Modi speech outside restricted area: Gujarat Police

Ahmedabad, May 1: A day after Narendra Modi was booked for making a speech at a polling booth while displaying BJP's election symbol in violation of electoral laws, a preliminary probe by Gujarat police has found he addressed the gathering outside the restricted 100-metre radius. selfied

"Just like any other case, we will investigate this case to find out the facts such as whether Modi was inside the 100-metre radius of the polling booth.

"Our preliminary probe (has) revealed that authorities had marked that limit with a white strip outside the booth, and the press conference was outside that limit," said a senior officer of Detection of Crime Branch of Ahmedabad police, which today initiated the investigation.

The model code for elections prevents canvassing within 100 meters of polling stations.

An FIR was lodged against Modi yesterday under section 126 (1)(a) of the Representation of People Act on the orders of the Election Commission for holding a meeting at the polling station. The provision bans holding of public meetings during the period of 48 hours ending with the hour fixed for the close of the poll.

A non-cognizable complaint was also filed against the TV channels which had broadcast the conference under section 126 (1)(b) of the RP Act.

"There is only one FIR against Modi for violating 126(1)(a) of the RP Act and section 188 of Indian Penal Code for violating CrPC section 144, which prohibits more than four people from gathering for a specific purpose. This is a cognizable offence, which falls under the jurisdiction of police. Police inspector Harpal Rathod became the complainant on behalf of government," the officer said.

"Another complaint against TV channels has been filed under 126(1)(b) for telecasting Modi's press conference, it is not an FIR. It is a non-cognizable offence. We will approach the court and follow its order about the NC complaint as police cannot investigate NC complaint (on their own)," he said.

Speaking on condition of anonymity, the officer also said the charge under section 144 CrPC would not stand legal scrutiny.

"The charge against Modi under CrPC 144 will not stand the trial, as nobody can prove that all the mediapersons and common public were invited or called to the venue by Modi himself. Modi never sent SMS or called them," he said.

The officer said the BJP's prime ministerial contender may not be necessarily called for questioning.

"Our line of investigation includes questioning people present at the time and acquiring video footage. However, it is not always necessary to question the accused. We may or may not call Modi for questioning," he said.

"As per the RP Act, one can be sentenced to 2 years jail term and/or fine, for the violation of section 126(1)(a)," an official said.

Modi had set off a huge controversy after he addressed the media outside the polling station soon after casting his ballot in Ranip area in BJP veteran L K Advani's Gandhinagar constituency. All the while he spoke, Modi held a lotus badge in hand.

Seeing red, Congress immediately complained to the Election Commission and sought action against Modi including his disqualification.

Other parties also attacked the Gujarat chief minister for his conduct with AAP calling him a 'habitual offender'.

The Commission had got into action and directed authorities in Gujarat to file FIR against the Modi.

"The Commission is of the view that by holding that meeting and also by addressing the same today when the polling is going on in the entire state of Gujarat and in different parts of the country, Narendra Modi has violated the provisions of Sections 126 (1)(a) and 126 (l)(b) of Representation of People Act, 1951.

"Therefore, the Commission directs...that complaint/ FIR as the case may be, should be filed against Narendra Modi and all others who were involved in the convening and holding of the said meeting...," the EC order said.

In its order, the EC also said that all the TV channels and other electronic media which carried the proceedings of the meeting should also be proceeded against under Section 126 (l) (b) "by filing separate complaints/FlRs against those channels."

New Delhi, Jul 2: India's COVID-19 tally breached the 6 lakh cases mark with 19,148 new coronavirus cases being reported in the last 24 hours, informed the Union Ministry of Health and Family Welfare on Thursday.

The total cases now stand at 6,04,641 of which there are 2,26,947 active cases while 3,59,860 patients have been cured/discharged/migrated.

434 deaths have been reported in the last 24 hours taking the number of COVID-19 deaths in the country to 17,834.

Maharashtra, the worst-hit state, has a total of 1,80,298 cases including 8,053 fatalities. Meanwhile, Tamil Nadu has 94,049 cases inclusive of 1,264 deaths.

Delhi has 89,802 coronavirus cases including 2,803 deaths.

Ahmedabad, Aug 6: In a major incident, a fire broke out in a Covid-designated hospital in Ahmedabad killing eight coronavirus patients. The mishap occurred in the wee hours of Thursday.

All the victims were in the ICU ward, where the fire is said to have started. Officials said that they all died on the spot while 41 other patients were shifted to other hospitals following a rescue operation. One paramedic staff of the hospital who tried to douse the fire sustained burn injuries.  

Deputy Chief Minister Nitin Patel, who is also the health minister, said that primary information has revealed that fire was caused by the short circuit in the ICU ward where eight patients were under treatment. 

He said that 41 other patients were shifted to Sardar Vallabhbhai Patel hospital. The incident happened at Shrey Hospital in Navrangpura which is one of the Covid-19 designated hospitals. Over 300 patients have recovered at the hospital in the last two months.

Among the victims were five men and three women. They have been identified as Arif Mansuri, Narendra Shah, Manu Rami, Leelvati Shah, Navneet Shah, Jyoti Sindhi, Manu Rami and Ayesha Tirmizi  

Following the incident, Prime Minister Narendra Modi tweeted, "Saddened by the tragic hospital fire in Ahmedabad. Condolences to the bereaved families. May the injured recover soon. Spoke to CM @vijayrupanibjp Ji and Mayor
@ibijalpatel Ji regarding the situation. Administration is providing all possible assistance to the affected."

Soon after the tweet, Chief Minister Vijay Rupani ordered a probe into the matter to be conducted by Additional Chief Secretary (ACS), Home, Sangeeta Singh and ACS (Urban Development) Mukesh Puri. 

They have been asked to submit a report in three days. Meanwhile, the hospital building has been sealed for further investigation.

Kochi, Mar 24: Long queues were witnessed in front of state beverages corporation outlets across Kerala on Tuesday despite the statewide lockdown to prevent the spread of the coronavirus.

As tipplers thronged the outlets unmindful of the curfew, officials asked them to ensure that they kept a one metre distance between them as part of preventive steps to check the COVID-19 transmission.

Official sources said precautionary measures have been taken at the beverages outlets to prevent the virus spread.

Only those wearing masks were allowed to stand in queues, the sources said.

Police were deployed to ensure that the people standing in queues keep a one metre distance between them, they added.

The opposition Congress slammed the CPI(M)-led LDF government for not taking steps to restrict crowds in front of the Kerala State Beverages Corporation (Bevco) outlets, apprehending that such a situation would pave way for spreading the virus.

Ernakulam district congress committee general secretary Sherin Varghese claimed if the government had implemented a 2017 Kerala high court order directing the beverages corporation to take remedial steps to end long queues in front of the outlets, such a situation would not have arisen.

"Had the beverages corporation complied with the court order, safety and security of persons standing in queues could have been ensured.

Now there is no protective measure to prevent the possible transmission of the coronavirus from a carrier to another person," he told PTI.

Meanwhile, the state government has directed that adequate distance be kept between people standing in queues.

Chief Minister Pinarayi Vijayan on Monday justified the decision to keep the liquor shops open citing the "peculiar" situation prevailing in the state.

Kerala is in a total lockdown since Monday midnight till March 31 to check the virus spread.
