Centre to lower bar for consensual sex to 16 years

New Delhi, Mar 12: The Union Cabinet is set to clear a bill seeking to replace the post-Nirbhaya case ordinance dealing with crime against women which will reduce the age for consensual sex to 16 and reinstate "rape" as an offence specifically committed against women.

The government has resolved differences on the two contentious aspects of the Criminal Law (Amendment) Bill, 2013, bowing to the demands of women's groups who protested against the ordinance's provisions making "sexual assault" a gender neutral crime.

Now, the perpetrator in a crime of rape will be male while the victim female according to the law to be considered by the Cabinet on Tuesday.

Settling divergent views on the age of consent was a more difficult task as the women and child development ministry pointed out that a recent law to protect kids deems anyone below 18 as a minor.

Official sources said there would be no contradiction between the two laws as Supreme Court has said in cases of alleged elopement where the girl has acted in accordance to her free will, the age of consent to be considered is 16.

While the issue is likely to be debated by the Cabinet, the ministry of home affairs has taken the view that criminalizing sex in the 16 to 18 age group is not warranted as it fails to take into account changing sexual mores.

With sexual contact between teens of this age increasingly common in both urban and rural areas and across social strata, it was felt a tough law could be misused to settle scores or allow conservative opinion to harass youngsters.

The law to protect children against sexual abuse deals with incidents where no consent has been obtained and the criminal law amendment bill will not allow offenders a legal loophole, sources said.

The bill could also make rape by those in authority punishable by life sentence extending to the abuser's "natural life". Another likely change is making it mandatory for government and private hospitals to provide free medical assistance to victims of sexual crimes.

Home minister Sushilkumar Shinde on Monday said there were differences on "legal points" which were being addressed to and will be settled by Cabinet.

Asked about the fate of the proposed bill, Shinde said the law ministry had to vet all proposals before the government takes the next step.

Once approved by the Cabinet, the Criminal Law (Amendment) Bill will be introduced in Parliament later this week and would be passed before March 22 when both the Houses adjourn for a month-long recess as is necessary if the ordinance is not to lapse.

The bill will replace the ordinance on criminal law which was promulgated on February 3 in the wake of public outrage over the December 16 gang rape incident.

Chennai, Jul 30: Tamil Nadu government on Thursday extended the Covid-19 lockdown till August 31, giving only a few relaxations like allowing delivery of non-essential goods by e-commerce sites. The ban on public transport has been extended till August 31, while availing of e-pass for inter-district and inter-state travel will continue to be in force.

In a detailed statement, Chief Minister Edappadi K Palaniswami announced a “complete lockdown” during which only essential services would continue to be in force on all Sundays during the month of August across the state.  

In Chennai, restaurants will be allowed to open dine-in facilities at 50 percent of its total capacity from 6 am to 7 pm from August 1, while vegetable shops, grocery outlets and standalone commercial establishments will also be allowed to remain open from 6 am to 7 pm.

E-commerce sites have been allowed to begin delivery of non-essential goods from August 1, while the ban on public transport, temples in urban areas and towns, cinema halls, shopping malls, and gyms would continue till August 31.

It also said companies or factories in Chennai that have been allowed to function with 50 percent of staff can increase their strength to 75 percent from August 1.

The government also asked companies to encourage its employees to work from home and advised commercial establishments to follow the Standard Operating Procedure (SOP) as advised by it. Inter-state or inter-district travel will be allowed only with e-pass, while ban on metro and suburban trains continues.

The decision to extend the lockdown till August 31 comes as Tamil Nadu continues to grapple with an increasing number of coronavirus cases. The prevalence of the virus is no more limited to one city or region of the state with almost all districts reporting fresh cases, some of them over 200 new patients, every day.

On Thursday morning, Tamil Nadu’s Covid-19 tally was 2,34,114 including 1,72,883 discharges and 3,741 deaths. The active cases stood at 57,490.

New Delhi, Jan 31: Substantial competition and low tariff rates by telecom operators since 2016 have led to a financial stress in the sector, the Economic Survey said on Friday.

The data price in the country came down by over 99 per cent during 2016-2019, making it among the lowest tariff in the world, according to the survey.

"Since 2016, the sector has witnessed substantial competition and price cutting by the telecom service providers (TSPs), creating financial stress in the sector. As a result, the sector is experiencing consolidation. While some operators have filed for bankruptcy, others have merged, in their quest to improve viability," the survey report said.

In April-June 2019, the price of data was Rs 7.7 per gigabyte (GB) as compared to Rs 200 per GB in June 2016, it added.

"The Average Revenue Per User (ARPU) for GSM based mobile services has also gone down substantially from Rs 126 in June 2016 to Rs 74.30 in June 2019," the survey said.

The tariff war started in the market with entry of new telecom operator Reliance Jio in September 2016.

"BSNL and MTNL are also affected by the tariff war that has impacted their cash flow resulting in mounting losses," the survey said.

The financial health of the public sector telecom firms plummeted to a level where they have been finding hard to pay employees salaries in time.

The government has drawn up a plan to revive these PSUs which is still in works.

The revival plan consists of several measures, including reduction of staff cost through voluntary retirement scheme, allotment of spectrum for 4G services, monetisation of land and building, tower and fibre assets of BSNL and MTNL, debt restructuring through sovereign guarantee bonds and ''in-principle'' approval for merger of BSNL and MTNL.

The survey said that the wireless telephony now constitutes 98.27 per cent of all subscriptions whereas share of landline telephones now stands at only 1.73 per cent where market share is dominated by private sector players.

"The overall tele-density in India stands at 90.45 per cent, the rural tele-density being 57.35 per cent and urban teledensity being 160.71 per cent at the end of September 2019. The private sector dominates with a share of 88.81 per cent (106.06 crore connections) at the end of September, 2019 while the share of public sector was 11.19 per cent (13.36 crore connections)," the survey said.

The lower price of data has also lead in surge of broadband connections and average consumption of the internet.

Total broadband connections increased by about ten times, from 6.1 crore in 2014 to 59.46 crore in June 2019, the survey said.

The number of internet subscribers (both broadband and narrowband put together) stood at 66.53 crore at the end of June 2019 as compared to 25.16 crore in 2014.

The number of mobile internet subscribers was 64.36 lakh at the end of June 2019 while the number of wireline internet subscribers was 2.17 crore.

"India is now the global leader in monthly data consumption, with average consumption per subscriber per month increasing 157 times from 62 MB in 2014 to 9.8 GB in June 2019. The cost of data has also reduced substantially, enabling affordable internet access for millions of citizens," the survey said.

New Delhi, Mar 31: India is likely to blacklist about 300 foreigners who came from 16 countries, including Malaysia and Thailand, on tourist visas but attended an Islamic congregation at Nizamuddin here that has become a key source for the spread of coronavirus in the country, officials said on Tuesday.

These foreigners were among around 8,000 people who attended the Tabligh-e-Jamaat at Nizamuddin Markaz facility in March, many of whom have shown symptoms of COVID-19, a Union Home Ministry officlal said.

About 30 of those who attended the Nizamuddin event in mid-March tested positive and at least three have succumbed to the infection in last few days.

"Those who came on tourist visa but attended the Nizamuddin event stands being in our blacklist as they have violated the visa conditions. Tourist visa holders can't attend religious function," a Union Home ministry official said.

If a foreigner is put in the Home ministry's blacklist, he or she can't travel to India in future.

A total of 281 foreigners were found by the police at the Nizamuddin campus in the last two days.

They include 19 people from Nepal, 20 people from Malaysia, one from Afghanistan, 33 from Myanmar, one from Algeria, one from Djibouti, 28 from Kyrgystan, 72 from Indonesia, 7 from Thailand, 34 from Sri Lanka, 19 from Bangladesh, three from England, one from Singapore, four from Fiji, one from France and one from Kuwait.

Most of these foreigners came on a tourist visa, an official said.
