Families of air crash victims to move to Apex Court

Mangalore, October 17: Mangalore Air crash Victims' Families Association in a meeting held on Sunday, has unanimously decided to move to the Supreme Court at the earliest, challenging the Kerala High Court Divisional bench's decision which has set aside the single bench's verdict with regard to the compensation to be paid to the air crash victims' families.

The Kerala High Court single bench judge Justice P R Ramachandran Menon in his judgement on the petition filed by Abdul Salam, who had lost his 24-year-old son B Mohammad Rafi in the air crash, had held high the Montreal Agreement.

Accordingly, the victims' family members are entitled to claim a compensation of one lakh Special Drawing Rights (SDR), (which is around Rs 78 lakh) per head. The significant judgement was delivered on July 20, 2011.

However, the Kerala division bench set aside the judgment of the single bench, thus allowing the petition filed by the insurance companies on August 25.

In wake of contrast judgement, Abdul Salam has decided to move to the Supreme Court backed by the Association. Speaking to the media persons following the Association meeting at Sahodaya Hall on Sunday, Association President Mohammad Beary said that Abdul Salam should move to the Apex Court before November 25.

“We would require Rs 10 lakh for the Supreme Court proceedings, hence we have decided to collect Rs 20,000 each from the victims' families. We would send letters to all the families and would meet them in person and seek their help. If the SC gives judgement in our favour, then it is like winning the battle,” he said.

Legal Advisor of the Association Varadaraj Kayangal said that the Supreme Court has to interpret the decision of the single bench and the divisional bench and uphold one of the orders.

Quoting the HC single bench order he said, “the carrier shall not be able to alter or limit its liability and each family should be compensated with a minimum amount of one lakh SDR as per Article 21 (1) of the Montreal Agreement.”

Meanwhile, the office-bearers of the Association will meet Union Civil Aviation Minister Vayalar Ravi, MP's of both ruling and opposition parties this week in Delhi. Mohammad Beary said that they would discuss the matter with the Minister and request him to fulfill their demands. “If he fails to give favourable response, then we would stage a protest march to the airport,” he informed.

Mangaluru, Jan 2: Shwetha Rasquinha, Assistant Professor and Head of the Department of Social Work, St Aloysius College, Mangaluru, has been awarded Doctor of Philosophy (PhD) degree by the Mangalore University for her thesis titled “Effectiveness of Social work intervention on caretakers of cancer patients- A social work study in Mangalore”.

She did her studies under the guidance of Dr Rameela Shekhar, Professor (Rtd), School of Social work, Roshni Nilaya, Mangaluru.

Ms Shwetha Rasquinha hails from Vittal, D/o Vincent Rasquinha and Late Regina Rasquinha, and is the second person to complete doctoral studies from the Vittal Parish.

Her colleagues and well-wishers have congratulated her for her highest achievement in academics and successful completion of quality research.

Hubli, Feb 25: A Hubli court in Karnataka has sent to police custody till February 28 three students from Jammu and Kashmir, who were booked under sedition charges for raising pro-Pakistan slogan in a video shared on social media.

A second Joint Magistrate First Class (JMFC) court on Monday sent the three students, identified as Basit Ashik Sophi (19), Talib Majid (19) and Amir Mohiuddin (23), to police custody till February 28 for questioning in the matter.

The court directed the police to make the accused undergo a medical evaluation before the interrogation and produce the medical certificates in the court before the next hearing.

The three students were last week transferred to Belgaum Hindalga jail from Hubli sub-jail and the case, registered in Gokul Road police station, was also transferred to the rural police station because the video was recorded in the college hostel room which is in the latter's jurisdiction.

The Kashmiri students were under judicial custody since February 17 following their arrest for raising pro-Pakistan slogans and posting a video of the same on social media on the night of February 16.

Bengaluru, Aug 7: The Karnataka government would provide Rs 10,000 immediate relief to families affected by heavy rains and flooding in districts across coastal, central and southern areas of the state, an official said on Thursday.

"Chief Minister B.S. Yediyurappa has directed all the Deputy Commissioners in the rain-cum-flood-hit districts to provide Rs 10,000 interim relief to the affected families and Rs 5 lakh to those whose houses were completely damaged in the natural disaster," a Revenue Department official told media persons here.

As the south-west monsoon advanced and intensified, heavy and widespread rains with gusty winds have been lashing 12 of the 30 districts across the state, wreaking havoc and disrupting normal life due to flooding, landslides, lakes and ponds overflowing, and rivers and their tributaries in the spate.

"The Chief Minister also instructed the officials to make use schools, colleges and public places as relief centres to shelter the rain-cum-flood-hit families, as hostels and community halls have been converted into Covid care centres in the affected districts," said the official.

The affected districts have also been advised to conduct a survey of crop loss suffered by farmers for compensation under the centrally-sponsored Pradhan Mantri Fasal Bima Yojana and the Weather Based Crop Insurance Schemes.

Deputy Commissioners have been told to take preventive measures to protect and provide relief to the people from heavy rains, floods and landslides in the affected districts.

"Yediyurappa also directed ministers in-charge of the districts to remain in their constituency and visit the affected areas to assess damage caused by the rains and flash floods for compensation and relief aid," noted the official.

The Chief Minister on Wednesday announced Rs 50 crore for rescue and relief operations in the affected districts across the state.

Meanwhile, the Meteorological department has issued a red alert on heavy rains in the affected districts of Kodagu, Udupi, Dakshina Kannada and Uttar Kannada in the coastal region and in Shivamoga, Chikkamagaluru, Hassan and Haveri in the Malnad region.

"Bagamandala in Kodagu district where Cauvery river springs near Talakaveri received a whopping 486 mm rain during the last 24 hours, causing flash floods and disrupting normal life as offices, shops and eateries remained shut and public transport was affected," added the official.

The water-level in Cauvery and Lakshmanatheertha is flowing at high level while the Sayi layout and Kuvempu layout Kushalnagar is inundated and the affected residents were shifted to safer location.
