NCLT initiates insolvency proceedings against Flipkart; Bengaluru HC stays order

Bengaluru, Nov 7: The National Company Law Tribunal (NCLT) initiated insolvency proceedings against the Walmart-owned e-commerce company Flipkart for defaulting on Rs 18 crore payment to one of its suppliers. However, the NCLT order was stayed by the Karnataka High Court after Flipkart approached it. 

The Bengaluru bench of the NCLT initiated Corporate Insolvency Resolution Process (CIRP) against Flipkart India under the Insolvency and Bankruptcy Code, 2016, after a case was filed by Cloudwalker Streaming Technologies seeking CIRP against Flipkart on the grounds that it has committed default on payment of Rs 26.95 crore on supply of LED TVs.

A moratorium had been placed prohibiting the pending case judgements, sale of assets and property, and the Board of Directors asked to extend full cooperation to the insolvency resolution process. 

In its petition, Cloudwalker told NCLT that Flipkart failed to collect all the TVs ordered, failed to pay the excess charges and costs as promised and failed to honour its commitment. Cloudwalker claimed that due to Flipkart's failure in fulfilling its commitment, it was forced to unload the uncollected goods at heavily marked-down price, just so it could remain afloat.

Cloudwalker said it had sent a demand notice to which there has been no reply from Flipkart, and said that it has "consistently and persistently failed, omitted and neglected to discharge its admitted and acknowledged debt and liability." Cloudwalker, in the petition, said that it is apparent that Flipkart is commercially insolvent and is unable to pay its debts. 

Flipkart argued in NCLT that the petition is not maintainable either in law or on facts and it is liable to be rejected with exemplary costs.

Flipkart said that it has already paid Rs 85.57 crore and the allegation that it has no money to pay its liabilities or debt is "baseless, frivolous, bereft of truth and filed with malafide intentions".

"Karnataka High Court has stayed the order of the NCLT in favour of Flipkart. This is an ongoing commercial litigation, which we are challenging. At this stage, we have no further comments," Flipkart spokesperson said in an email response.

Manama: Kannada Sangha Bahrain President Mr. Pradeep Shetty and Vice President of Bahrain's prestigious KHK HEROES Foundation Mohammed Mansoor on Monday, May 11, met The Second Secretary (Consular & CW) of the Embassy of India, Bahrain Mr. P. K. Chowdhury in the Indian Embassy. 

The situation, problems and relief of Indians and Kannadigas residing in Bahrain during the COVID 19 Pandemic was discussed in detail. The distribution of food (dry ration) kits, as well as those seeking repatriation, was also discussed in the meeting.

When asked about the repatriation of distressed Kannadigas, the Second Secretary said that though the number of Kannadigas who wish to return home is not much compared to the rest of the states, still Embassy is compiling all the information and will do the needful soon. 

Mr. Shetty and Mr. Mansoor told the Second Secretary that those who are in problem can contact them and they are ready to do their best.

Bengaluru, Jun 8: Karnataka Pradesh Congress Committee (KPCC) chief DK Shivakumar on Sunday said that Congress is a secular party and they clearly do not want any third candidate from BJP to win the Rajya Sabha elections.

Speaking to news agency, Shivakumar said, "We are a secular party. We are very clear that we don't want any BJP third candidate to win the Rajya Sabha election. My leader, Sonia Gandhi will take a call on it."
"My party leaders have taken a call on HD Devegowda Ji, very soon they will come with an announcement," he added.

Shivakumar had on Saturday said that the party has decided to field one candidate for the forthcoming Rajya Sabha elections.

He said the party would soon take a decision on the issue of support to former Prime Minister HD Deve Gowda's candidature to the Upper House.
The elections to fill the vacant 18 Rajya Sabha seats from seven states will be held on June 19.

Bengaluru, Jun 29: Bengaluru continued to see a sharp spike in covid- 19 cases as 738 more people tested positive on Monday that took the city's tally to 4052 of which 3427 is active.

The surge in Bengaluru pushed up the number of positive cases to 1105 across Karnataka. The total number of cases in Karnataka now stands at 14,295 of which 6382 are active.

The death toll stood at 230 as 19 more people died in the 24 hours till 5 pm on Monday.

Karnataka, particularly Bengaluru, has seen a sharp rise in cases over the last two weeks indicating the possibility of community transmission and further rise in cases.

Estimates by government authorities project that Karnataka will have around 25,000 cases by mid-August.

R.Ashok, the revenue minister incharge of covid- 19 in Bengaluru on Monday told doctors that they would have to dedicate another six months to contain the virus indicating that authorities were expecting the case count to rise in subsequent days and months.

The city reported over 3,200 cases since 19 June as against 844 cases between 8 March and 18 June.

There are around 500 containment zones in Bengaluru that is likely to have an impact of business and activities in the state's growth capital and its efforts to revive the economy.

The state government on Monday held meetings with private hospitals to increase the number of beds available for treatment of covid- 19.

The number of people in intensive careunits (ICU) jumped to 268.
