Amend sedition law; Abolish AFSPA: Justice Saldanha

Mangalore, June 14: The Karnataka Chapter of Transparency International India (TII) demanded drastic amendments to the sedition law, abolition of Armed Forces (Special Powers) Act (AFSPA) and urged legal stability to divorces granted to Christians as per canon law.



Addressing the media persons here on Tuesday, Justice MF Saldanha, Chairman of TII Karnataka chapter said that if the sedition law is not changed, many more people would be targeted by the state machinery.


He said sedition law and AFSPA are heavily being misused by the government. The authorities have pursued sedition charges against activists, despite a long-standing Supreme Court ruling that prosecution under the sedition law requires incitement to violence, he said, adding that these laws give protection to wrong doers.


He said AFSPA has been used widely to violate fundamental rights for 50 years mainly in Jammu Kashmir and North-East states. Terming the Act as retrograde he said India has adequate laws to deal with serious problems such as insurgency, and application of AFSPA if necessary should be selectively done and for short period of time.

In a letter to the City Police Commissioner Mr Saldanha has raised the issue of police inaction in the case of Godwin D'Souza, who is being harassed by his first wife.


Godwin D'Souza, a resident of Kulshekhar was married to Shanthi D Souza on August 22, 1999 at Cordel Church, Kulshekhar and the marriage was dissolved by the Ecclesiastical Court (canon law). The decree of nullity was passed by the same court in September 19, 2002 which held that the earlier marriage no longer presents obstacles for entering into a new and valid marriage in the Catholic Church for the both parties.


Based on this cancellation of the church, Godwin got remarried in the same church in 2003 by the same priest. Godwin has two children from his second marriage.



Godwin and his family came to know after 10 years of annulment, that Godwin's first wife Shanti has filed a private complaint with the Chief Judicial Magistrate under Section 200 of the Criminal Procedure Code for various offences punishable under law including section 494 of IPC which deals with bigamy.

Saldanha alleged that this was an extortion attempt by Shanthi because she has threatened Mr Godwin and his father repeatedly and asked them to pay a sum of Rs 60 lakh or else his family will be ruined.

Saldanha said although two FIRs have been registered in Mangalore Rural police station, no action has been taken.


He also urged the Police Commissioner to reconsider the case in the light of legal position.

Bengaluru, Jun 18: Two employees at a plant of Toyota Kirloskar Motor in Karnataka's Bidadi have tested positive for COVID-19, the automobile company said in a statement on Wednesday.

According to the auto major, the two employees had attended work on June 7 and 16 respectively.

"As a first step and through appropriate contact tracing, TKM has started identifying all those employees who may have had primary or secondary contact with the infected employees for necessary treatment and quarantine wherever necessary and is in contact with the local government authorities," the statement said.

Toyota Kirloskar Motors had restarted operations after weeks of nationwide lockdown to prevent the spread of coronavirus on May 26. It said that all necessary precautions were to maintain social distancing and all Central and state government directives were being followed.

"However, despite all such measures, two employees at TKM's Bidadi plant tested positive for COVID-19 on June 16th, 2020. Operations at TKM plant has already been temporarily suspended so that required disinfection can be carried out at the plant," the statement said.

"TKM has extended all necessary support to the infected employees for medical treatment as well as quarantine procedures. The company is in touch with the families of the infected employees so as to support them to handle this situation carefully without further complications," it added.

Bengaluru, May 27: A yet incomplete state-wide survey has revealed that there are over 53.99 lakh households vulnerable to the infection in Karnataka. The survey is being conducted by the government to find COVID-19 vulnerable population particularly with comorbidities and cases like SARI and ILI.

The survey, which is 67.16% complete so far, finds 1.37 lakh households across Karnataka have people with comorbid conditions, excluding a further 13,341 households with symptoms of Influenza Like Illness (ILI), Severe Acute Respiratory Infection (SARI) and Covid-19.

Over 48 lakh households have senior citizens, who on account of their age are at highest risk of death from the disease.

Munish Moudgil, Director of the State COVID War Room, clarified that households could have multiple types of vulnerable people. According to the survey data (which is dated May 26), Kalaburagi and Bengaluru Urban have the highest cases of SARI, ILI with 1,902 households and 1,703 households respectively, although these numbers are likely to rise, as the survey is still incomplete in these districts. 

A BBMP source said that 68% of the survey has been completed in the city, but the data has not been logged yet. The number of SARI/ILI cases is next highest in Shivamogga with 1,217 households, Mysuru with 1,200 and Davangere with 1,178.

The government regards SARI and ILI as indicators of coronavirus and on April 17, had passed an order instructing healthcare workers to test people with these conditions for the coronavirus. Consequently, 51 COVID-19 cases were discovered by testing people with these symptoms.

Belagavi, meantime, has reported the highest incidents of households with comorbid conditions with 12,427 identified so far, followed by Mandya with 9,289, Kalaburagi with 8,311, Shivamogga with 8,140 and Bengaluru Urban with 7,562. Importantly, 3,45,443 vulnerable people have been identified in Bengaluru Urban within 28.26% of data logged in so far.

Bengaluru, Jan 5: Karnataka Minister for Large and Medium Industries Jagadish Shettar warned of strict action against officers who demand bribe from farmers while acquiring land.

Mr Shettar, who paid a surprise visit to defense, aerospace hi-tech industry layout in Haraluru, Devanahalli in Bengaluru Rural district, warned the officials who demand a bribe for sanctioning compensation funds.

He said, 'Lands have been acquired from farmers for the development of the industrial area. It's the duty of state government to provide compensation to these farmers. Complaints must be registered against officials who demand a bribe for functioning compensation funds.'
