Illegal commercial structure: High Court directs BDA to take action against DVS

Bangalore, October 20: Karnataka High Court has directed the Bangalore Development Authority (BDA) to take action against former Chief Minister D.V. Sadananda Gowda and Food and Civil Supplies Minister D.N. Jeevaraj within three months for violating the terms and conditions of allotment of sites.

With this Mr Gowda is all set to lose his newly built commercial complex in the metropolitan city.

The court also quashed the building plans sanctioned by the Bruhat Bangalore Mahanagara Palike (BBMP) favouring the duo.

The provisions of agreement and the rules enable the BDA to cancel the allotment for violation of the terms and conditions of the allotment by issuing a prior notice to the allottees, besides forfeiture of 12.5 per cent from the deposit amount.

Moreover, the declaration signed by the allottees empowers the BDA to take back the site without paying any compensation for both the site as well as for any structure constructed on it.

A Division Bench comprising Justice D.V. Shylendra Kumar and Justice H.S. Kempanna passed the order on a public interest litigation (PIL) petition filed by K.G. Nagalaxmi Bai alleging that Mr. Gowda and Mr. Jeevaraj constructed structures in violation of the law on adjacent sites allotted to them at HSR Layout in the city.

The Bench noticed that though the BDA had rejected their request for amalgamation of their sites, Mr. Gowda and Mr. Jeevaraj had gone ahead and constructed a three-storey homogeneous structure in violation of the plans sanctioned by the BBMP in their respective sites.

After filing of the PIL in August 2011, the BBMP in October 2011 approved the modified plan for five floors having about five dwelling units, citing that such a plan was permissible as per the revised zonal regulations, the Bench said, while observing these actions were attempts to sustain the initial infraction in construction.

The Bench pointed out that as per Condition No. 4 of sale-cum-terms of agreement, the allottees can neither subdivide the site nor construct a structure having more than one dwelling unit. Though the BBMP might not be aware of these terms and conditions at the time of approving the plans, the allottees were fully aware.

The Bench also noted that authorities, who were expected to take corrective action in such an instance, perhaps didn't given the antecedents of the allottees.

Hope CM will take action, says DKS on BJP MLA's birthday bash

Bengaluru, Apr 11: Karnataka Congress chief D K Shivakumar on Saturda said that he was hopeful that the Karnataka Chief Minister would take stern action against BJP MLA M Jayaram--who was on Friday seen celebrating his birthday with several villagers in Gubbi taluk in Tumkur, in violation of social isolation measures and nationwide lockdown to fight the coronavirus outbreak.

"I am sure that the Chief Minister will take action on all these types of activities. We have already petitioned the DGP. Suo moto case should be registered immediately," the Karnataka Congress Chief told media.

Speaking about the video conference meeting that Congress President Sonia Gandhi held with all Pradesh Congress Committee (PCC) presidents via video conference, he said: "She has given us directions that the party has to play its own role. She said that the party needs to be very active, apart from the government."

With regards to the farmer's struggles due to the national lockdown, the Karnataka Congress Chief said that the farmers are in a 'very grim situation'. "I appeal to all the people of Karnataka that we should go to the fields and discuss with farmers and buy the materials. Let us purchase their fruits and vegetables and distribute them at the village level."

Accompanied by sons, Deve Gowda files nomination for RS polls from Karnataka

Bengaluru, Jun 9: JD(S) patriarch H D Deve Gowda on Tuesday filed his nomination as party's candidate for June 19 Rajya Sabha elections from Karnataka.

The former Prime Minister was accompanied by his sons former Chief Minister H D Kumaraswamy and former Minister H D Revanna, state JD(S) chief H K Kumaraswamy and others, as he filed his papers at the office of Legislative Assembly Secretary M K Vishalakshi, who is the returning officer for the polls. JD(S) on Monday had announced that Gowda will be contesting the Rajya Sabha polls.

Announcing the decision, Kumaraswamy had said Gowda decided to contest following the request of Congress President Sonia Gandhi, several national leaders and party legislators, and it was not an easy task to "persuade" him to enter the Rajya Sabha.

The JD(S), which has 34 seats in the assembly, is not in a position to win a seat in Rajya Sabha on its own and will need support from the Congress with its surplus votes. A minimum of 45 votes are required for a candidate to win. If he wins, this will be the second Rajya Sabha entry for 87-year-old Gowda, the first time being in 1996 as the Prime Minister.

Gowda was defeated in Tumkur constituency by BJP's G S Basavaraj by over 13,000 votes in the 2019 Lok Sabha polls. As joint candidate of the then ruling Congress-JDS coalition, Gowda had chosen to contest from Tumkur at the last minute after vacating Hassan-his home turf, to grandson Prajwal Revanna (a current MP).

Election is scheduled on June 19 to fill four Rajya Sabha seats from Karnataka, represented by Rajeev Gowda and BK Hariprasad of Congress, Prabhakar Kore of the BJP and D Kupendra Reddy of JD(S) that will fall vacant on June 25, with their retirement. Today is the last date for filing nominations. With BJP not fielding any candidate against Gowda, his election is likely to be unanimous.

Karnataka BJP urges Modi govt to ban PFI, SDPI

Bengaluru, Jan 29: The Karnataka unit of BJP has urged the Centre and the State governments to ban the Popular Front of India (PFI) and the Social Democratic Party of India (SDPI), accusing them of harbouring terrorist tendencies.

Addressing a press meet, N Ravi Kumar, state general secretary of the party, alleged that there was a nexus between the Congress, the PFI and the SDPI.

“Recent reports have exposed the links between the PFI and the Congress,” he said, accusing Congress leader Kapil Sibal of receiving huge funds from PFI to defend their cases in the Supreme Court.

He also accused the organisations as the ones responsible for the death of 23 Hindu activists in Karnataka. Such incidents have proven that both SDPI and PFI are dubious organisations, he said.
