Acquitted man's mother narrates ordeal

In a corner of a dimly-lit room, Padsha Begum, 65—whose son was Thursday acquitted after 17 years by Delhi High Court in the 1996 Lajpat Nagar blast case—is on a prayer mat with both joy and sorrow reflecting on her face. Her daughter Nighat is reciting some verses from the holy Qur'an loudly.

The acquittal of Begum's son Mirza Nissar Hussian has infused a new lease of life to this Srinagar family that has been living in deep distress for the past 17 years.

Begum says she offered special thanksgiving prayer after hearing about Hussain's acquittal. And so did Nighat.

On Thursday Delhi High Court acquitted two convicts who were given death penalty in the 1996 Lajpat Nagar Market bomb blasts. Mirza Nissar Hussain is one among them.

“Thanks to Almighty Allah. My son will be home after 17 years. Truth has ultimately prevailed,” Begum says. “His acquittal has proven that he was not guilty of what he was framed for. How can an 8th standard student carry out a blast and kill people? We will see our innocent son after 17 years for no fault of his.”

Hussain's sister says, “My another brother Iftikhar, who was also arrested in 1996 in connection with the blasts, was released after 14 years in 2010. By then our family had literally collapsed. While our father had already passed away, two of my brothers were put in jail for no fault. We will see the face of another brother after 17 years. It has been a very tough time.”

Nighat says the family has nothing to celebrate as of now as “Nissar is being implicated in some other case relating to Jaipur blasts.” “What kind of justice is this?” she asks. “If my brother was proven innocent in a case for which he spent 17 years in jail, it is paranoia that they are implicating him in some other case.”

Bengaluru, Jul 28: Congress leader Siddaramaiah on Monday alleged that BJP is trying to destabilise the Congress government in Rajasthan.

"It is the duty of the Governor to act according to the decision of the state cabinet. But he is acting like a central government puppet," he said at a protest organised here by Karnataka Pradesh Congress Committee (KPCC).

He said the Congress is protesting across the country to save democracy and save the constitution.

"We are not fighting through violence. We are protesting peacefully. The Constitution has given the right to protest in a democratic system," he said.

He accused the BJP of "being disrespectful" to the Constitution.

"Governments must walk within the framework of the Constitution. The Constitution gives everyone rights and duties. BJP destabilises elected governments and buys our legislators by horse-trading by spending crores of money. The same thing happened in Karnataka as well," he alleged.

Unnao, Feb 26: Ever heard of someone wishing a 'bright future' for the dead? In a bizarre incident in Uttar Pradesh's Unnao district, a village head issued a death certificate with the wish for an elderly man who had died last month.

The incident took place in the Sirwariya village in Asoha block where an elderly person Laxmi Shankar died after a prolonged illness on January 22.

His son went to the village head Babulal and requested him to issue a death certificate that he needed for some financial transactions.

Babulal not only issued the death certificate, but also 'wished' 'a bright future for the deceased' on the document.

The village head wrote in the death certificate -- "Main inke ujjwal bhavishya ki kaamna karta hoon (I wish him a bright future)."

The letter went viral on the social media on Monday after which the village head apologised for the error and issued a new death certificate.

In a first, the Supreme Court on Friday allowed the service of summons and notices, a necessity in almost all legal proceedings, through instant messenger like WhatsApp as well as by e-mail and fax.

A bench headed by Chief Justice SA Bobde observed that it has been brought to the notice of the court that it is not feasible to visit post offices for service of notices, summons, and pleadings. The bench also comprising Justices AS Bopanna and R Subhash Reddy observed that notice and summons should be sent through e-mail on the same day along with instant message through WhatsApp and other phone messenger services.

The bench clarified that all methods should be deployed for a valid service on the party. "Two blue ticks would convey that the receiver has seen the notice," noted the bench.

The bench declined the request of the Attorney General for specifically naming WhatsApp as a mode of effectuating service. The top court noted that it would not be practical to specify only WhatsApp. The apex court also permitted RBI to extend the validity of cheques in the backdrop of lockdown to contain the coronavirus outbreak.

Senior advocate V Giri representing RBI informed the bench that he had circulated the note regarding validity of a cheque as directions issued on the previous hearing.

The bench noted that it will be in discretion of the RBI to issue orders which are suitable to alter the validity of the period of a cheque.

During an earlier hearing on the matter on July 7, the Attorney General contended before the top court that the Centre had some reservations in connection with the utilization of mobile applications like WhatsApp and other apps for service of summons. The Centre's top law officer informed the apex court that these apps claimed to be encrypted, and they were not trustworthy.

The RBI counsel had contended before the top court that it was considering clarifying the validity of a cheque which has been reduced to 3 months from 6 months.
