Sexual offenders in office stand to lose salary, job, promotion

August 4, 2013

officeNew Delhi, Aug 4: You could risk losing at least 10% of your salary every month for a year, promotions, withdrawal of privileges and perks or even face termination of service if found guilty of sexually harassing a woman at your workplace. These are part of the new rules under the Sexual Harassment at Workplace (Prevention, Prohibition and Redressal) that was passed by Parliament recently. The rules empower the complaints committee to restrict the perpetrator's entry from the workplace if the guilty happens to be an outsider. The panel can also impose a fine of Rs 500, or 5% of the woman's salary in case of a false or malicious complaint.

These provisions are included in new rules that have been drafted by the ministry of women and child development and sent to the law ministry for their opinion. The provisions are likely to be notified by end-August.

A complaints committee, established under the law, will be empowered to recommend and impose a written apology, censure, withhold promotions, pay hikes or increments, entitlements and privileges, impose termination of service in case where they find a case of sexual harassment. The committee can also revoke, suspend any licence or registration in cases like a doctor or a lawyer's licence.

If the act has been committed by an outsider or a visitor the committee can pass orders to restrict the entry of the perpetrator or forewarn him of criminal and legal action in case of trauma to the victim. The guilty also risks losing a minimum of 10% of his salary every month for a period of a year or in a lump sum. The committee has been given powers to take in to consideration the nature of relationship between the complainant and the accused, the position of the respondent in the hierarchy and the incidents of prior complaint before determining the nature of penalty.

It can also slap a fine of Rs 500 or 5% of the salary of the complainant every month for a year in case of a false or malicious complaint.

The sexual harassment law, which has been in effect from April, is applicable to organized and unorganized workplaces including educational institutions, hospitals, residences (applicable to domestic workers) and provides a mechanism for the implementation of the Vishakha guidelines of 1997. Sexual harassment has been described broadly in the act as any attempt to promise or give preferential treatment, threaten or attempt to give detrimental treatment to an employee, create a work environment that is hostile, offensive or intimidating or humiliate an employee so that it affects her health or safety.

Jammu, Jan 15: Fresh landslides kept the Jammu-Srinagar National Highway shut for the third consecutive day on Wednesday, leaving over 5000 vehicles stranded.

"There were four fresh landslides in Digdol and Panthiyal belts on the highway in Ramban district. The traffic on the highway remained closed for the third day today", a police officer told PTI.

On Monday, heavy rains triggered shooting of stones in Moumpassi, Digdole and Panthiyal areas, forcing a suspension of the traffic, the official said.

Snowfall in Kashmir side of the highway, including Jawahar Tunnel, since Sunday has resulted in blockade of the highway.

"No fresh traffic was allowed from Nagrota in Jammu for Kashmir", he said.

As a result of the blockade of the highway, over 5000 vehicles remained stranded at various places en route from Lakhanpur in Kathua district to Banihal belt of Ramban district and also on the Kashmir side.

New Delhi, May 23: India will try to restart a good percentage of international passenger flights before August, Civil Aviation Minister Hardeep Singh Puri said on Saturday, three days after announcing resumption of domestic flights from May 25.

All scheduled commercial passenger flights have been suspended in India since March 25 when the Modi government imposed a lockdown to contain the novel coronavirus pandemic.

"I am fully hopeful that before August or September, we will try to start a good percentage of international civil aviation operations, if not complete international operations," Puri said during a Facebook live session.

"I can't put a date on it (restarting international flights). But if somebody says can it be done by August or September, my response is why not earlier depending on what is the situation," he said.

Jul 1: Gold prices in India hit an all-time high on Wednesday, tracking a global rally, as surging coronavirus cases in many countries raised the metal's safe-haven appeal.

Local gold futures hit an all-time high of Rs 48,871 ($646.66) per 10 grams in early trade, taking their gains to 25% in 2020 so far. The contract had gained nearly 25% in 2019.

However, this dampened the retail demand for gold in India, the world's second-largest consumer of the precious metal.

"Retail demand is negligible. Buyers are postponing purchases anticipating a correction in prices," said a Mumbai-based bank dealer with a bullion importing bank.

In thin trade, dealers were offering a discount of up to $22 an ounce over official domestic prices on Wednesday afternoon, up from the last week's $18. The domestic price includes a 12.5% import tax and 3% sales tax.

The country's gold imports in May plunged 99% from a year earlier as international air travel was banned and jewellery shops were closed amid a nationwide lockdown to curb the spread of coronavirus.

In overseas market, spot gold firmed near an eight-year peak on Wednesday, as a spike in coronavirus cases in the United and States and many other countries has cast a shadow on hopes for a quicker global economic recovery, driving inflows into safe-haven assets.

According to a latest Reuters tally, the coronavirus has infected more than 10.48 million people worldwide so far.
