45 custodial rapes in nine years, says rights forum

New Delhi, December 27: The Asian Centre for Human Rights (ACHR) has alleged that that at least 45 custodial rapes were reported between 2002 and 2010.

In its submission to the Justice Verma Committee set up in the wake of the gruesome rape on December 16 here, the centre said that at least 45 custodial rapes took place between 2002 and 2010 as per the complaints registered by the National Human Rights Commission (NHRC).

The number of cases registered by the NHRC with the period within brackets: two (2009-2010), four (2008-2009), 18 (2007-2008), 10 (2006-2007), five (2005-2006), four (2004-05), and two (2002-2003). No case was registered in 2003-04.

“These cases are the tip of the iceberg and the law enforcement personnel enjoy virtual immunity as prior sanction is required for their prosecution even in cases of rape as per Section 197 of the Criminal Procedure Code and Section 6 of the Armed Forces Special Powers Act of 1958,” according to Suhas Chakma, Director ACHR.

“The Justice Verma Committee must recommend removal of the requirement of prior sanction for prosecution, suit or other legal proceeding against any offences relating to sexual assault,’’ Mr. Chakma said.

The centre does not have consolidated figures for permission granted for prosecution of those involved in such offences. These are maintained by the States for the police, the Ministries concerned like the Home Ministry for paramilitary forces, and the Defence Ministry for the defence forces.

The ACHR criticised the restrictive Terms of Reference of the Justice Verma Committee which has been asked to suggest possible amendments in the criminal laws to provide for quicker trial and enhanced punishment for criminals accused of committing “sexual assault of extreme nature against women.”

“The Committee should bear in mind that failure of the law to take its own course against sexual assault, which may not necessarily be of extreme nature, ultimately creates the environment in which criminals dare to commit sexual assault of extreme nature. Women in India have been facing unprecedented sexual violence and the Committee must broaden the definition to capture all forms of sexual assault,” Mr. Chakma said.

New Delhi, May 9: Home Minister Amit Shah today tweeted to say he is healthy and not suffering from any disease, dismissing recent rumours on social media about his health. "I want to make it clear that I am completely healthy and do not suffer from any disease," the Home Minister wrote.

The 55-year-old home minister said for the last few days, some people on social media have been spreading rumours about his health. "In fact, many have tweeted even wishing for my death," he said.

Mr Shah said with the country fighting the coronavirus pandemic, that has affected nearly 40,000 people and killed more than 1,900, he did not pay attention to these rumours as he was busy performing his duties as the home minister. He said he was clarifying today because lakhs of BJP workers have expressed concern over the last two days.

The Home Minister, taking a jibe at those spreading rumours, said such speculation about his health will only make him stronger. "I request people to stop indulging in such talks and let me do my work, they should also go about their business," he added.

Amit Shah thanked well-wishers and workers of the BJP for enquiring about his health. He signed off by saying he has no hatred towards those who spread the rumours.

New Delhi, May 31: The income tax department has notified forms for filing income tax returns for the financial year 2019-20.

The Central Board of Direct Taxes (CBDT) has notified Sahaj (ITR-1), Form ITR-2, Form ITR-3, Form Sugam (ITR-4), Form ITR-5, Form ITR-6, Form ITR-7 and Form ITR-V for the assessment year 2020-21.

The department has revised the I-T return forms for the financial year 2019-20 to allow assessees to avail benefits of various timeline extension granted by the government following the COVID-19 outbreak.

The government has extended various timelines under the Income Tax Act, 1961, through the Taxation and Other Laws (Relaxation of Certain Provisions) Ordinance, 2020.

Accordingly, the time for making investment or payments for claiming deduction under Chapter-VIA-B of IT Act that include Section 80C (LIC, PPF, NSC etc.), 80D (Mediclaim) and 80G (Donations) for the financial year 2019-20 had been extended to June 30, 2020.

ClearTax founder and CEO Archit Gupta said, "The new forms require a separate table to disclose tax saving investment made in the first quarter of 2020 for availing them in FY 2019-20. Taxpayers must assess their tax liability for FY 2019-20 and make sure they are maximising their Section 80C benefits if not already done so."

New Delhi, Jun 23: In an unexpected development, the pump price of diesel is all set to surpass the petrol price in the capital, making it the most expensive transport fuel for the first time in a long time.

Globally, diesel is priced slightly above petrol prices due to the very nature of the product that has a higher cost of production. But in India, due to the lopsided taxation structure, diesel attracts lesser of the tax between the two auto fuels keeping its prices lower than petrol for last several years.

Diesel is currently priced at Rs 79.40 a litre in the Capital, just 36 paise short of petrol price that is being retailed at Rs 79.76 a litre. Going by the trend of price movement in the two products for the last few days where diesel prices have consistently increased by 50-60 paise per litre while the daily increase in petrol prices have fallen to just 20 paise on Tuesday, it is set to surpass petrol prices in next few days.

"Diesel price movement is sharper in international market and if oil companies follow the global price trend, diesel prices will surpass that of petrol later this week. It will be after many years that this would happen and is expected to sustain for some time unless government changes the tax structure of the petroleum products again," said an oil sector expert from one of the big four audit and advisory firms asking not to be named.

Interestingly, even in India the base price of diesel is expensive than petrol. According to the Indian Oil Corporation (IOC), while the base price of petrol in Delhi currently comes to Rs 22.11 per litre, the same for diesel is higher at Rs 22.93 per litre (effective from June 16, 2020). This has been the case for a long time, but retail price of petrol can be higher than diesel due to central and state taxes.

What has now brought diesel prices to a whisker of petrol prices in the capital is the Delhi government's decision early May to increase the Value Added Tax on diesel from 16.75 per cent to 30 per cent and on petrol from 27 per cent to 30 per cent. This increased the retail price of diesel and petrol in Delhi by Rs 7.10 and Rs 1.67 a litre respectively. With Central taxes on the two products already reaching identical levels, the Delhi governments move hastened price parity between petrol and diesel.

Currently, the Central excise on petrol is Rs 32.98 a litre while that on diesel it is Rs 31.83 a litre. The VAT on petrol in Delhi is Rs 17.71 a litre and that on diesel is Rs 17.60 a litre.

While the movement of retail pricing is being seen with a sigh of relief by vehicle owners whose cars run on petrol, those buying the relatively expensive diesel cars are now repenting on their decision. The development is also being seen with caution by automobile companies who have spent millions to ramp up their facilities for diesel run vehicles. The expectation is that demand for such cars will now fall, causing more damage to companies where sales are already impacted due to persistent economic slowdown and now the spread of COVID-19 pandemic.

"The pricing development would push automobile companies to strategies being followed by companies in the western markets where diesel run cars are not sold on fuel pricing differential, but on overall make and quality that puts them ahead of petrol run cars," the expert quoted earlier.

Yes, but for commercial vehicle sector the rising price of diesel had not been welcomed. In fact, the commercial transport sector had time an again threatened strike against the move to raise fuel prices.

With petrol and diesel retail prices closing, the case for adultering fuel has also gone down much to the relief of vehicle owners.
