New Delhi, Mar 22: Air India Express has been asked by the Delhi State Consumer Commission to pay Rs 88,000 to a passenger for failing to provide him with an alternative after his flight to Dubai was cancelled.

The state commission held the airline liable for the damages, saying that it has to realise the inconvenience a passenger suffers on cancellation of the flight and it is their duty to provide alternative arrangements in such cases.

The commission's observations came while upholding the decision of a district forum here which had allowed the plea of the aggrieved passenger and had directed Air India Express to pay him Rs 88,000, including compensation and the extra amount he had to pay for a ticket on another airline.

"Once tickets have been booked by a consumer for flight, it is the Airlines' duty to provide the requisite transport unless they are inhibited by reasons beyond their control. The Airline has to realise the inconvenience a passenger suffers on cancellation of the flight and it becomes the duty of the airline to provide alternative arrangements which the airline in this case failed to do. Therefore, they had to be held liable for damages and the district consumer forum was justified in the award made by it," a bench presided by Justice Barkat Ali Zaidi said.

The airline in its appeal had challenged the district forum's decision, saying the flight was cancelled due to a technical problem.

The commission, however, dismissed its appeal and said the airline had not elaborated what the technical problem was.

The district forum's order had been passed on a complaint by Delhi resident Sunil Goyal, who had stated that his flight to Dubai from Delhi via Abu Dhabi scheduled to take off on May 22, 2005 was cancelled and claimed no reason was given for the same.

He had also alleged that as no alternative was provided to him by Air India Express, he had to buy a more expensive ticket on another airline.

New Delhi, Jun 13: About 56 per cent of children were found to have no access to smartphones which have emerged as essential tools for online learning during the coronavirus-induced lockdown, according to a new study that surveyed 42,831 students at various school levels.

The study ''Scenario amidst COVID 19 - Onground Situations and Possible Solutions'' was conducted by child rights NGO Smile Foundation with an aim of analysing the access to technology.

The findings of the study showed that 43.99 per cent of surveyed children have access to smartphones and another 43.99 per cent of students have access to basic phones while 12.02 per cent do not have access to either smartphones or basic phones.

A total of 56.01 per cent children were found to have no access to smartphones, the study said.

"Concerning television, it was noted that while 68.99 per cent have access to TV, a major chunk of 31.01 per cent does not. Hence suggesting that using smartphone interventions for enhancing learning outcomes is not the only solution," it said.

At the primary level of education (class 1 to 5) 19,576 children were surveyed while at upper primary level (class 6 to 8) 12,277 children were surveyed. At secondary level of education (class 9 to 10) 5,537 children were surveyed and at higher secondary level (class 11 to 12) 3,216 children were surveyed.

The survey based on which the study was conducted used two approaches - over the telephone wherein the NGO reached out to the children whose database it already had -- students enrolled in various education centres of the NGO -- and second was through community mobilization wherein community workers went door to door to get answers.

The survey was conducted in 23 states, including Delhi, Gujarat, Maharashtra, Karnataka, Tamil Nadu, West Bengal, Andhra Pradesh, Telangana, Uttar Pradesh, Haryana, over a period of 12 days from April 16 to April 28.

The lockdown induced by the COVID-19 pandemic in March prompted schools and colleges to move to the virtual world for teaching and learning activities. However, many experts say the digital divide in the country may turn online classes into an operational nightmare.

As per official statistics, there are over 35 crore students in the country. However, it is not clear as to how many of them have access to digital devices and Internet.

Santanu Mishra, co-founder and executive trustee, Smile Foundation, said the findings clearly show that the digital divide is a real challenge, and multiple approaches need to be implemented to cater to all across the nation.

"As an exercise before we start any programme, we do a baseline study to understand the on-ground challenges so that our programmes can bring in real work and real change. With the onset of the pandemic, following indefinite school closures, it is more important than ever to understand the situation and how can we ensure that children are given quality education. Through this, we understand that customized modules need to be built in accordance with the channel of communication," he said.

New Delhi, Jul 16: The Rajasthan High Court will hear Thursday afternoon a petition filed on behalf of the Sachin Pilot camp, challenging a move to disqualify dissident MLAs from the state assembly.

The plea against the disqualification notices sent from the Speaker’s office to Pilot and 18 other Congress MLAs will be heard by Justice Satish Chandra Sharma.

The 19 MLAs were sent notices Tuesday by the Speaker after the Congress complained that the MLAs had defied a party whip to attend two Congress Legislature Party meetings.

New Delhi, Jul 5: World's largest, 10,000-bed Sardar Patel COVID Care Centre and Hospital (SPCCCH) at Radha Soami Satsang Beas in Chhatarpur area of the national capital has made operational on Sunday.

Inaugurated by Lieutenant Governor of Delhi, Anil Baijal, the facility has been created on an emergency basis by the South Delhi District Administration with support of the Ministry of Home Affairs in a record time of 10 days.
Notably, this coronavirus treatment centre which is set up in Chhatarpur area of the national capital is said to be the "largest" of its kind in the world.

"The Sardar Patel COVID Care Centre and Hospital has been developed to help the citizens of Delhi and NCR who are affected by the coronavirus. Our team of doctors and medical staffs will take care of this facility. Sardar Patel COVID Care Centre and Hospital will have 10 per cent of beds with oxygen facility," the Delhi LG said after the inaugural.
Talking about the facilities at the new coronavirus centre, Baijal further stated, "We have counsellors for mentally traumatised patients. We have a team of good psychiatrists and specialists in medicine."

The facility will function as an isolation centre for mild and asymptomatic COVID positive patients. 10 per cent of the beds will have oxygen facility in case the patient develops severe breathlessness and requires tertiary hospital care, read a statement.

Operationally, the facility has been linked to the Deen Dayal Upadhyay Hospital and Madan Mohan Malviya Hospital. The referral tertiary care hospitals are Lok Nayak Jai Prakash Narayan Hospital and Rajiv Gandhi Super Speciality Hospital.

ITBP will be running the first 2,000 beds with their 170 doctors/specialists and more than 700 nurses and paramedics, the statement added.
Most of the basic infrastructure such as beds, mattresses and linen has been donated by various civil society organisations and non-governmental organisations. 

A recreational centre has been made available to the patients along with a library, board games and skipping ropes. People admitted to the facility will be provided five healthy meals a day along with immunity-boosting chawanprash, juices and hot kadha, the statement added.
