SC shocked over magnitude of Karnataka's illegal mining

New Delhi, August 23: Expressing shock at the magnitude of the alleged illegal export of 35 lakh metric tons (MTs) of iron ore by private firms in Karnataka, the Supreme Court today said it wants to explore the possibility if the guilty could be punished within six months.

A three-judge forest bench headed by Justice Aftab Alam asked the Central Empowered Committee(CEC) to suggest viable alternatives to ensure that those involved in illegal mining are convicted within six months and posted the matter for further hearing on September 7.

"Assuming there is a CBI probe, it will take months or years to complete the probe. They will be examining hundreds of witnesses and placing tons of material. But we want the investigation to be completed within six months.

"Let us have some results. See if these cases can be segregated. So far the charge sheet filed in some cases are under Section 379 (punishment for theft) and 406 (criminal breach of trust) of the IPC. The whole thing seems to be an eye-wash," said the bench, also comprising K S Radhakrishnan and Swatanter Kumar.

The apex court turned furious after senior counsel and amicus curiae Shyam Divan informed it that eight lakh out of the 35 lakh MTs of iron ore were actually seized by the authorities and kept in custody as per the orders of a judicial magistrate, yet the seized consignments were exported out of the country.

Citing the CEC report, Divan termed the loss to the exchequer as "huge and enormous" and the illegal export of the huge consignment as "the rarest of rare" in the annals of the country.

"If the state machinery were working properly without turning a blind eye, all this would not have happened. See the magnitude," the apex court remarked while dealing with NGO Samaj Parivartana Samudaya's PIL on illegal mining and encroachment in the forest areas of the state.

The CEC report of April 27 had recommended CBI probe into the illegal export of the iron ore from the state's Belekere port with the alleged involvement of various business houses.

As the irregularities were huge, the apex court today said to senior counsel Shyam Divan, "As an amicus, we want you to tell us how to speed up the probe. Show us the way." The bench then posted the matter for September 7.

At the last hearing, the apex court had said it would not allow resumption of mining activities of iron ore in Karnataka unless there is a statutory compliance and full implementation of reclamation and rehabilitation measures.

The bench had also asked the CEC to file a comprehensive report detailing the steps taken for the statutory compliance and implementation of R&R measures and the permission needed for the resumption of mining.

The Supreme Court on April 13 had accepted the CEC's recommendations, which had suggested that no new mining leases should be granted in Bellary, Tumkur and Chitradurga districts of Karnataka unless rehabilitation plans for the existing leases were executed.

The bench had also asked the CEC to examine if the works in the category 'A' mines, with the least irregularities in them, could be commenced.

In its earlier report, the CEC had distinguished the mines in the area in three categories as A, B and C.

The mines in which there was least or no irregularities were categorised as 'A' and those with maximum illegalities were put in 'C' category.

Karnataka Iron and Steel Manufacturing Association had also sought immediate steps for opening of 16 iron and ore mines in which the apex court appointed expert panel, central empowered committee (CEC), had found minimum irregularities.

New Delhi, Jun 25: Diesel price in the national capital crossed the Rs 80 per litre-mark for the first time ever on Thursday as oil companies raised prices for the 19th day, taking the cumulative rate to Rs 10.63 a litre.

Petrol price, after a day's hiatus, was hiked by 16 paise and the increase in less than three weeks now totals Rs 8.66 per litre.

Petrol price in Delhi was hiked to Rs 79.92 per litre from Rs 79.76, while diesel rates were increased to Rs 80.02 a litre from Rs 79.88, according to a price notification of state oil marketing companies.

Diesel had for the first time become costlier than petrol in Delhi on Wednesday and has now crossed the Rs 80 per litre-mark.

Rates differ from state to state depending on the incidence of value-added tax (VAT).

However, diesel is costlier than petrol only in the national capital where the state government had raised local sales tax or VAT on the fuel sharply last month. It costs less than petrol in other cities.

The 19th daily increase in rates since oil companies on June 7 restarted revising prices in line with costs after ending an 82-day hiatus in rate revision, has taken diesel prices to fresh highs.

In 19 straight days, diesel price has gone up by Rs 10.63 per litre. Petrol price has been hiked on 18 occasions since June 7 and now totals to Rs 8.66 a litre.

Kanpur, Jul 11: "The Uttar Pradesh administration has done the right thing by taking action against my son," said an old and feeble Ram Kumar Dubey, father of gangster Vikas Dubey.

The father said his son killed eight police officials and it was an unforgivable sin.

"Had he listened to us, his life would not have ended this way. Vikas never helped us in any way. Due to him, even our ancestral property was razed to the ground. He also killed eight policemen, which is an unforgivable sin. The administration has done the right thing. Had they not done so, tomorrow others would have acted similarly," Ram Kumar said.

"It is the chief minister's duty to protect every individual. The police is an extension of that. He attacked them which cannot be forgiven. I will not even take part in his cremation," he added.

Ram Kumar Dubey said that his only appeal to the government is to allow him entry to his ancestral property now.

Vikas Dubey was cremated at Bhairav Ghat in Kanpur. His wife, younger son and brother-in-law were present and no other member of his family attended the last rites.

Vikas Dubey was arrested by the police in Ujjain on Thursday morning. He was on the run for the last six days and had come to the city to offer prayers at a temple, where he was identified by a security guard.

He was killed in an encounter by the Uttar Pradesh Police earlier today after he "attempted to flee".

The gangster was the main accused in the encounter that took place in Bikru village in Chaubeypur area of Kanpur last week, in which a group of assailants opened fire on a police team, which had gone to arrest him.

Eight police personnel were killed in the encounter.

Vikas Dubey managed to escape after the incident. Uttar Pradesh police had launched a hunt and raised a bounty on him for Rs 5 lakh.

New Delhi, Jan 1: In the backdrop of huge losses borne by airlines, Aviation Minister Hardeep Singh Puri has said the government is concerned that more airlines will shut down if predatory pricing continues. "Some predatory pricing is taking place" in airfares, the minister told reporters on Tuesday. Mr Puri however ruled out any plan by the government to regulate airfares. The remarks come amid high competition in the country's aviation sector, struggling against high fuel prices and other operating costs.

"The interesting thing that we have observed is that on Delhi-Mumbai route 20 years ago, the average fare was Rs 5,100. Today, the average fare is Rs 4,600. Some predatory pricing is taking place. It means people are selling tickets below their cost," he said.

"One of our concerns is that if there is predatory pricing, then the airlines will stop functioning. This is not Air India's problem only. Jet Airways got shut down. Before that, it was Kingfisher airline," he said.

IndiGo and SpiceJet - two of the country's biggest airlines - reported losses of Rs 1,062 crore and Rs 463 crore respectively in the second quarter of 2019-20. Other airlines have also reported losses in the quarter that ended on September 30, 2019.

Asked if predatory pricing is the reason for the ill health of the airlines, the minister said, "No, there are many reasons... Predatory pricing is one of the factors. But the profitability of an airline is dependent on (a) number of things."

Asked if the trend of predatory pricing has come down after regular discussion with the airlines, he said, "Yes, absolutely."

"It is (a) constant battle. An ideal situation from an airline's point of view is that they grow and they are also able to charge more fares. What fares they charge is their business. Our advice to them is to charge realistic fares," he added. "It should not be too high. And it is not in your business interests if you are imposing predatory fares."

The minister also said that the government is not planning to regulate fares. "No regulation. It has to be done within deregulation system.... If I put a cap on fare, the airline will start charging that cap only... that cap will become the normal fare... So, within a deregulated structure, we have to bring about an equilibrium," the minister said.

"Government, periodically, at my level or at secretary''s level, we sit down with the main aircraft operators and tell them it is in your interest not to allow such practices which undermine the civil aviation sector."
