Mangalore Air crash: Now, injured move high court for enhancement of solatium

Mangalore, October 7: One of the survivors of Mangalore Air crash has filed a petition before the Kerala High Court seeking maximum compensation to injured persons in the aviation disaster of May 22, 2010, which killed 158 people on board.

The petition was filed by Krishnan, a resident of Uduma in Kasargod district, who suffered injury in the air crash.

“Being the injured person as defined under the Carriage by Air Act 1972 and also being entitled to enforce the claim for damages quantified, he made a claim for quantified damages. Despite being a public sector undertaking, the company insisted on receiving a lesser compensation than that is quantified and fixed under the Act,” the petition pointed out.

The aircraft was carrying 160 passengers and six crew members. Except eight survivors, including the petitioner, all others were killed in the accident.

The analysis of the flight data recorder and cockpit voice recorder confirmed the negligence on the part of the pilot.

The petitioner submitted that he was employed in Dubai and his family is dependent on him being the sole earning member of the family. The accident has deprived them of their livelihood.

The mental agonies suffered by the petitioner on account of the traumatic accident has manifested in physical injuries to his body in various forms and he is undergoing treatment.

Counsel for the petitioner Kodoth Sreedharan said that in such a case without asking for anything the carrier is liable to pay Rs 1 lakh Special Drawing Rights (now enhanced to 1,13,100 Special Drawing Right) as compensation and 1000 Special Drawing Rights (now enhanced to 1131 Special Drawing Rights) for loss of baggage and the second tier liability.

Bengaluru, Jul 4: A case has been filed against a man who posed himself to be the PMO's National Security Council 'youth advisor' during his visit to Bengaluru.

According to the police, Ankit Dey (22 yrs) who had visited Bengaluru between 16 to 20 June and for his stay at ITC Gardenia, posed himself as a youth advisor to National Security Council at PMO.

As per the information given by the hotel staff, the police department had communicated with the PMO. They got clarification that there is no such person designated in the Prime minister's office. A complaint has been filed in Cubbon Park police station.

"The man found to be 22-year-old as per the identity shown in the hotel, left his visiting cards. Although he did not ask for any discount in the hotel," said Police.

A senior police officer said, "A criminal case has been filed against the accuse 'Ankit Dey' under the section IPC 420 (cheating and dishonesty), 465 (forgery), 468 (forgery for purpose of cheating), 471 (using as a genuine forged document), 417 (cheating).

Police have started its work to find him as per the clues we have got. At this point of time, we can not reveal more details," Officer said.

Mangaluru/Udupi, Aug 1: Karnataka’s twin costal districts of Dakshina Kannada and Udupi have recorded 10 more deaths related to covid-19. 

With four more deaths, Dakshina Kannada’s covid-19 death toll mounted to 159. Udupi’s covid-19 death toll mounted to 35 with 6 new deaths. 

Meanwhile, DK recorded 139 new covid positive cases. Among them 91 are from Mangaluru, 19 from Bantwal, 14 from Beltangady, nine from Puttur, and six from other districts.

With this, the total number of the covid-10 cases in DK reached 5,852. Out of these only 3,008 cases are currently active. 

On the other hand, Udupi recorded 136 new covid-19 cases. The total number of covid-19 cases reported in the district mounted to 4,492. 

According to the official bulletin, a total of 32,401 samples have been collected so far. Among them 27,463 have turned out to be negative and 446 reports are awaited.

Bengaluru, Jan 8: The Karnataka high court on Tuesday directed the government to submit steps taken in respect of the order of Lokyukta in relation to the Kethaganahalli landgrab case involving former chief minister HD Kumaraswamy, his relatives and former minister DC Thammanna.

A division bench headed by Chief Justice Abhay Shreeniwas Oka gave the direction on a PIL filed by Samaj Parivartan Samudaya (SPS), an NGO. The petitioner said despite an order from the Lokayukta on August 5, 2014, to take action within 15 days, no action has been initiated till date in respect of encroachment of a huge tract of land in Kethaganahalli along Bengaluru-Mysuru highway.

SPS says the land was purchased in 1979 contrary to norms of Karnataka Land Revenue Act. It claims Kumaraswamy and others paid only Rs 5,000 per acre, although the prevailing market rate was Rs 25,000 to Rs 30,000 per acre.
