Nayana Pujari rape-murder case: Pune court sentences three accused to death

Pune, May 10: The Shivaji Nagar court in Pune, on Tuesday, delivered death sentence to all three convicts in the October 2009 Nayana Pujari gangrape and murder case.

nayanaOn Monday, the court convicted the three prime accused who have been found guilty of kidnapping, robbing, gang-raping and killing. Special Judge LL Yenkar delivered the quantum of sentence against the convicted trio.

The accused Yogesh Ashok Raut, Mahesh Balasaheb Thakur and Vishwas Hindurao Kadam were held guilty under Indian Penal Code Section 376, 302, 120B, 361 and other counts, said Special Public Prosecutor Harshad Nimbalkar.

Another accused, Rajesh Pandurang Choudhari, arrested as an accomplice, later turned approver and will be eligible for a pardon.

"We have conclusively established the various charges against all the accused and the court has accepted our arguments," said Nimbalkar on Monday.

"Considering the brutal manner in which the victim was gangraped and then killed, this falls under the category of rarest of rare case," he added.

Nayana's husband, Abhijit Pujari and her younger sister have demanded that "the accused should be hanged" for the heinous crime they perpetrated against her.

"There is some sense of relief. Whether it is Jyoti Singh or Nayana, it was an act of rape and murder.... The law prescribes capital punishment as an option... and I think they deserve it," Nayana's husband said on Monday.

However, he expressed disappointment that despite being heard by a fast track court, it took over seven years for the conviction to be passed.

On the night of 7 October, 2009, Phatak-Pujari had completed her duties at Synechron IT company in Kharadi and was preparing to go home, when Raut, who worked there as a driver, offered her a lift.

However, instead of driving towards her home, he diverted the cab towards Rajgurunagar, while picking up two other friends en route.

The three repeatedly raped her in the moving car and then stopped at a desolate spot, where the snatched her debit card, forced her to reveal the pin and and withdrew total of Rs 61,000 from her account.

They subsequently strangled her with her scarf, smashed her head with a large stone to mangle her face and dumped her body in the forests of Zarewadi from where it was recovered after two days.

The case created a scare among Puneites, especially those working in late-night shifts in the IT sector and resulted in enhanced security measures both by the companies and police.

The three and Chaudhari, a guard at the company, were subsequently arrested.

On 17 September, 2011, Raut managed to escape from police custody while being taken to a hospital for treatment and was nabbed only in May 2013.

The trial, which continued for over seven years, saw four different judges hearing the matter in which the prosecution examined 37 witnesses and the defence another 13 witnesses.

In his statement, accused-turned-approver Chaudhari said he was threatened by Raut, Thakur and Kadam that they planned to eliminate the victim and he should keep his mouth shut about it.

Arrested on 16 October, 2009, Chaudhari claimed that he was extremely remorseful about the incident but was equally scared over the death threats issued by the accused. However, he later mustered courage and agreed to turn an approver in the case.

He revealed how, after gang-raping her, the trio snatched her ATM debit card and forced her to reveal the PIN number, with Kadam pointing a knife at her.

Later, Kadam and Thakur left on a motorcycle and withdrew the money from her ICICI bank account, but did not inform Chaudhari.

It also emerged during the investigations by the police that Raut had raped and murdered a 22-year-old woman vegetable vendor in Pune a few months before this crime.

Mandya, Jun 14: In a tragic incident, a woman and her two children were drowned in a pond at Beeranahalli village in Nagamangala taluk of this district on Sunday.

Police said that the deceased have been identified as Geeta (40), and her two children Savita(19) and Soumya(14).

Savaitha is a degree student while Soumya was studying in 9th standard. The trio drowned in a pond where they had gone to wash their cows. The locals rushed to the spot and tried to rescue them but could not save.

Mumbai, Jul 15: A domestic row between a couple spilled onto road when a woman stopped her husbands car and climbed on its bonnet, briefly disrupting traffic on the busy Pedder Road in South Mumbai, police said on Wednesday.

The incident, which took place on Saturday evening, was recorded by some passersby on their mobile phones and its videos are making rounds on social media.

The wife chased the husband's SUV (sports utility vehicle) in her car after she spotted another woman seated next to him in his vehicle.

As her husband's SUV stopped at the Pedder Road signal, the wife get down from her car, rushed towards his four-wheeler and started shouting at him, a police official said.

In the video, the woman is seen climbing the bonnet of the SUV, removing her footwear and hitting the vehicle's windshield with it. She is also seen asking the husband's co- passenger to get out of the SUV and shouting for police help.

As she stopped her car in the middle of the busy road, one lane got blocked for some time and the traffic police personnel present there tried to ensure movement of other vehicles, the official said.

After sometime, the traffic police asked the couple to take their cars near the footpath.

By that time, the husband stepped out of his SUV, following which the wife ran towards him and caught him. She even kicked him a couple of times and took him to her car, the video shows.

She then again ran towards her husband's SUV, which was parked a few metres away. She opened its driver-side door and lunged at the woman seated in the vehicle, but was stopped by some people who had gathered at the spot, the police official said.

Later, the couple and their cars were taken to Gamdevi police station, where the wife refused to lodge a complaint against her husband.

A fine was imposed on her for traffic rules violation and abandoning her car in the middle of the road, which caused disruption of vehicular movement, the official said.

Cuttack, Jan 16: At least 15 passengers were injured as five coaches of the Mumbai-Bhubaneswar Lokmanya Tilak Express derailed and three more were displaced after colliding with a goods train amid heavy fog near Cuttack in Odisha on Thursday, railway officials said.

Railway officials had earlier said that 25 passengers were injured in the incident but later officers who reached the site reported that four passengers were found to have suffered major injuries and 11 had received minor injuries.

Passengers with major injuries have been sent to Cuttack Medical College. All passengers are stated to be out of danger.

Officials said the accident happened when the passenger train hit the guard van of a good train around 7 am between Salagaon and Nergundi stations.

The officials said there was heavy fog at the site but it was not clear what led to the accident. The speedometer of both the trains have been seized for inquiry, East Coast Railway Spokesperson J P Mishra said.

Buses have been arranged for all remaining passengers to move towards their destination.

Cuttack is around 10-12 km away and Bhubaneswar(Terminating station) is 35 km.

The accident disrupted train services in the area.

Five trains have been affected due to the accident where restoration work in underway. These include the Bhubaneswar-Mumbai LTT SF Express, the Puri-Rourkela Express, Dhanbad-Bhubaneshwar Rajyarani Express which have all been diverted via Naraj.

"East Coast Railway acknowledges with deep gratitude help of nearby locals and villagers who have displayed great humanitarian values and come to the rescue of injured passengers," Mishra said.
