MLAs should not be forced to attend House on July 18, says SC

New Delhi, Jul 17: Amid the ongoing political imbroglio in Karnataka, the Supreme Court on Wednesday declined to fix any deadline for the Assembly Speaker to decide upon the resignations of 15 rebel MLAs who put the ruling JDS-Congress government on brink of collapse.

A three-judge bench presided over by Chief Justice Ranjan Gogoi said the discretion granted to the Assembly Speaker under the Constitution to exercise his power must not be interfered with for the time being.

"The discretion to the Speaker must not be fettered with," the bench said.

At the same time, the court said the MLAs "ought not to be compelled" to attend the House proceedings pending the decision on their resignations. They should be allowed to "opt out".

The court said it was passing the interim orders in view of the facts and circumstances of the matter and to ensure "Constitutional balance" and "competing rights".

The bench, also comprising Justices Deepak Gupta and Aniruddha Bose, refused to set the "time frame" for Speaker K R Ramesh Kumar to take a decision on the resignations, also noticing that the trust motion is already scheduled to take place on July 18.

Notably, the Speaker had on Tuesday urged the court not to pass any order and instead proposed to decide upon the resignations by Wednesday itself.

The court, in its orders, also took into consideration of the rebel MLAs plea to allow them not to participate in the House proceedings on Thursday.

The court said the Speaker should be permitted to exercise his power under Article 190 of the Constitution and Rule 202 of the Rule of the Procedure and Conduct of Business of the Karnataka Legislative Assembly.

The court said it was not answering legal questions at the moment. It said as and when the orders were passed by the Speaker, the same should be placed before it for proceeding further in the matter.

The court passed its orders on a writ petition filed by disenchanted MLAs led by Pratap Gouda Patil and nine others. Five others have subsequently joined them in the court to seek a direction to the Speaker to decide upon their resignations.

The Speaker had maintained he would decide upon the disqualification petitions first. He said he would decide resignations earliest and in accordance with the law.

The rebel MLAs, holed up in a Mumbai hotel, faced threat of being disqualified, which may disable them to join immediately an alternative government, if formed, leaving them with a choice to get re-elected and be a part of such a dispensation.

Bengaluru, Jul 23: Karnataka on Thursday recorded a biggest single-day surge of over 5,000 cases and 97 related fatalities, taking the total number of people who tested positive for the virus to 80,863, the health department said. 

The day also saw a record 2,071 patients getting discharged after recovery.

Out of 5,030 fresh cases reported, a whopping 2,207 cases were from Bengaluru urban alone.

As of July 23 evening, cumulatively 80,863 Covid-19 positive cases have been confirmed in the state, which includes 1,616 deaths and 29,310 discharges, the health department said in its bulletin.

It said, out of 49,931 active cases, 49,291 patients are in isolation at designated hospitals and are stable, while 640 are in ICU. Out of the 97 deaths reported on Thursday 48 are from Bengaluru urban, followed by Mysuru 8, Dakshina Kannada 7 and others.

Most of the dead are either with a history of Severe Acute Respiratory Infection (SARI) or Influenza-like illness (ILI).

Among the districts where the new cases were reported, Bengaluru urban accounts for 2,207, followed by Raichur 258, Kalaburagi 229, Dakshina Kannada 218, and others.

Bengaluru urban district tops the list of positive cases, with a total of 39,200 infections, followed by Dakshina Kannada 4,209 and Kalaburagi 3,370.

Dammam, May 29: A woman hailing from Mangaluru, who was waiting for repatriation amidst coronavirus lockdown in Saudi Arabia, passed away yesterday after a brief illness.

The deceased has been identified as Lateefa (55), wife of Abdul Azeez, a resident of Angaragundi near Baikampady on the outskirts of the city.

She had flown to Saudi Arabia in November 2019 along with her husband to spend some time with their NRI son in Dammam. They were supposed to return in April this year.

After the sudden cancellation of regular flights due to lockdown, they were waiting for the repatriation flights from Dammam to Mangaluru or Bengaluru.

Meanwhile, Lateefa’s health condition worsened and she was hospitalised. She passed away on Thursday without responding to any treatment. Last rites are expected to take place in Dammam.

Mangaluru, May 30: Coastal district of Dakshina Kannada today recorded third covid-19 death as a 67-year-old woman from Bantwal taluk succumbed to the coronavirus at the district Wenlock Hospital, the designated Covid hospital.

The victim is said to be a neighbor of two women (daughter-in-law and mother-in-law) who died of the coronavirus a few days ago. 

On April 18 due to difficulties in breathing, she was rushed to Wenlock Hospital, where she was tested positive for coronavirus. Initially she responded to treatment. However, her condition started worsening earlier this week and breathed her last today evening.

Her daughter also has been tested positive for the deadly virus and she is currently undergoing treatment.
