Sand mining banned across India; UP, Centre spat over Durga Sakthi Nagpal

New Delhi/Lucknow, Aug 5: The national green tribunal (NGT) on Sunday banned mining or removal of sand from river beds across the country without an environmental clearance amid the uproar over suspension of an IAS officer who had cracked down on sand mafia in Uttar Pradesh. In its order, the Tribunal noted that the loss caused to the state exchequer due to illegal sand mining may run into lakhs of crores of rupees.durga

The order was given on a plea alleging that such activities were going on in UP with the "wilful connivance" of its state machinery.

Widening the ambit of the plea, a bench headed by NGT chairman Justice Swatanter Kumar said its order would be applicable across the nation as the petition raised substantial environmental issues.

Initially, the bench banned illegal sand mining on the beds and banks of rivers Yamuna, Ganga, Hindon, Chambal, Gomti, among others, but later modified its order saying the issue of illegally removing sand has nationwide implications. The bench said the clearance has to be obtained from the ministry of environment and forests (MoEF) or state environment impact assessment authority (SEIAA).

"We restrain any person, company, authority to carry out any mining activity or removal of sand, from river beds anywhere in the country without obtaining environmental clearance from MoEF/SEIAA and license from the competent authorities," the bench said while issuing notices to all respondents seeking their response by August 14. The tribunal also directed all the mining officers and police officers concerned of all the states to ensure compliance of its orders, on the plea filed by the National Green Tribunal Bar Association.

The petition alleged that those who have opposed such sand mining, including field level officers, like suspended SDM Durga Sakhti Nagpal, have been victimized which is also apparent from various news reports.

Nagpal, the 28-year-old SDM of Gautam Budh Nagar who led the crackdown on sand mining mafia in her district, was suspended on July 27 ostensibly for ordering demolition of a wall of a under-construction mosque allegedly without following the due process. Nagpal, who belongs to the UP cadre, was chargesheeted yesterday.

Senior advocate Raj Panjwani assisted by advocate Ritwick Dutta, appearing for the association, contended that "rampant" illegal mining and transport of lakhs of tonnes of sand is being carried on every year and is causing a loss of lakhs of crores of rupees to the state exchequer.

Meanwhile, a defiant Samajwadi Party (SP) appeared heading for a confrontation with the Centre over the IAS officer's suspension issue, asserting that UP government's decision is "correct and final" and went a step further taunting it to remove all IAS officers from the state.

Firing the first salvo, SP supremo Mulayam Singh Yadav said the decision to suspend IAS officer Durga Sakthi Nagpal, who hit the spotlight for cracking down on the sand mafia, is justified.

"It is correct. It is final," he told reporters outside Parliament with a firm "no" on being asked whether the suspension order would be revoked.

Amid the brewing hostility between the SP and the Centre over the suspension issue, Prime Minister Manmohan Singh said government is in touch with the state authorities on the issue and that laid down rules will be followed.

The unrelenting stand of the ruling SP government was also voiced in Lucknow by Chief Minister Akhjilesh Yadav who made it clear that officials who make "mistakes" will be punished.

"There might be many children (sitting here) who I can say would have received a beating from their teachers and parents when they had done something wrong ... the government is also run like this, whenever any official does something wrong he is punished", Akhilesh, who has justified the suspension of Nagpal, a 2010-batch officer, said at a function.

In Delhi, SP leader Ram Gopal Yadav struck a defiant note. "If the Centre wants to intervene, it can remove all the IAS officers from Uttar Pradesh. We will run the state with our own officers," he said.

Minister of state for personnel V Narayanasamy said that under the rules, the suspended officer has the right to appeal.

"She has not approached us so far. But if she sends her appeal to us, we will send its copy to the state government and seek its response. Then we will decide the future course of action. Normally, an officer approaches the state government ... We cannot act suo moto," he said.

Thiruvananthapuram, Feb 21: Hindu temples, dedicated to Lord Shiva, witnessed heavy rush on Friday as devotees celebrated Maha Shivratri festival with traditional zeal and religious fervour across Kerala.

Cutting across age barriers, devotees, including women and children, thronged small and big shrines since early morning to offer prayers and take part in special poojas and rituals on the occasion.

Devotees used to mark the auspicious occasion by observing 'orikkal' (fasting), dedicating the leaves of Koovalam plant, which is considered holy according to Hindu tradition, to the Lord and by abandoning their sleep chanting 'Om Nama Shivaya' mantras.

Ardent devotees even remain awake throughout the night and spend their whole day in temples.

The Sreekandeswaram Mahadeva Temple here, Vadakkunnathan temple in Thrissur and Maha Deva temple in Vaikom were among the major shrines which witnessed heavy rush since early morning.

Temple authorities, especially Devaswom Boards which manage many major shrines in the state, have made elaborate arrangements in Shiva temples to ensure smooth darshan for devotees.

All arrangements have been put in place on the banks of River Periyar in Aluva in Ernakulam for 'Balitharppanam', a ritual in which people pay obeisance to their ancestors.

Performing the ritual on the midnight of Shivratri is considered auspicious by devotees.

Hundreds of 'bali taras' (specially erected platforms) have been set up on the banks of the river to perform the ritual and a large number of priests have been deployed to assist devotees.

Thousands of police personnel were deployed in view of the large turnout of devotees.

Mumbai, Jan 12: Thousands of citizens on Sunday congregated in Mumbai's suburban Jogeshwari to oppose the new citizenship law, the proposed NRC and NPR.

They also condemned last Sunday's violence on the JNU campus in Delhi, where masked men ran riot and attacked students. Leftist organisations had claimed RSS-affiliated ABVP's role in the attack, a charge denied by the students' body.

Former Tata Institute of Social Science (TISS) general secretary Fahad Ahmed told PTI that they assembled under the aegis of 'Hum Bharat Ke Log' in Millat Nagar area.

"Prime minister Narendra Modi should call 56 students from across the country to debate on the CAA, NRC and NPR," Ahmed said in an apparent jibe at Modi's "56 inch chest" remark, which the latter had made ahead of the 2014 Lok Sabha polls.

"Why the PM is not talking to us? Why is he not communicating? Even the Britishers used to talk to Indians whom they ruled, but our PM is not talking to poor people," he alleged.

Bollywood actor Sushasht Singh also spoke on the occasion.

"We are people of this country and such acts (CAA) are tarnishing the image of our country," he said.

At the gathering, people waved banners with slogans like "I Am From Gujarat, My Documents Burned in 2002", "No CAA, Boycott NRC, Stop Dividing India, Don't Divide us", "Save Constitution", written on them.

A large number of police personnel were present at the venue.

The Citizenship Amendment Act (CAA), which was notified on January 10, grants Indian citizenship to non-Muslim minorities migrated to India from Afghanistan, Pakistan and Bangladesh till December 31, 2014, following persecution over their faith.

Massive protests were witnessed against the CAA, mainly by the student community, since its passage by Parliament in December last year.

Opposition parties have been dubbing the CAA an "anti-Muslim" legislation, a charge being debunked by the government.

The Congress and other parties like the TMC have also opposed the proposed National Register of Citizens (NRC) and the National Population Register (NPR).

Union home minister Amit Shah has said that the government won't rest until persecuted refugees are granted Indian citizenship.

New Delhi, Jun 23: In an unexpected development, the pump price of diesel is all set to surpass the petrol price in the capital, making it the most expensive transport fuel for the first time in a long time.

Globally, diesel is priced slightly above petrol prices due to the very nature of the product that has a higher cost of production. But in India, due to the lopsided taxation structure, diesel attracts lesser of the tax between the two auto fuels keeping its prices lower than petrol for last several years.

Diesel is currently priced at Rs 79.40 a litre in the Capital, just 36 paise short of petrol price that is being retailed at Rs 79.76 a litre. Going by the trend of price movement in the two products for the last few days where diesel prices have consistently increased by 50-60 paise per litre while the daily increase in petrol prices have fallen to just 20 paise on Tuesday, it is set to surpass petrol prices in next few days.

"Diesel price movement is sharper in international market and if oil companies follow the global price trend, diesel prices will surpass that of petrol later this week. It will be after many years that this would happen and is expected to sustain for some time unless government changes the tax structure of the petroleum products again," said an oil sector expert from one of the big four audit and advisory firms asking not to be named.

Interestingly, even in India the base price of diesel is expensive than petrol. According to the Indian Oil Corporation (IOC), while the base price of petrol in Delhi currently comes to Rs 22.11 per litre, the same for diesel is higher at Rs 22.93 per litre (effective from June 16, 2020). This has been the case for a long time, but retail price of petrol can be higher than diesel due to central and state taxes.

What has now brought diesel prices to a whisker of petrol prices in the capital is the Delhi government's decision early May to increase the Value Added Tax on diesel from 16.75 per cent to 30 per cent and on petrol from 27 per cent to 30 per cent. This increased the retail price of diesel and petrol in Delhi by Rs 7.10 and Rs 1.67 a litre respectively. With Central taxes on the two products already reaching identical levels, the Delhi governments move hastened price parity between petrol and diesel.

Currently, the Central excise on petrol is Rs 32.98 a litre while that on diesel it is Rs 31.83 a litre. The VAT on petrol in Delhi is Rs 17.71 a litre and that on diesel is Rs 17.60 a litre.

While the movement of retail pricing is being seen with a sigh of relief by vehicle owners whose cars run on petrol, those buying the relatively expensive diesel cars are now repenting on their decision. The development is also being seen with caution by automobile companies who have spent millions to ramp up their facilities for diesel run vehicles. The expectation is that demand for such cars will now fall, causing more damage to companies where sales are already impacted due to persistent economic slowdown and now the spread of COVID-19 pandemic.

"The pricing development would push automobile companies to strategies being followed by companies in the western markets where diesel run cars are not sold on fuel pricing differential, but on overall make and quality that puts them ahead of petrol run cars," the expert quoted earlier.

Yes, but for commercial vehicle sector the rising price of diesel had not been welcomed. In fact, the commercial transport sector had time an again threatened strike against the move to raise fuel prices.

With petrol and diesel retail prices closing, the case for adultering fuel has also gone down much to the relief of vehicle owners.
