Delhi gangrape case sentencing on Friday

New Delhi, Sep 11: A fast track court, which has convicted four persons in the December 16 gangrape-cum-murder case, on Wednesday fixed September 13 for pronouncing the quantum of sentence to be awarded to them.delhi-gangrape-accused-faces

Additional Sessions Judge Yogesh Khanna reserved the order on punishment after hearing arguments of the prosecution, which sought death penalty for the four, and the defence lawyers.

The Delhi Police sought death penalty for the four for brutally gangraping and murdering a defenceless 23-year-old girl in a cold blooded manner.

Advancing arguments on quantum of sentence, Special Public Prosecutor Dayan Krishnan said the death sentence should be awarded to the four convicts -- Mukesh (26), Vinay Sharma (20), Pawan Gupta (19) and Akshay Thakur (28) -- as the case falls in the category of “rarest of rare” cases.

The defence lawyers, however, sought a lenient punishment for the convicts, saying life imprisonment in such a case is a rule while death penalty is an exception.

During the arguments, the prosecutor told the court that the convicts do not deserve any mercy, as they killed the helpless girl who kept on pleading for mercy.

“The crime is not only grotesque and diabolic in nature but the barbaric behaviour of the convicts was of the highest kind. Maximum sentence has to be given as the court should see that they have raped and killed a helpless girl, even as she pleaded for her life,” he said.

He said people at large are watching this case and if the convicts are awarded a lighter punishment, the public will lose faith in the judicial system.

“This is an extreme case of depravity and sexual assault of a young girl, who could not survive after their gruesome attack and gangrape.

“The act to damage the girl’s intestines intentionally leaves no scope of sympathy,” the prosecutor argued.

The prosecutor said as per an apex court judgement when there is murder after gangrape, the sentence should be death penalty.

At the start of arguments on point of sentence, convict Mukesh moved an application seeking issuance of contempt notice against Home Minister Sushil Kumar Shinde for his reported statement that death is assured for the four convicts in the case

The court, while convicting the four men on Tuesday, had said that the crime was committed in a “premeditated manner".

The court convicted them for 13 offences including gangrape, murder, unnatural offences, attempt to murder, dacoity, destruction of evidence, conspiracy, kidnapping or abducting in order to murder, while acquitting them of the charge of murder in dacoity.

In the 237-page judgement, which had come six days short of nine months of the incident that shook the nation’s conscience, also found complicity of main accused Ram Singh, who was found dead in Tihar jail during the trial.

On August 31, the juvenile accused was convicted and sentenced to a maximum of three years in a reformation home.

On the night of December 16, last year, Ram Singh, Vinay, Akshay, Pawan, Mukesh and the juvenile had gangraped the girl in a bus after luring her and her 28-year-old male friend, who was also assaulted, on board the vehicle, which was later found to be plying illegally on Delhi roads.

The limbs of the victim’s friend, a software engineer, were fractured in the incident. The girl succumbed to her injuries on December 29, 2012 at a Singapore hospital.

Bhopal, Jul 7: Anil Mishra, personal assistant to BJP Rajya Sabha MP Jyotiraditya Scindia, has tested positive.

He has been accompanying Scindia throughout his tours post-corona infection.

His contact trail is longer than that of Scindia. He has been in touch with Chief Minister Shivraj Singh Chouhan.

Mishra was present during Scindia's meetings with the MLAs and the swearing in ceremony of the MP ministry on July 2.

BJP sources say there is concern over the possible list of people who will be put in isolation to check the spread of the virus.

Mumbai, Mar 27: The RBI on Friday put on hold EMI payments on all term loans for three months and cut interest rate by steepest in more than 11 years as it joined the government effort to rescue a slowing economy that has now got caught in coronavirus whirlwind.

The Reserve Bank of India (RBI) cut repo to 4.4 per cent, the lowest in at least 15 years. Also, it reduced the cash reserve ratio maintained by the banks for the first time in over seven years. CRR for all banks was cut by 100 basis points to release Rs 1.37 lakh crore across banking system.

The reverse repo rate was cut by 90 bps to 4 per cent, creating an asymmetrical corridor.

RBI Governor Shaktikanta Das predicted a big global recession and said India will not be immune.

It all depends how India responds to the situation, he said.

Global slowdown could make things difficult for India too, despite some help from falling crude prices, Das said, adding food prices may soften even further on record crop production.

Aggregate demand may weaken and ease core inflation further, he noted.

The liquidity measures announced include auction of targeted long-term repo operation of 3 year tenor for total amount of Rs 1 lakh crore at floating rate and accommodation under Marginal Standing Facility to be increased from 2 per cent to 3 per cent of Statutory Liquidity Ratio (SLR) with immediate effect till June 30.

Combined, these three measures will make available a total Rs 3,74,000 crore to the country's financial system.

After cutting policy rates five times in 2019, the RBI had been on a pause since December in view of high inflation.

The measures announced come a day after the government unveiled a Rs 1.7 lakh crore package of free foodgrains and cash doles to the poor to deal with the economic impact of the unprecedented 21-day nationwide lockdown.

While the Monetary Policy Committee (MPC) of the RBI originally was slated to meet in the first week of April, it was advanced by a week to meet the challenge of coronavirus.

New Delhi, Feb 12: The Centre on Wednesday said the NRC data in Assam is safe even though some technical issues were visible and that will be resolved soon.

The Union Home Ministry clarification came in view of reports that data of the final list of the National Register of Citizens has been made offline from its official website.

"The NRC data is safe. Some technical issues are in visibility on cloud. These are being resolved soon," a home ministry spokesperson said.

The data was not available for a couple of days and it created panic in the public, mostly among the people excluded from the list as the rejection certificates were yet to be issued.

NRC State Coordinator Hitesh Dev Sarma accepted that the data has been made offline, but refuted the allegation of any "malafide" intent in it.

The cloud service for the huge set of data was provided by IT firm Wipro and their contract was till October 19 last year. However, this was not renewed by the previous coordinator.

So, the data got offline from December 15 after it was suspended by Wipro, Sarma said.

He said the state coordination committee had decided to do necessary formalities in its meeting on January 30 and wrote to the Wipro during the first week of February.

"Once Wipro makes the data live, it will be available for public. We hope people will be able to access it in the next 2-3 days," Sarma said.

The complete detail of exclusion and inclusion of bonafide Indian citizens in the NRC was uploaded on its official website http://www.nrcassam.nic.in after the final list was published on August 31, 2019.

The final NRC was published by excluding 19,06,657 persons. A total of 3,11,21,004 names were included out of 3,30,27,661 applicants.

After the earlier NRC State Coordinator Prateek Hajela relinquished the charge on November 11 following his transfer to home state Madhya Pradesh on a direction from the Supreme Court, Sarma was appointed in his place on November 9.
