UAE-India to e-streamline contract registration of Indian workers

nriAbu Dhabi, April 4: The UAE Ministry of Labour and India’s Ministry of Overseas Indian Affairs today signed a protocol to streamline the admission of Indian contract workers by way of an electronic contract registration and validation system.

A milestone in the efforts to upgrade rules and procedures governing contract employment of Indian nationals in the UAE, the new system heralds a joint endeavour by the UAE and India.

This protocol emanates from a comprehensive UAE-India Memorandum of Understanding on Manpower, which was signed by Mr. Vayalar Ravi, Indian Minister of overseas Indian Affairs and Mr. Saqr Ghobash, UAE Minister of Labour, in New Delhi on 13th September 2011 .

The protocol mandates the informed consent and approval by the worker, the employer and the Indian competent authorities of the full terms of the work contract prior to the worker’s deployment to the UAE. The contract terms are, in turn, captured in the contract document that is eventually signed by worker and employer in the UAE and duly registered with the Ministry of Labour.

Minister Ghobash underlined the commitment of the UAE to exemplary co-operation with India in a range of areas, including the employment of Indian contract workers in the UAE. In particular, the new system ensures the full transparency of the contracting process by mandating that the prospective worker be duly informed by Indian government-accredited recruitment agencies of the terms of the contract offer, including the scope of remuneration and employment conditions and benefits, prior to deploying to the UAE.

Ghobash further elaborated that the system requires that the worker signs off on the terms of the contract and that the competent Indian government authorities approve these terms before the admission process is completed and a work permit is issued. These same terms are then electronically captured into the formal employment contract that is signed by worker and employer in the UAE. He stressed the importance of safeguarding and protecting the interests of both workers and employers under the provisions of the UAE Labour Law.

Vayalar Ravi, Indian Minister of Overseas Indian Affairs, hailed the protocol, which would protect the interest of workers as well as the employers, as a leap in India-UAE relations in the field of labour employment. He stated that the protocol underlines the commitment of the Indian Government to the protection and welfare of the Indian workers in the UAE, in accordance with UAE legislation. He thanked the Ministry of Labour, under the guidance of Minister Ghobash, agreeing that the new system safeguards the interests of workers and employers alike by validating the contract conditions of the Indian worker in the UAE.

Ravi further informed that India is implementing a comprehensive e-governance system towards making the process of overseas deployment of Indian workers transparent and accessible to all stakeholders. The Contract Registration and Validation System is fully aligned with India’s e-governance system, allowing for a seamless application of the respective rules and procedures of both countries. He cited many projects undertaken by the Indian government to ensure welfare and protection of the Indian workers. The Indian Minister stated that the interests of workers and the employers are complementary and that the new protocol is a commitment of both the governments to jointly work towards the same.

The new system is activated by an online application by a UAE employer for the granting of work permits that requires disclosure of the key terms of the employment offer. MOL processes the application and provides access to the electronic record to Indian government-accredited recruitment agencies in India that are then required to obtain the worker’s attested consent; a duly designated Indian government agency also accesses the record for the purpose of reviewing the terms of the employment and granting an emigration clearance accordingly. This is followed by the registration of the electronic contract and the issuance of the work permit by the UAE MOL.

Dubai, Apr 13: The UAE plans to impose "strict restrictions" on countries reluctant to take back their nationals working in the Gulf country in the wake of the coronavirus outbreak and restructure its cooperation and labour relations with them, a state-run media report said on Sunday.

Indian expatriate community of nearly 33 lakh is the largest ethnic community in UAE constituting roughly about 30 per cent of the country’s population. Among the Indian states, Kerala is the most represented followed by Tamil Nadu and Andhra Pradesh.

The options being considered by the Ministry of Human Resources and Emiratisation include "imposing strict future restrictions on the recruitment" of workers from these countries and activating the "quota" system in recruitment operations, state-run WAM news agency reported, citing an official.

It said the options also include suspending memoranda of understanding signed between the ministry and concerned authorities in these countries.

Citing the unnamed official, it said these options are being considered after many countries did not respond to requests by their nationals to return home following the coronavirus outbreak.

The official made it clear that all countries of foreign workers in the UAE should be responsible for their nationals wishing to return to their countries as part of the humanitarian initiative launched recently by the ministry.

Earlier this month, the ministry launched the initiative to enable residents who work in the UAE and wish to return to their countries to do so during the period of precautionary measures undertaken in the UAE to contain the spread of the coronavirus.

Employees will be asked to submit their annual leave dates or agree with their employers on unpaid leave.

UAE's Ambassador to India Ahmed Abdul Rahman Al Banna has said that the Ministry of Foreign Affairs and International Cooperation (MOFAIC) had sent out a “note verbale” to all the embassies in the UAE, including the Indian mission, during the past couple of weeks on the issue.

“We have sent the note verbale and all the embassies have been informed including the Indian embassy in the UAE and even the Ministry of External Affairs in India,” Al Banna told Gulf News over phone on Saturday.

He said the UAE has offered to test those who want to be evacuated.

“We are assuring everybody that we have the best of the facilities, the best of the testing centres and we have tested more than 500,000 people,” he said.

“We are assuring them also of our cooperation to fly those who got stranded in the UAE for some reasons. Some got stuck because of the lockdown and closure of airports in India. Some were visiting the UAE.”

“We are offering our system and making sure that they are good (to fly) by doing all the tests and transport them according to the request of their own government,” he said.

The envoy said those who test positive for COVID-19 will remain in the UAE. “They will be treated in our home facilities,” he added.

The Kerala High Court on Saturday sought the central government's response to a petition seeking a direction to bring back Indians stranded in the UAE in view of the coronavirus outbreak in the gulf nation.

Considering the plea by Kerala Muslim Cultural Centre (KMCC) in Dubai, the court directed the Centre to file an affidavit on the steps taken by it to ensure the safety of Indians living there and bring back those stuck in the Gulf countries.

In its plea, KMCC, the organisation for non-resident Indians from Kerala, sought directions to the Ministries of External Affairs and Civil Aviation to provide exemptions in the international air travel ban to bring back those Indians stranded in the UAE.

Riyadh, Mar 18: Private-sector businesses in Saudi Arabia on Wednesday were ordered to introduce enforced remote working for all employees for 15 days in an attempt to prevent the spread of the coronavirus.

Businesses that require staff to be physically present to ensure they continue to operate — including those in vital or sensitive sectors such as electricity, water and communications — must reduce the number of workers in their offices to the bare minimum. This can be no more than 40 percent of the total number of staff.

In such cases precautionary measures set by the Ministry of Health must be followed. At offices, and staff accommodation, with more than 50 workers, an area at the entrance must be provided where temperatures can be taken and symptoms checked.

Employers must also set up a mechanism for workers to report any symptoms, such as high temperature, coughing or shortness of breath, or contact they have had with infected individuals or people who recently returned from other countries without following proper Ministry of Health quarantine procedures.

Inside offices, a safe amount of space between employees must be maintained at all times. In addition, all health clubs and nurseries provided by employers must close.

Pregnant women and new mothers, people suffering from respiratory diseases, those with immune-system problems or chronic conditions, cancer patients and employees above the age of 55 are to be given 14 days compulsory paid leave, which will not be deducted from their annual entitlement.

Businesses that are excluded from the new measures include pharmacies and supermarkets, and their suppliers. Private-sector organizations that provide services to government agencies must contact them before suspending workplace attendance. Any other business that considers it impossible to operate with only 40 percent of staff in the workplace must submit an exemption request to the authority that supervises it.

Jeddah, Jul 8: The Organization of Islamic Cooperation (OIC) writes to the members of the United Nations Security Council (UNSC), urging the body to come in the way of a plan announced by Israel for annexation of significant portions of the occupied West Bank.

The letter was addressed by the 57-member organization’s Secretary-General Yousef al-Othaimeen to the UNSC’s members as well as the members of the Middle East Quartet — the European Union, Russia, United Nations, and United States— the Arabic-language Rai al-Youm news website reported on Tuesday.

The letter urged the Council to adopt “the necessary measures” that would prevent the annexation and compel Israel to stop all its illegal activities.

The OIC also urged the UNSC to hold an emergency meeting to “salvage the [remaining] opportunities for peace, and revive attempts at reinstatement of the political process under international supervision.” Such meeting, it added, had to enable realization of “the two-state solution, and [creation of] a Palestinian state with East Jerusalem [al-Quds] as its capital.”

Israel’s Prime Minister Benjamin Netanyahu announced the plan to annex 30 percent of the occupied Palestinian territory — namely the areas upon which the regime has built its illegal settlements as well as the Jordan Valley — after US President Donald Trump backed the annexation in January.

Trump pledged the support while unveiling details of his Middle East scheme called the “deal of the century.”

The highly controversial scheme allegedly seeks to resolve the Palestinian-Israeli conflict, but is heavily tilted in favor of the occupying regime. As well as backing the annexation, the scheme re-endorses Washington’s incendiary recognition in late 2017 of al-Quds as “Israel’s capital,” although Palestinians want the occupied holy city’s eastern part to serve as the capital of their future state.

Palestinians have roundly rejected either the American design or the Israeli plan that is rooted in it.

Tel Aviv had previously announced July 1 as the date it sought to start implementing the annexation plan. It, however, is yet to get it off the ground amid far-and-wide international condemnation and speculation that the plan was announced in the first place to deflect attention from a massive corruption scandal involving Netanyahu.

Countries warn Israel of consequences to bilateral ties

Also on Tuesday, Egypt, France, Germany, and Jordan warned Israel against going ahead with the plan, saying that doing so could have consequences for their bilateral relations with the Tel Aviv regime.

In a statement distributed by the German Foreign Ministry, the countries said their foreign ministers had discussed how to restart talks between Israel and the Palestinian Authority.

Most other European countries have likewise communicated their objection to the plan.

“We concur that any annexation of Palestinian territories occupied in 1967 would be a violation of international law and imperil the foundations of the peace process,” the European and Middle Eastern foreign ministers said, referring to the year, when Israel occupied the West Bank.

“We would not recognize any changes to the 1967 borders that are not agreed by both parties in the conflict,” they added. “It could also have consequences for the relationship with Israel.”

Israel had no immediate response. In a separate statement, however, Netanyahu’s office communicated Tel Aviv’s intransigence on the matter.

The statement said the Israeli premier had told his British counterpart Boris Johnson on Monday that he was committed to Trump’s “realistic” plan.

“Israel is prepared to conduct negotiations on the basis of President Trump’s peace plan, which is both creative and realistic, and will not return to the failed formulas of the past,” the statement alleged.
