Mining scam: Apex court refuses protection from arrest to HDK

New Delhi/Bengaluru, Jul 28: The Supreme Court on Thursday refused to grant any protection to former Karnataka Chief Minister H D Kumaraswamy from arrest in the cases relating to illegal grant of mining lease and lifting of minerals in favour of two miners and receipt of Rs 150 crore bribe.kumaraswamy

A bench of Justices A K Sikri and Ashok Bhushan just recorded a statement by Karnataka Lokayukta’s counsel, senior advocate Vikas Singh and advocate Joseph Aristotle, and Kumaraswamy’s counsel that the matter is coming up for consideration for anticipatory bail before the High Court of Karnataka on Friday. The court said the parties would be free to raise their plea before the high court.

In a relief to Kumaraswamy, the bench, however, said the Special Investigation Team (SIT) formed by the Lokayukta was permitted to carry out its investigation but the final report (charge sheet or closure) would not be filed without permission from the apex court.

However, Kumaraswamy’s anticipatory bail plea came up for hearing in the High Court of Karnataka on Thursday and the court extended the interim relief to him by directing SIT not to arrest him for the next two weeks. Justice Rathnakala adjourned the hearing by two weeks after the SIT informed the court that the mining matter is coming up for hearing in the Supreme Court and sought time.

In the Supreme Court, senior advocates Raju Ramachandran and Huzefa Ahmadi, appearing for the JD(S) leader, contended that the investigating agency has gone on to register separate FIRs in the matter under the garb of the apex court's direction for investigation, in March this year.

“The petitioner is being harassed. They (SIT) are trying to arrest him at any cost. There are three allegations, one related to grant of mining lease in favour of Sri Sai Venkateshwara Minerals, second, renewal of mining lease to Janthakal Enterprises and third, about payment of Rs 150 crore bribe. But, all these were related to one transaction. There cannot be separate FIRs,” they contended.

In respect of Venkateswara Minerals, the high court had already stayed the proceedings, nevertheless the petitioner was being subjected to investigation, Ramachandran submitted.

The cases pertaining to Janthakal Enterprises and payment of bribe was already quashed by the high court but the investigating agency was re-registering FIRs, forcing the petitioner to seek anticipatory bail, Ahmadi contended, seeking the apex court's intervention.

The SIT counsel opposed the plea for any protection, contending the investigation was being conducted on the direction of the Supreme Court only. They also pointed out that the petitioner was seeking anticipatory bail from the high court, despite a clear-cut direction by the apex court that no other court would interfere into the matter.

Declining any protection to Kumaraswamy for now, the court put the plea by former chief minister S M Krishna, represented by senior advocate Mukul Rohatgi, in the case related to de-reservation of forest land for consideration on September 12.

The apex court in 2012 had stayed the investigation against Krishna.

Activist T J Abraham had filed a complaint in the matter by relying upon a report prepared by the then Lokayukta Justice Santosh Hegde, indicting the then chief ministers and bureaucrats in de-reservation of 11,797 square kilometres of forest land in 2002-03 in Ballari district and grant of illegal lease, resulting in huge losses to the government. Meanwhile, the court directed handing over a copy of the SIT report to all the parties.

Bengaluru, Jan 6: Former Governor of Karnataka T N Chaturvedi passed away on Sunday late night at a private hospital in Noida.
He was 90.

T N Chaturvedi served as of Comptroller and Auditor General of India from 1984 to 1989. He was awarded the Padma Vibhushan in 1991.

An officer of Indian Administrative Service (IAS), Chaturvedi held several key posts after retirement including Governor’s post of Karnataka and Kerala. He was the governor of Karnataka from 2002 to 2007 and held additional post of Governor of Kerala following death of then Kerala governor Sikander Bakht. He held the post from Feb 2004 to June 2004 and was replaced by newly appointed Governor.

An officer of Indian Administrative Service (IAS), Chaturvedi held several key posts after retirement including Governor’s post of Karnataka and Kerala.

Expressing grief on the demise of T N Chaturvedi Vice President M Venkaiah Naidu, in a tweet said, “T N Chaturvedi was an administrator par excellence, towering intellectual and true nationalist and he was known for his erudition, integrity and knowledge. He had an illustrious career in public life and served every role with distinction.”

Even former Union Minister Anant Kumar Hegde condoled Chaturvedi's demise. "Humble tributes to our ex-Governor of Karnataka TN Chaturvedi who passed away last evening. He was an outstanding bureaucrat who was CAG in the 90's before becoming the Governor of our state. May his soul attain Sadgati. Om Shanti Shanti Shanti!" Hegde tweeted.

Mangaluru Jun 18: Dakshina Kannada on Thursday, June 18, reported 23 fresh covid-19 cases, taking the total number of the cases detected in the district to 401.  

Among the 23 corona-positive patients, there are 21 males and two females. 

21 are Saudi returnees, while the other two have contracted infection from P-6618.

No cases were reported in Udupi district on Thursday.

The total number of cases in Udupi is 1,039, with only 92 cases being currently active. As many as 946 patients including 38 on Thursday who recovered have been discharged from hospital.

Mangaluru, June 21: A gang of miscreants intercepted a goods auto-rickshaw which was legally transporting beef from an abattoir to market and attacked its driver in heart of the city this morning. 

The attack comes exactly a week after a gang of Bajrang Dal miscreants thrashed a cattle trader at Urwa while legally transporting four buffalos to Kudroli abattoir on June 13.

Today, a person identified as Abdul Rasheed was transporting around 200 kilograms of beef from Kudroli abattoir to Kankanady market.

Meanwhile, miscreants began to chase beef laden vehicle and managed to waylay it near Highland Hospital. They thrashed Abdul Rasheed and poured kerosene on the beef besides damaging the vehicle. 

The miscreants fled in their car and motorbikes after passersby began to gather.

Dear DC Dr. Harsha, we want to know if you will take strict action on these anti nationals / rowdis / day robbers / terrorists who ransacked auto + beaten the auto driwer and stolen Rs. 10,000 from him though he was legally transporting the meat.   They same terrorists are involved in transporting live animals to beef export houses in Gujrat owned by Brahmins / Jains.   Will you be loyal to your duty and promise.   We will see how you will handle the issue failing which you will lose our respect and we will consider you as a dramabaz and phenku.   You should follow the law and treat everyone equally.  There should not be any pity on goondas/ terrorists belonging to sangh parivar.   The terrorists who thrashed the auto driver and damaged the auto and burnt the meat by pouring kerosene are not human beings and should be treated as anti nationals + terrorists.    We hope you will discharge your duty as per the oath taken by you while accepting your post.
