Judiciary should set example by denying anticipatory bail for culprits'

Mangalore, November 9: Mocking at the practice of the elite of getting themselves admitted to hospital when caught in legal net, Justice Michael Saldanha said that Judiciary should set example by denying or holding the plea for anticipatory bail by such culprits till they recuperate and get discharged from the hospitals.

Addressing a news conference in Mangalore on Tuesday, Justice Michael Saldanha speaking about recent church vandalism incident and the recent trends that have emerged as the repercussion to political instability in the State, said that, of the cases filed in the Karnataka State where illness is pleaded, only 1.4 per cent have some substance in it while the rest are all fake.

“In most of the cases it is only the powerful who either fall ill or are out of station when the police come searching for them. The poor are always caught and produced before the Court. The Court should come out clear and say that if you are absconding then you are disqualified to get anticipatory bail,” Justice Saldanha said adding that there is 'zero justification for hospitalisation' in most of the cases in the Karnataka State .

With regard to the VIP treatment given to the ministers and other notorious criminals in jails, Justice Saldanha said that details must be sought with regard to the money spent to provide special facilities at Parappana Agrahara Prison as well as other jails where these Ministers have been kept.

“It is better to construct a tunnel from Vidhana Saudha to Parappana Agrahara so that at least traffic in this route will be relaxed,” he said in a lighter tone.

Justice Saldanha said that while congestion in Court prevents poor from getting a bail for several days or months, these elite criminals when arrested by the police, manage to get bail in matter of hours.

“In special cases, applications are taken out of turn, even while 1,700 applicants wait in queue for their turn to come,” he said questioning as to under which provision of law these people are given special treatment.

With regard to recent vandalism in churches in the city, Justice Saldanha said that there is a need to have incisive investigation into the same as he feels that there are invisible hands playing behind these incidents.

“These are not sporadic incidents. Instead they are pre-planned. If these are sporadic incidents, then why have the vandalism taken place in prayer halls of one particular religion. If the person responsible for the incident is a lunatic venting out his frustration, has he vented it out at a religious centre of one religion and not anywhere else,” the Justice questioned.

Mangaluru/Mysuru, May 19: Though the Karnataka government permitted the private buses, operators in Dakshina Kannada district have decided not to operate buses until May end. In Mysuru district too the private buses remained off the roads.

Dakshina Kannada Bus Owners’ Association President Dilraj Alva said “Technically, private bus operators are not able to operate services as all of us have surrendered our permits. If we start services we will have to pay the tax for entire month. Hence, we have decided to resume bus services from June 1.”

The private buses had suspended their services since March 24.

In addition, bus owners also have two more demands which the state government needs to consider on priority, he said.

“We have requested the government to exempt private buses from paying tax for the next six months. We were not plying buses during lockdown and it will be tough for us in the next three months to operate as per new conditions.”

“The government has allowed only 30 persons in each bus to maintain social distancing. In addition, we have been urging the state government for bus fare revision since 2013. The government has revised the bus fares of KSRTC twice after that,” Alva said adding that bus owners will be meeting Mangaluru RTO on Tuesday.

Nanded, May 24: In a sensational incident, a Lingayat seer from Karnataka was found murdered in his mutt in the Nanded district of Marathwada region of Maharashtra on Sunday.

The seer, who was strangled to death, has been identified as Shivacharya Nirvanarudra Pashupatinath Maharaj, the founder-spiritual head of Nirvanji Pashupatinath Mutt.

Addressing media persons, Nanded Superintendent of Police Vijaykumar Magar, the prime suspect, Sainath Langote first killed his accomplice Bhagwan Shinde and then went to the ashram late on Saturday.

He entered Shivaharya Maharaj's bedroom where he was resting and threw chilli powder in his eyes, blinding him.

Then he quickly grabbed cash of Rs 69,000, his laptop and other valuables in the bedroom worth approximately Rs.1.50 lakh, besides the seer's car keys.

As Shivacharya Maharaj attempted to grapple with him, Langote pinned him down and strangled him, then dragged his body to the sadhu's car parked outside and dumped it into the boot.

"He started the car and sped off towards the road outside, but the car crashed into the main gate of the ashram creating a noise, alerting the other sevaks sleeping inside the ashram," Magar said.

Around 8-10 other ashram sevaks rushed outside to check the ruckus and when they saw their seer's belongings and his body in the car trunck, they attempted to stop Langote, but he gave them the slip.

A short distance away, Langote managed to steal a motorbike and sped off into the darkness and hours later, the police found the body of his accomplice Shinde from a nearby school premises, Magar said.

In view of the sensitivity of the incident, Magar said around five crack teams were formed which fanned out into the district and managed to catch Langote this afternoon.

"The prima facie motive for the seer's murder was clearly robbery and the second killing could be due to rivalry or some differences among them. The absconder suspect has been caught by a police team. We will interrogate him and get further details of the crime," Magar said.

Nanded Congress strongman and PWD Minister Ashok Chavan appealed that the murder should not be politicized, since the police investigations are underway and the autopsy report is awaited.

He said the deceased sadhu belonged to the Lingayat caste, and both Shinde and Langote who belonged to the same community were his followers.

Shivacharya Maharaj had come to Nanded over a decade ago and set up the ashram which he ran along with a band of followers.

Mangaluru, Jan 17: An auto-mobile shop at Deralakatte here caught fire on Friday incurring huge loss on the shopkeeper.

According to police, the incident happened in the morning when the shop owner opened the shop.

Locals suspect that miscreants might have set the shop on fire and had escaped from the scene at night.
