Centre submits relevant documents before SC on sub-quota issue

New Delhi, June 12: The Centre today placed before the Supreme Court the "relevant" material and documents on the basis of which it carved out 4.5 per cent sub-quota for minorities in the central educational institutions such as IITs.

Additional Solicitor General Gourab Banerji mentioned the issue and placed the documents before a bench comprising justices K S Radhakrishnan and J S Khehar, which had yesterday asked the Ministry of Human Resources Development to place the material by today.

The apex court, which had yesterday refused to stay the Andhra Pradesh High Court order quashing the 4.5 per cent sub- quota for minorities within the 27 per cent reservation for OBCs in central educational institutions, had posted the matter for hearing on Wednesday.

The bench had ticked off the government for the way it had handled the "complex" and "sensitive" issue. The apex court had also expressed its "unhappiness" that the Centre was blaming the High Court when it had itself failed to produce documents to support its case.

The bench was critical of the Ministry of Human Resource Development rushing to the apex court with the appeal against the May 28 order of the High Court without documents to justify the policy of carving out 4.5 per cent sub-quota within the 27 per cent OBC reservation.

The Union government had moved the apex court challenging the High Court order quashing the 4.5 per cent sub quota for minorities. The December 22, 2011 Office Memorandum for the sub-quota for socially and educationally backward classes of citizens belonging to minority communities in central educational institutions and jobs was announced by the Centre ahead of the Assembly elections in five states including Uttar Pradesh and Punjab.

Lucknow, Jul 2: After a video showing health workers allegedly tossing bodies of coronavirus victims in a large pit in Karnataka, BSP President Mayawati on Wednesday stated that the incident is the "height of cruelty and insult to humanity".
The former UP Chief Minister demanded that the guilty must be punished.

"The tragedy that the bodies of COVID-19 victims being thrown into trenches in Ballari, Karnataka is the height of cruelty and an insult to humanity. Though incidents related to inhuman cruelty with corona patients are rampant but guilty of Ballari must be punished by the state government," Mayawati said in a tweet.

Also, in another tweet, she asked the Central government to extend the Pradhan Mantri Garib Kalyan Anna Yojana till the end of the coronavirus pandemic.

"In order to check ignominy of starvation on account of long unprecedented hardship & unemployment due to coronavirus and the subsequent nationwide lockdown, the PM Garib Kalyan Anna Yojna must continue not till November but till the end of the pandemic, this is the demand of BSP," she tweeted.

New Delhi, Jan 15: The mother of 23-year-old paramedic student, who was raped and brutally assaulted by six men in December 2012, on Tuesday said she knew that the curative petitions of the convicts will be rejected and is confident that they will be hanged on January 22.

Her remarks came after the Supreme Court on Tuesday refused to stay the execution of two of the four death row convicts in the 2012 Nirbhaya gang rape and murder case while dismissing their curative petitions against their conviction and capital punishment.

"The curative please had to be rejected. This was the third time they had gone to the Supreme Court. Whatever pleas they file, we are ready to face them and we will fight it out. We feel that they will be hanged on January 22. We want that to happen," Nirbhaya's mother told PTI over phone.

The four convicts -- Vinay Sharma (26), Mukesh Kumar (32), Akshay Kumar Singh (31) and Pawan Gupta (25) -- are to be hanged on January 22 at 7 am in Tihar jail as a Delhi court issued their death warrants on January 7.

Vinay and Mukesh had filed curative petitions on January 9.

Shortly after the apex court refused to stay the execution of two of them, Mukesh moved a mercy petition before President Ram Nath Kovind.

Mukesh also approached the Delhi High Court for quashing the death warrant. The high court is expected to take up his petition on Wednesday.

The Kozhikode International Airport located at Karipur is not safe for the landing of flights in rainy season, according to an air-safety expert, who had warned the aviation ministry and the civil aviation regulator about this in 2011. 

The warning was particularly about the dangers of permitting passenger aircraft to land on runway 10 of the airport during rains and unfavourable wind conditions. 

Nine years later, on August 7, 2020, the warning became a reality when an Air India Express pilots landed in tailwind conditions and the aircraft overshot the tabletop runway to drop off the end and crash.

 “An aircraft landing on runway 10 in tailwind will experience poor braking action due to heavy rubber deposits … All such flights … are endangering the lives of all on board,’’ said Capt Mohan Ranganathan, in a letter sent on June 17, 2011 to then director general of civil aviation Bharat Bhushan and Nasim Zaidi, chairman of a civil aviation safety advisory committee, which was formed after the May 2010 Mangaluru air crash which killed 158 people.

“My warning issued after the Mangaluru crash was ignored. It is a table-top runway with a down slope. The buffer zone at the end of the runway is inadequate,” Capt Ranganathan said. Given the topography, he pointed out, the airport should have a buffer of 240m at the end of the runway, but it only has 90m (which the DGCA had approved). “Moreover, the space on either side of the runway is only 75m instead of the mandatory 100m,” he added.

Capt Ranganathan said there is no guideline for operations on a table-top runway when it is raining. “Runway 10 approach should not be permitted in view of the lack of runway end safety area (RESA) and the terrain beyond the end of the runway. RESA of 240m should be immediately introduced and runway length has to be reduced to make the operations safe,” his letter said.

If an aircraft is unable to stop within the runway, there is no RESA beyond the end. The ILS localiser antenna is housed on a concrete structure and the area beyond is a steep slope. “The Air India Express accident in Mangalore should have alerted AAI to make the runway conditions safe. We have brought up the issue of RESA during the initial Casac-sub group meetings. We had specifically mentioned that the declared distances for both runways have to be reduced in order to comply with ICAO Annex 14 requirement,” Capt Ranganathan said.

He said the condition of the runway strip was known to DGCA teams that have been conducting inspection and safety assessments. “Have they considered the danger involved? Did the DGCA or the airlines lay down any operational restrictions or special procedures?”

The letter also refers to Approach and Landing Accident Reduction (ALAR) training, which is supposed to be mandatory before every monsoon, but airlines don’t follow it, he said. “70% of accidents take place during approach and landing and that is why this training is essential,” he added.
