Samajwadi Party brass wanted rape taint on Rahul Gandhi: Ex-MLA

rahul_copy_copyNew Delhi, July 31: In a startling revelation, a former MLA of the Samajwadi Party has told the Supreme Court that his party leadership had egged him to file a PIL in the Allahabad high court in 2010 against Congress general secretary Rahul Gandhi accusing him of abduction and rape of an Amethi girl.

The HC, while dismissing the PIL, on March 7, 2011, had imposed a cost of Rs 50 lakh on petitioner Kishor Samrite and ordered a CBI probe against him. But, on appeal the apex court had on April 6, 2011, stayed the HC order and issued notices to the UP government and Gandhi.

Gandhi last Friday told the Supreme Court that accusations against him were false, malicious and baseless.

But, what made Samrite to strike back at SP was the affidavit filed by the Akhilesh Singh Yadav government terming him as a person who has lost his balance. Samrite said, "When the petitioner was called by senior leaders of the present ruling party (in the state) to file the writ petition, petitioner bona fide filed the writ petition."

"The state, in the changed political equation, is wanting to disown its actions and wash its hands and making a scapegoat of the petitioner," Samrite said and clarified that right from the beginning he had been taking a stand for inquiry into the alleged incident only and not for a probe against Gandhi.

The ex-MLA from Madhya Pradesh, who was elected on a SP ticket to the assembly from Lanji constituency in Balaghat district, said he was shocked to read the state's stand that "the petitioner is mentally imbalanced" and narrated the sequence of events leading to filing of the PIL in the HC in 2010.

Samrite said he was called to Delhi in 2010 "to meet the other senior leaders, who were in Delhi as the Parliament was in session, where he was apprised about the facts of the serious incident that had been reported from a village in UP and in view of the fact that he had taken up several public causes in the past he was requested to file a writ petition in the nature of PIL in the Allahabad High Court's Lucknow Bench. Thus, the writ petition came to be filed and notice was issued on it."

He said after he filed the appeal against the March 7, 2011, High Court order in the Supreme Court, he was interrogated by the CBI during which he had narrated the entire sequence of events leading to filing of the PIL in HC. "The same should form a part of the status report which the CBI desired to submit before the Supreme Court," he said.

Gandhi in his response to the Supreme Court's notice issued on April 6, 2011, on Samrite's petition, had said: "I emphatically deny the allegation of rape and detention of the writ petitioners by me and say that both these allegations are false, malicious and baseless and no cognizance could be taken by any responsible person of such allegations made on websites."

Gandhi had requested the court to take action against Samrite for filing a vexatious petition to harm his public image and give a political twist to the malicious allegation that that he had kidnapped the girl and her family.

The HC had asked for a CBI probe against Samrite on March 7. The CBI had lodged a case under Indian Penal Code Sections 120B (criminal conspiracy), 181 (false statement on oath), 211 (false charges to cause injury) and 499-500 (defamation). On Samrite's appeal, the SC had on April 6, 2011, stayed the HC order and issued notice to UP government and Gandhi.

The HC in its March 7 order had said, "We also direct the CBI director to register a case against Kishore Samrite and all other persons who are found involved in the plot, if any, hatched in order to defame Shri Rahul Gandhi, Member of Parliament from Amethi."

Lucknow, Aug 4: Rashtriya Swayamsewak Sangh (RSS) Chief Mohan Bhagwat on Tuesday left for Ayodhya to attend foundation laying ceremony of Ram Temple tomorrow.

The Prime Minister is scheduled to lay the foundation stone of the Ram temple in Ayodhya on August 5. The construction of Ram temple will begin in Ayodhya after the said ceremony in which various dignitaries from political and religious fields are scheduled to participate.

Bhagwat, along with PM Modi, Uttar Pradesh Chief Minister Yogi Adityanath, Governor Anandiben Patel and President of Ram Mandir Trust, Nitya Gopal Das will be present on stage for the event.

Supreme Court, on November 9 last year, had directed the Central government to hand over the site at Ayodhya for the construction of a Ram temple.

The formation of Shri Ram Janmabhoomi Teertha Kshetra Trust was announced on February 5 for the construction of Ram temple at Ayodhya. The Trust has been mandated by the Central government to oversee the construction of Ram temple in Ayodhya.

Kochi, Apr 4: France on Saturday evacuated 112

French citizens stranded in Kerala and Tamil Nadu in a special Air India flight, official sources said here.

The Embassy of France had made a request to the Kerala government to facilitate the journey of the French citizens stranded due to the lockdown announced by the central government to prevent the spread of novel coronavirus.

The French citizens, mostly tourists and those who came for Ayurvedic treatment, were brought here by the state tourism department 24 days ahead of their trip.

They underwent a medical examination before boarding the flight for Paris from Cochin International Airport at 08.13 am on Saturday, officials said.

The Air India flight was chartered by the French government for evacuating its citizens in various cities in India including Kochi, Bengaluru and Mumbai.

On Friday, Gulf nation Oman had evacuated its 46 citizens stranded in Kochi in an Oman Air flight.

New Delhi, Mar 22: The exercise to update the National Population Register (NPR) and the first phase of the Census 2021, scheduled to begin from April 1, are likely to be deferred for an indefinite period due to Coronavirus pandemic, officials said.

A formal order on this effect is expected within a day or two.

Discussions are going on at the highest level of the government and in all probability, the NPR and house listing phase of the Census work will be deferred till the threat of the Coronavirus is over, a home ministry official said.

The exercise to update NPR and the housing listing phase of the Census is scheduled to be carried out across the country from April 1 to September 30.

Last week, the home ministry had said the preparation for the Census 2021 and updation of the NPR were at its peak and they will begin from April 1.

The ministry said this after a conference of the Directors of the Census Operations on status of preparatory work around Census 2021 and NPR updation.

There has been opposition from several state governments to the NPR and some of the assemblies even adopted resolutions expressing reservations on the exercise.

The states which have been opposing the NPR include Kerala, West Bengal, Punjab, Rajasthan, Chhattisgarh and Bihar.

However, most of them also said they will cooperate with the house listing phase of the Census.

The objective of the NPR is to create a comprehensive identity database of every usual resident in the country.

The database would contain demographic as well as biometric particulars, they said.

The notification for the house listing census and NPR exercise came recently amid furore over the contentious Citizenship Amendment Act (CAA).

The home ministry officials said most of the states have notified provisions related to the NPR.

The NPR is a register of usual residents of the country. It is being prepared at the local (village/sub-town), subdistrict, district, state and national levels under provisions of the Citizenship Act, 1955 and the Citizenship (Registration of Citizens and Issue of National Identity Cards) Rules, 2003.

The data for NPR was last collected in 2010 along with the house listing phase of the Census 2011. Updating of this data was done during 2015 by conducting door to door survey.

While updating the register in 2015, the government has asked details like Aadhaar and their mobile number.

This time, the information related to their driving licence and voter ID card may also be gathered, the officials said, adding that PAN card details will not be collected as part of this exercise.

Though information regarding the place of birth of parents will be sought, it is up to the residents whether to respond the question as it is voluntary.

For the purposes of the NPR, a 'resident' is defined as a person who has lived in a local area for the past six months or more, or a person who intends to reside in that area for the next six months.

The law compulsorily seeks to register every citizen of India and issue a national identity card.

The demographic details of every individual are required for every usual resident: name, relationship to head of household, father's name, mother's name, spouse's name (if married), sex, date of birth, marital status, place of birth, nationality (as declared), present address of usual residence, duration of stay at present address, permanent residential address, occupation, educational qualification.

The Union Cabinet has approved Rs 3,941.35 crore for the NPR exercise.
