried to save me but was also hit with an iron hammer and other weapons on his head and arms. The intention of the group of men and their acts was definitely to murder me and other persons associated with me," she said.

New Delhi, Jun 4: Press Council of India (PCI) member BR Gupta has resigned from his post, saying he was unable to work individually or collectively for the media, which is in a "deep crisis".

"I have tendered my resignation as a Press Council of India member," Gupta told PTI.

He said the PCI had the responsibility to encourage media and media professionals constantly.

"But everyone now realises that the media scenario is in a deep crisis. The motto for which the Council was created was not being fulfilled and I felt I was not doing anything remarkable for the freedom of media," Gupta said.

He claimed that the PCI was not a wholly representative body for the media.

"Then how can we come out of the crisis being faced by the media and mediapersons? It is a big challenge for us. I have quit as I have not been able to work individually or collectively being a PCI member," Gupta added.

Referring to salary cuts and job losses, he said media and mediapersons were struggling for social, political and economic justice.

When contacted, PCI chairman Justice C K Prasad said Gupta's resignation has not been accepted yet.

"I have received it (the resignation). I have not gone through it. It has not been accepted," Prasad told PTI.

Gupta was appointed as a PCI member for a three-year term on May 30, 2018.

He said liberty is one of the basic features of the preamble to the Constitution that continues to inspire people and the media.

"It is difficult (for me) to fulfil the unbiased role and responsibility to help citizens and the media for making democracy stronger," Gupta said.
