Mumbai evidence not admissible in its court: Pak tells India

Islamabad, August 1: The Pakistan government has formally informed India that evidence provided by New Delhi in the 2008 Mumbai terror attacks case is not admissible in a Pakistani court as defence lawyers were not allowed to cross-examine Indian officials, a media report said today.

Pakistan's Interior Ministry has informed the Indian government that the evidence is not admissible in the trial of seven Pakistani suspects, including Lashkar-e-Taiba commander Zakiur Rehman Lakhvi, since defence lawyers were not allowed to cross-examine Indian officials when a Pakistani judicial commission visited Mumbai in March. In a letter sent to the Indian government yesterday, the Interior Ministry cited the ruling of a Rawalpindi-based anti-terrorism court and said cross-examination of key Indian officials is needed to make the evidence admissible in Pakistan, The Express Tribune reported.

During a hearing on July 28, the anti-terrorism court did not record the statement of two Pakistani investigators who were scheduled to testify about the evidence provided by India. The judge ruled that since the evidence gathered by the Pakistani judicial commission in India had not been made part of the case, the testimony regarding the Indian evidence too should not be recorded.

The evidence provided by the Indian authorities includes the confessional statement of Ajmal Kasab, the lone surviving terrorist, a CD with intercepts of conversations between the attackers in Mumbai and their handlers in Pakistan, autopsy and medical reports of the dead and injured and the statements of four Indian officials.

The Pakistani judicial commission had interviewed these four officials during the visit the Mumbai. However, no cross-examination was allowed under an agreement between India and Pakistan.

Sources privy to the investigations by the Federal Investigation Agency told The Express Tribune that the Interior Ministry had made it clear to India that the evidence would not have any legal value in Pakistan if the Indian officials could not be cross-examined by lawyers representing the seven accused facing trial in Pakistan.

On July 17, the judge of the anti-terrorism court accepted Lakhvi's plea and declared the findings of the judicial commission "null and void". The accused had challenged the legal value of the report of the judicial commission as their lawyers were not allowed to cross-examine Indian officials who provided evidence against them.

The seven suspects have been charged with planning, financing and executing the terror attacks in Mumbai that killed 166 people in November 2008.

Their trial has been hit by countless delays and the judge has been changed five times.

New Delhi, Jun 1: The Directorate General of Civil Aviation (DGCA) on Monday asked airlines to allot seats in flights in such a manner that middle seats are kept vacant to the extent possible.

However, if a flyer has been allotted the middle seat due to a high passenger load "then additional protective equipment like the wrap-around gown of the Ministry of Textile approved standards" must be provided to that passenger in addition to three-layered face mask and face shield, said the DGCA order, which has been accessed by news agency.

India resumed its domestic passenger flights from May 25 after a gap of two months due to the coronavirus-triggered lockdown. International commercial passenger flights continue to remain suspended in the country.

New Delhi, Feb 8: Arvind Kejriwal is set to return as Delhi chief minister and his Aam Aadmi Party (AAP) will virtually sweep the assembly elections, exit polls predicted Saturday.

As polling came to a close at 6 pm, with the Election Commission of India (ECI) projecting a voter turnout at 60.24% (as of 9:50 pm), a poll of polls covering 10 exit polls gave 52 seats to AAP, 17 to the Bharatiya Janata Party and one to the Indian National Congress.

The polls, which are sample surveys conducted among voters exiting polling booths, signalled that the Delhi voter responded to AAP’s campaign that focused on “kaam”, or getting work done.

Kejriwal, a former civil servant and activist who stormed into electoral politics with an anti-corruption campaign in 2013, led a campaign focusing on the development work his government did in Delhi, especially in education and healthcare, as well as sops such as lower electricity bills and free bus rides for women.

The exit polls gave AAP between 47 and 68 seats in the 70-member Assembly.

They predicted an absolute rout for Congress, which ruled Delhi for three terms between 1998 and 2013. The maximum seats to AAP were given by India Today TV-Axis exit poll, which predicted 59-68 seats for the party, while giving 2-11 for the BJP and none to the Congress.

If these figures hold, the results will come as a disappointment for the BJP, which had hoped its sweep in the Lok Sabha elections in 2019 would reflect in the assembly polls.

Delhi’s voter turnout saw a sharp fall over the 2015 elections. According to the Election Commission of India, voter turnout till 9 pm was projected at 60.24% — lower than 67.12% in 2015.

Traditionally, a lower voter turnout is read as a vote for the incumbent.

The voter turnout in Delhi has been similar during the Congress regime under Sheila Dikshit, when she won consecutive terms. In 2003, when Delhi voted a second time for the Dikshit government, the voter turnout was 53.42%, and a comparable 57.58% was the turnout in 2008.

Later, in two consecutive elections — 2013 and 2015 — voters turned out in big numbers to vote Dikshit out of power. In 2013, 65.63% of Delhi turned out and the percentage increased further to 67.12% in 2015.

Across constituencies, Matia Mahal in Central Delhi registered the highest voter turnout of 68.36%, whereas Bawana assembly constituency in North district saw the lowest turnout at 41.95%. Among districts, North East district registered the highest (62.75%) voter turnout, while the lowest turnout was recorded in South East district (54.15%), according to the ECI app.

New Delhi, Feb 5: Days after a gunman opened fire in Delhi's Shaheen Bagh, the epicentre of anti-CAA movement, YouTuber Gunja Kapoor was detained at the protest site on Wednesday after she was caught covertly filming the protests in a burqa.

Kapoor runs the channel ‘Right Narrative’ on YouTube and her pinned tweet on Twitter says she is followed on the microblogging site by PM Narendra Modi.

According to police, the protesters turned suspicious after Kapoor asked them "too many questions". She was caught by some of the women protesters after they identified her as the popular YouTuber. The incident led to a commotion at Shaheen Bagh, the epicentre of protests against the Citizenship Amendment Act (CAA), a senior police official said.

She was taken to Sarita Vihar police station where her identity was ascertained, police said.

The incident sparked outrage on social media. Many took to Twitter to question why Kapoor was at the protest in disguise. Others expressed concern about her motives at secretly filming the protests.

Meanwhile, praises flew in for the women of Shaheen Bagh who can be seen defending Kapoor from angry protesters after she was caught.

This is not the first time that a right wing social media activist has landed in trouble in Shaheen Bagh where residents and other women and children have been sitting in protest for nearly two months since the passing of the contentious Citizenship Amendment Act 2019 in December last year.

In January, Deepa Sharma had posted videos online about the "traumatic" experience she had when she was allegedly heckled and harassed by Shaheen Bagh protesters. While the woman's claim could never be verified, other pieces of rampant fake news aimed at delegitimising and villainising protesters has taken social media by storm.

From doctored videos of women protesters allegedly accepting they were paid Rs 500 to attend protests to alleged fights over biriyani and anti-India sloganeering, trolls on social media seem to be working overtime to taint the ongoing protests.

The latter, however, show no signs of giving up. In fact, as Delhi nears elections on February 8, protesters have arranged for music performances by eminent artists, including pop celebrity Prateek Kuhad, till February 7.

Sit in protests take place 24x7 with women showing up in thousands to spend the night and sing songs of protest. And with polls around the corner, the protests have become an active part of political discourse with Aam Aadmi Party's Manish Sisodia expressing his support for the protesters at a recent press conference.
