Sharjah court adjourns civil case against 17 Indians

Sharjah, April 23: A Dh1.5m civil case against 17 Indians, who had earlier won a reprieve from death sentence, has been adjourned to May 7.


The Sharjah Civil Court of First Instance on Sunday adjourned the civil case filed by two Pakistani brothers, who had claimed that they were assaulted by the 17men during a group fight of bootleggers in which another Pakistani expatriate, Misri Nazir Khan, was killed in January 2009.


On Sunday, a member of the court’s medical panel submitted a medical report to the court, which had, in its last hearing, ordered the medical assessment of the injuries and disabilities sustained by the petitioners, Mushtaq Ahmed and Shahid Iqbal.


‘A copy of the medical report presented to the court today was given to the advocates of the defendants and the petitioners as well...and the court adjourned the case to May 7,’ said advocate Bindu S Chettur of Mohamed Salman Advocates and Legal Consultants that was appointed by the Indian government to defend its citizens.


‘Now that the medical evidence for the petitioners’ disabilities has been submitted, we will present our defence in the next hearing,’ she said.


The court is expected to look into the extent of injuries and permanent disabilities sustained by the brothers, who have claimed they were left jobless after the incident.


The 17 men were spared the death sentence awarded by an appellate court for the murder after being pardoned by Khan’s family. A record blood money of Dh3.4m was raised by Indian businessmen and community members. The court then reduced their sentence to two years in prison followed by deportation.


The same court, in February, sentenced them to another six months’ imprisonment for bootlegging. This followed a reopening of the case as the Federal Supreme Court referred the criminal case back to the Appeals Court. The prosecution had appealed the previous judgement of the Appeal Court in the apex court citing that it did not consider the charges of bootlegging and assault.


However, the convicts did not have to serve the additional jail term as they had already spent more than three years in jail. The release of the 17 men, 16 from Indian state of Punjab and one from Haryana, can now happen only after the civil case is closed.

Dubai, May 5: A Saudi ministerial decision issued on Monday allows companies in the private sector to reduce salaries by 40 per cent and allows termination of contracts owing to the economic hardships resulting from the COVID-19 pandemic, according to daily newspaper Al Sharq Awsat.

The new decision was still not published by the cabinet according to the newspaper.

The decision which the newspaper saw a copy of was signed by Saudi Ministry of Human Resources and Social Development to regulate the labour contract in the current period, allows employers to reduce the employees salaries by 40 percent of the actual effective wage for a period of 6 months, in proportion to the hours of work and allowing the termination of employee contract after 6 months of the COVID-19 circumstances.

The new decision has also included a provision in which the employer would be allowed to cut wages even he or she benefits from the subsidy provided by the goverment, such as those for helping pay workers wages or exemption from government fees.

The decision also stressed that employers are not allowed to terminate any employee, unless three conditions are met.

1.            First the passing of six months since the measures of salary cut has been taken

2.            Reducing pay, annual leave and exceptional leave were all used

3.            Company proves that its facing financial troubles due to the circumstances.

The memo, which goes into affect as soon as its published in the government’s official newspaper, ensures that the employee will receive his/her salary if on annual leave within the period of 6 months.

Riyadh, Apr 27: The government of Saudi Arabia has signed a SR995 million (approx. Dh972m) contract with China to provide Covid-19 tests for nine million people in the Kingdom.

The Saudi Press Agency, SPA, reported that the decision came "as a result of a phone call made today (Sunday) between the Custodian of the Two Holy Mosques King Salman bin Abdulaziz Al Saud and Chinese President Xi Jinping."

The contract includes providing necessary equipment and supplies, making available of 500 Chinese specialists and technicians who are specialised in performing tests, establishing six large regional laboratories throughout the Kingdom; including a mobile laboratory with a capacity of performing 10,000 tests per day. Saudi cadres will also be trained to conduct daily tests and comprehensive field tests, under the new agreement

The contract was co-signed by the National Unified Procurement Company and Chinese company Huo-yan Laboratories by Dr. Abdullah Al Rabeeah, Advisor at the Royal Court, on behalf of the Government of Saudi Arabia, and Chinese Ambassador to the Kingdom Chen Weiqing, as a representative of the Chinese Government.

The contract is one of the largest contracts that will provide diagnostic tests for the novel Coronavirus.

Tests were also purchased from several other companies from the United States, Switzerland and South Korea, bringing the number of available tests to 14.5 million, covering around 40 percent of Saudi Arabia's population, SPA added.

Apr 9: The UAE Cabinet, chaired by His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE and Ruler of Dubai, adopted a resolution to grant paid leave to select categories of employees at the federal government.

This move is part of a series of precautionary measures and procedures taken by the UAE government to bring the Covid-19 pandemic under control.

The resolution stipulates that married employees of the federal government may take fully paid leave to take care of their children below the age of 16. The age condition shall not apply to people of determination, as well as in cases where a spouse is subject to self-isolation or quarantine that requires no contact with family members, upon a decision from the Ministry of Health and Prevention.

The resolution also applies to employees whose spouses work in vital health-related occupations, such as doctors, nurses, paramedics and other medical jobs that require exposure to infected people, as well as employees of quarantine centres, throughout the emergency period witnessed by the country.

Pursuant to the resolution, the relevant ministry or federal authority may ask employees holding essential technical occupations to work remotely instead of taking leave.

The resolution was issued in line with the UAE government's keenness to support employees and provide them with a safe and healthy working environment, as well as to protect the health and safety of government employees and their families, during the current crisis that requires greater efforts, additional working hours, and in some cases, exposure to infected people.
