Mumbai: Nine-year-old whispers in judge's ears, nails rapist

Mumbai, Apr 28: Overcoming all odds, a 9-year-old rape survivor, daughter of a hearing and speech-impaired woman living on the streets, deposed in court and nailed her attacker, a fellow street resident.

crimeThe special Protection of Children from Sexual Offences (POCSO) Act court on Wednesday convicted the accused, Mangi Sonkar (49), and sentenced him to seven years' imprisonment.

The child had not made the allegations of rape either before the cops or doctors due to male presence and had only mentioned the molestation.

The rape came to light when the child, uncomfortable with the male defence lawyer in court, was pacified by the judge and whispered in her ear about the rape. "The victim has been brought up in very insecure atmosphere.

It is but natural, impossible for a child who has been brought up in such condition, to depose before anyone and to disclose the fact of rape committed on her in presence of male person," the court said.

The child told the court that the incident took place on September 9, 2014. She used to sleep with her mother and sister on the footpath.

Her father had died a few years earlier. She said that the accused also used to sleep on the footpath along with his family. On the night of the incident, after everyone fell asleep, he attacked her.

The child said that she woke up her mother and revealed the incident to her.

The mother in turn took the help of a local man, Yusuf, who took them to Byculla police station and registered a complaint.

The court refuted the defence claims that the accused had been falsely accused at Yusuf's behest. Stressing that a conviction can be secured even without corroboration of the victim's testimony in a rape case, the court said, "The prime reason for attaching such an importance to the testimony of the victim is that a girl or a woman in the tradition-bound non-permissive society of India would be extremely reluctant to falsely implicate or even to admit any incident, which is likely to reflect on her chastity or to put at risk her own image, dignity and reputation in the society."

The court also found the child could not properly explain to her mother the extent of her ordeal due to barriers in communication. "The victim narrated the incident to her mother, in turn her mother narrated incident to one Yusuf uncle in sign language," the court said.

The court said since he too was male, the child could only tell him about molestation and not about the rape.

Akhil Bhartiya Hindu Mahasabha President Ranjit Bachchan was shot dead on Sunday because of an extra-marital relationship of his second wife.

Lucknow Police Commissioner Sujit Pandey said at a press conference here on Thursday that Ranjit Bachchan's second wife Smriti Srivastava, her paramour Dipendra and driver Sanjit Gautam have been arrested in connection with the case. All three were held on Thursday, while the shooter -- Jitendra -- is yet to be arrested.

Pandey said that Smriti wanted a divorce from Ranjit Bachchan and their case was pending in the family court since 2016. While she was keen to marry Dipendra, Ranjit Bachchan was unwilling to leave her.

"On January 17, Ranjit had met Smriti and even slapped her, which became the provocation for the murder," he said.

The Police Commissioner said that during investigation, the police had probed all possible angles, including a terror angle.

"We found there were no financial disputes, no property disputes and no terror angle to the case. It emerged that Smriti had an affair with Dipendra and wanted to leave Ranjit Bachchan, who had four criminal cases against him. Through technical and electronic surveillance, we found the connection between Smriti, Dipendra, driver Sanjit and the shooter Jitendra," he said.

Ranjeet Bachchan, 40, who had founded the Vishwa Hindu Mahasabha, was shot in the head on Sunday morning while his brother Aditya Srivastava was injured in the attack by the assailant who also snatched their mobile phones.

The attacker had covered himself in a shawl and was on foot. The police had released CCTV footages showing a suspect and announced a cash reward of Rs 50,000 for providing information.

Meerut: The licence of a private hospital in Uttar Pradesh’s Meerut has been suspended after a video showing its staff member providing fake Covid-19 report had gone viral.

"A video had gone viral in Meerut. We have registered a case in this regard. We have suspended the licence of the nursing home. Today, we have sealed it also. Strict action will be taken against anybody who will do something like this in this time of crisis,” said Anil Dhingra, District Magistrate, Meerut.

In the video, the person can be heard saying that they provide Covid-19 negative report for Rs 2,500, Dhingra stated.

Meerut CMO Rajkumar said, “In the video, a man from the hospital can be heard saying that he can arrange COVID-19 negative report and the person can get operation or other things done. We have identified the man. We have suspended the licence of the hospital and an FIR has been registered.”

Gonda, Apr 9: A man allegedly committed suicide by hanging himself from the ceiling of his room as he was missing his wife stuck at her parents' place due to the lockdown, police said.

The incident took place in Radha Kund locality here on Wednesday, they said, adding the deceased has been identified as Rakesh Soni, 32.

As per information, Soni's wife had gone to her parents' place and was stuck there due to the lockdown and he was missing her due to which he committed suicide, Inspector Alok Rao said.

A probe is on in the mater, he said.
