Illegal' petrol bunk floored by district administration

March 31, 2011
Mangalore, March 31: As per the order of Dakshina Kannada Deputy Commissioner's court, an Indian Oil outlet, located in front of Karnataka Polytechnic in the city was evicted on Thursday morning.

With this the 'Mangalore Service Centre', whose structure had grown beyond the 10 cents of the land taken for lease from the department of revenue, lost its existence.

The DC court order was executed by a team led by Assistant Commissioner Prabhuling Kavalkatti. The operation commenced at around 9:00am and continued till noon.

Kavalkatti said that Dulsin D'Souza and Canute D'souza, who had taken 10 cents of land on lease over two decades ago, had illegally encroached upon 42 cents of government land to build a full-fledged petrol bunk.

The lessees had approached High Court after receiving a notice from district administration to evict the encroached land. However, the high court had rejected their appeal and shifting the case to Dakshina Kannada DC court for final decision.

“The DC court had given a deadline to the lessees to evict the encroached land before using force. After receiving a negative response from the encroachers the DC court on Wednesday, March 30, has issued the order for final eviction”, said Mr Kavalkatti.

Victor D'Souza, a representative of the lessees said that although they had time for the renewal of the lease till November 27, 2011, the deputy commissioner took an extreme step to demolish the Service Centre.

Kavalkatti said that the lessee can renew their agreement anytime before November 27, but only for 10 cents of land. “But, they had used the 42 cents of extra land illegally to operate the bunk, which is a violation of law. It is apparent that the pumping equipments were fitted on the encroached land”, he said.
