New Delhi, July 27: In an embarrassment to veteran Congress leader N D Tiwari, a DNA test has confirmed that he is the biological father of Rohit Shekhar.

Earlier, the Delhi high court on Friday rejected his plea not to open his DNA report before a single judge bench, adjudicating the paternity suit of a city youth, who claims to be his son.

The court allowed Justice Reva Khetrapal, who has decided to open Tiwari's DNA report along with those of paternity suit petitioner Rohit Shekhar and his mother Ujjwala Sharma at 2.30 pm today, to declare the DNA test result in open court, but asked her not to give its copies to any party to the case.

Dismissing Tiwari's appeal against Justice Khetrapal's July 19 decision, a division bench of Acting Chief Justice A K Sikri and Justice Rajiv Sahai Endlaw said, "Not opening the DNA report may lead to a lengthy process".

Concurring with the single judge's observation on Supreme Court's direction to maintain confidentiality on Tiwari's DNA profile, the bench said, "We are in agreement with the single judge that nowhere the Supreme Court in its order stated that the DNA profile shall be kept in a sealed cover till the conclusion of trial. This DNA report is a piece of evidence.."

"The purpose was to cut short the controversy and to avoid an unnecessarily prolonged trial. If the sample is not opened now, it may lead to unnecessary cross-examination of the witnesses. We do not find merit in the petition, so it is dismissed," the bench added.

Tiwari's counsel and senior advocate Mukul Gupta had sought quashing of the single judge's order or to provide protection till the Supreme Court clarifies its May 24 order on the issue of confidentiality.

The senior lawyer submitted to the bench that after the single judge dismissed their plea to conduct the trial in-camera and also to keep the DNA report confidential, they have filed an application before the apex court, which is yet to hear their plea.

Daman, Mar 3: A BJP councillor was shot dead on Monday in the Union Territory of Daman, police said.

Salim Memon was sitting in his motorcycle showroom when three to four unidentified persons shot four to five bullets after asking a visitor there to move out, an official said quoting eye-witnesses.

While fleeing, they also shot two rounds close to this visitor who was standing outside, he said.

"Memon was rushed to a hospital in Marwad area but was declared dead on arrival. CCTV footage is being scanned to nab the culprits," said Daman Superintendent of Police Vikramjit Singh.

Memon was elected to Daman municipality as a Congress candidate but then switched over to the BJP.

Sources said Memon, who also has a land brokerage business, had come out of jail a few months back in connection with a case of rivalry.

Thiruvananthapuram, Aug 6 : Kerala Chief Minister Pinarayi Vijayan has said that Congress is known for adopting a soft Hindutva agenda and that there was nothing new in the remarks of Priyanka Gandhi Vadra and Rahul Gandhi on Ayodhya temple construction.

"I am not surprised regarding, Priyanka Gandhi's remark on Ayodhya. From Rajiv Gandhi and Narasimha Rao, Congress had followed a similar stance. I don't think Congress has any stand when it comes to secularism.

If it was the case, then our country would not have reached such a level," the chief minister said when asked about the 'Bhumi Pujan' ceremony at the Ram temple in Ayodhya on Wednesday.

"There is nothing new on Rahul Gandhi or Priyanka Gandhi's position on the issue. They are following the Congress' soft Hindutva agenda. There is no element of surprise," Vijayan said.

Further, Vijayan said that CPI(M) Politburo had made clear the party's viewpoint on the Ayodhya temple construction.

"When it comes to Ayodhya issue. I want to ask who had allowed worship there. It was Congress. Who had allowed to lay the idol there? It was Congress.

Who gave permission to Karseva? It was Congress. Even when it came to demolition of Babri Masjid too who shut their eyes and gave a silent nod for it- wasn't it the Congress regime at the centre? And Muslim League (IUML) was part of it. These are all part of our history," said Kerala Chief Minister.

He said instead of involving in discussions on it, more time should be utilised towards containing the COVID-19 spread in the country and helping the poor who are suffering due to the pandemic.
