Kerala can't act in Italian marines case, says Centre; Supreme Court slams stand

New Delhi, April 21: In a controversial move, the Centre today told the Supreme Court that the Kerala Police doesn't have any jurisdiction to probe the murder of two Indian fishermen by Italian marines as the incident happened in international waters. Additional Solicitor General Harin Raval said that the Italian vessel Enrica Lexie was at 20.5 nautical miles from India's coast, whereas the Indian territory ends at 12 nautical miles.

Angered by the statement, the top court, slamming the Centre, said, "You are saying Kerala Police doesn't have jurisdiction? It is very unfortunate and can't be acceptable. How can you take such a stand? Two Indian citizens have been killed."

The Centre, however, stuck to its stand. The Supreme Court was hearing a petition filed by the owners of the Italian ship Enrica Lexie, detained following the killing of two fishermen on February 15, for allowing it to continue its voyage.

The Supreme Court also indicted it will release the ship subject to conditions and posted the case to 30 April because wife of one of the victims didn't respond to the court notice.

Kerala Chief Minister Oommen Chandy too criticised the Centre, saying they followed up the case after consulting it.

When contacted, External Affairs Minister SM Krishna said that he was not consulted about this stand by the Centre in the court.

Today's controversial comments by the Centre also coincide with the Italian government offering Rs. 1 crore each as settlement to the families of two Indian fishermen.

Italian marines, Latorre Massimillano and Salvatore Girone, were arrested on February 20 and sent to judicial custody for shooting dead two Indian fishermen, 25-year-old Ajesh Binki, and 45-year-old Gelastine, on February 15, off Alappuzha. The marines, posted on the Enrica Lexie, had allegedly mistaken the two for pirates.

New Delhi, Jan 31: Slamming the BJP over the Jamia firing incident, Congress leader Priyanka Gandhi Vadra on Friday said such incidents were possible with the ruling party's leaders inciting people to shoot, and asked Prime minister Narendra Modi to answer whether he stands with violence or non-violence.   

Her attack on the government comes a day after tensions in the Jamia area spiralled on Thursday after a man fired a pistol at a group of anti-CAA protesters, injuring a student, before walking away while waving the firearm above his head and shouting "Yeh lo aazadi" amid heavy police presence in the area.

"When the BJP government ministers and party leaders incite people to shoot, give provocative speeches, then all this becomes possible. The Prime Minister should answer what kind of a Delhi he wants to build?" Priyanka Gandhi said in a tweet in Hindi.

Does the PM stand with violence or non-violence, she asked.

"Does he stand with development or with anarchy?" the Congress general secretary said.

Nagpur, Aug 8: "He was a great son and always the first one to help others in need. He sacrificed his life for the country," said Neela Sathe, the mother of late captain DV Sathe, who was flying the Air India flight that crash-landed at Kozhikode airport on Friday, claiming 18 lives.

Indian Army Retired Colonel Vasant Sathe and his wife Neela lost both their sons in line of duty. The couple is originally from Nagpur, Maharashtra.

Speaking to news agency, Neela broke into tears and said, "He was a great son and always the first one to help others in need. 

His teachers still appreciate him. During the Ahmedabad floods, he saved the children of the soldiers by lifting them in his arms. I wish God would have called us instead of him."

"Both our children sacrificed their lives for the country," she added.

Remembering DV Sathe's childhood, Neela talked about every that moment when he made his parents proud.

Neela told with great pride that Captain DV Sathe had received the Sword of Honor and had also won eight medals in the Air Force.

Neela last talked to DV Sathe over phone call a few days ago during which captain told her mother not to go out of the house amid COVID-19 crisis as if something happens to her, he won't be able to bear that.

Vasant, captain's father retired as a colonel after serving in the Army for 30 years, following the footsteps of their father, both his sons joined too the Army.

Their elder son Vikas, was in the Army, and at the age of 22, he was martyred in an accident in Ferozepur in 1981. Their younger son Deepak (DV Sathe), who served as a pilot in Air India after serving in the Indian Air Force, died in the plane crash on Friday.

An Air India Express plane carrying 190 passengers including 10 infants skidded while landing at Karipur Airport in Kozhikode on Friday evening.

New Delhi, Mar 6: Union Finance Minister Nirmala Sitharaman on Friday will move the Insolvency and Bankruptcy Code (Second Amendment) Bill, 2019 for consideration and passing in Lok Sabha.

In December last year, the Union Cabinet had approved a proposal to promulgate an ordinance to amend the Insolvency and Bankruptcy Code (IBC) 2016.

The amendments will remove certain ambiguities in the IBC 2016 and ensure smooth implementation of the code, an official statement said.

The move is aimed at easing the insolvency resolution process and promoting the ease of doing business. Aimed at streamlining of the insolvency resolution process, the amendments seek to protect last-mile funding and boost investment in financially-distressed sectors.

Under the amendments, the liability of a corporate debtor for an offence committed before the corporate insolvency resolution process will cease.

The debtor will not be prosecuted for an offence from the date the resolution plan has been approved by the adjudicating authority if a resolution plan results in change in the management or control of the corporate debtor to a person who was not a promoter or in the management or control of the corporate debtor or a related party of such a person.

The amendments are aimed at providing more protection to bidders participating in the recovery proceedings and in turn boosting investor confidence in the country's financial system.
