National Herald case:Sonia, Rahul Gandhi & two others move SC

New Delhi, Feb 4: Congress President Sonia Gandhi and Rahul Gandhi today moved the Supreme Court challenging the December 7 last year Delhi High Court order refusing to quash summons issued to them in the National Herald case.

sonia Besides Gandhis, Suman Dubey and Sam Pitroda have also approached the apex court against the High Court verdict.

The High Court had on December 7, 2015 not only refused to quash the summons issued to the Congress leaders, but had also made scathing observations on their "questionable conduct" regarding how they took control of the publication.

Subsequently, the Gandhis and others had appeared before a Patiala House court on December 19 last year when they were also granted bail, with the magistrate observing that they had deep political roots and there was no apprehension that they would flee.

The magisterial court then fixed the matter for further hearing on February 20 when they will have to appear again unless the apex court grants them any interim relief.
Earlier, the High Court, while refusing to quash summons against them, had said, "Questionable conduct of petitioners needs to be properly examined at the charge stage to find out the truth and so, these criminal proceedings cannot be thwarted at this initial stage."

Along with the Gandhis, five other accused--Suman Dubey, Moti Lal Vora, Oscar Fernandes, Sam Pitroda and Young India Ltd--had challenged the summons issued to them by a trial court on a complaint by BJP leader Subramanian Swamy against them for alleged cheating and misappropriation of funds in taking control of the now-defunct daily.

Sonia, Rahul, Vora (AICC Treasurer), Fernandes (AICC General Secretary), Dubey and Pitroda were summoned under sections 403 (dishonest misappropriation of property), 406 (criminal breach of trust) and 420 (cheating) read with section 120B (criminal conspiracy) of the IPC.

The trial court had on June 26, 2014 asked them to appear before it on August 7, 2014 but the order was stayed on August 6 by the Delhi High Court which on December 7, 2015 vacated the stay by rejecting plea to quash the complaint and summons.

According to Swamy's complaint, all of them were directors of Young Indian Ltd (YI), a company that was incorporated in 2010 and which took over the "debt" of Associated Journals Ltd (AJL), the publisher of National Herald.

Swamy had accused Sonia, Rahul and others of conspiring to cheat and misappropriate funds by just paying Rs 50 lakh by which YI obtained the right to recover Rs 90.25 crore which the AJL had owed to the Congress party.

Malls, restaurants, religious places to open in Delhi from June 8; hotels to remain shut

New Delhi, Jun 8: Delhi Chief Minister Arvind Kejriwal has announced that malls, restaurants and religious places in the national capital would open from Monday after more than two months since the coronavirus-induced lockdown was imposed, but banquet halls and hotels would remain closed.

At an online briefing on Sunday, Kejriwal said hotels and banquet halls might be converted into hospitals in the coming days to treat coronavirus patients and therefore, they would remain shut.

"Malls, restaurants and religious places will be opening from Monday in Delhi in accordance with the Centre's guidelines," he said.

The city government will comply with the instructions of the Centre and its experts like maintaining social distancing and wearing of masks at these places, Kejriwal said.

"In view of the rising number of coronavirus cases, we might attach hotels and banquet halls with hospitals and convert them into hospitals. Hotels and banquet halls will not be opened for now," he said.

The Centre had said on May 30 that "Unlock-1" would be initiated in the country from June 8 and the lockdown would be relaxed to a great extent.

The Delhi government also issued an order allowing opening of restaurants, shopping malls and places of worship except in the COVID-19 containment zones, "subject to compliance with the Standard Operating Procedure (SOP) issued by the Ministry of Health and Family Welfare".

Kejriwal urged the elderly people, who are at a higher risk of contracting the coronavirus, to confine themselves in a room and not to interact with even the family members in order to protect themselves.

Delhi has so far registered over 27,500 coronavirus cases, including 761 deaths.

Civil Aviation Minister announces interim relief for victims of AIE flight crash

The Civil Aviation Ministry announced an initial assistance of Rs 10 lakh to the dependents of the deceased in the Kozhikode AIE plane crash, while the Kerala government also announced a compensation of Rs 10 lakh each.

Minister of Civil Aviation, Hardeep Singh Puri, who visited the mishap spot on Saturday, said that a detailed probe is already on and the pilot and co-pilot were highly experienced.

He also announced a compensation of Rs 2 lakh each to the injured and Rs. 50,000 each to those who suffered minor injuries. The other normal compensations would be decided in due course.

Puri said that Captain Deepak Vasant Sathe, aged 59, who commandeered the AIE flight, had a flying experience of 10,848 hours, while co-pilot Akhilesh Kumar, aged 32, had a flying experience of 1,723 hours.

"Deepak was one of the most distinguished and experienced pilots. He had a commanding experience of 6,662 hours and was commander of B-737 aircraft for 4,244 hours. He had also operated to Kozhikode international airport 27 times. He joined AIE in 2013 and prior to that he served with the IAF and HAL. He was a figher pilot and a recipient of prestigious sword of honour and a gold medalist," said Puri.

Puri said that even as the flight slipped down to around 35 feet, a major disaster was averted due to timely rescue operations. Local people played an exemplary role and the fire brigade's timely action of cutting the plane body and rescuing the passengers minimised the casualties, he said.

Chief Minister Pinarayi Vijayan also said that the local people and all rescue and relief agencies did a well co-ordinated job. The state government would also meet the entire treatment expenses of the injured.

Till Saturday afternoon, the total number of deaths was 18. While 149 were still in hospitals, 23 were discharged.

Finance Minister announces Rs 3 lakh crore collateral free automatic loan for businesses

New Delhi, May 13: Finance Minister Nirmala Sitharaman on Wednesday announced Rs 3 lakh crore collateral-free automatic loan for businesses, including MSMEs.

This will benefit 45 lakh small businesses, she said detailing parts of the Rs 20 lakh crore economic stimulus package.

The loan will have 4-year tenure and will have a 12-month moratorium, she said.

Also, Rs 20,000 crore subordinated debt will be provided for stressed MSMEs, she said adding this would benefit 2 lakh such businesses.

The Finance Minister said a fund of funds for MSME is being created, which will infuse Rs 50,000 crore equity in MSMEs with growth potentials.

Also, MSME definition has been changed to allow units with investment up to Rs 1 crore to be called micro-units in place of Rs 25 lakh now.

Also units with turnover up to Rs 5 crore to be called micro-units, she said, adding a turnover based criteria is being introduced to define small businesses.

The investment and turnover limits for small and medium businesses have likewise been raised to allow them to retain fiscal and other benefits, she said.

Global tenders will be banned for government procurement up to Rs 200 crore, she said, adding this would help MSMEs to compete and supply in government tenders.
