First conviction after SC verdict, Rasheed Masood set to lose MP seat

New Delhi, Sep 19: In the first conviction after the Supreme Court struck down a law that provided immunity to MPs and MLAs from immediate disqualification, a Special CBI court today held Rajya Sabha member Rasheed Masood guilty in a case of corruption and other offences and he is set to lose his seat. rasheed

Masood, Minister of Health in the VP Singh government between 1990 and 1991, was held guilty of fraudulently nominating undeserving candidates to MBBS seats allotted to Tripura in medical colleges across the country from the central pool.

Special CBI Judge J P S Malik held Masood guilty of offences under the Prevention of Corruption Act and IPC Sections 120-B (criminal conspiracy), 420 (cheating) and 468 (forgery). He has, however, been acquitted of the charge under Section 471 IPC (using as genuine a forged document).

Masood's conviction is the first case after the July 10 Supreme Court judgement that struck down sub-section 4 of Section 8 of Representation of the People Act, under which incumbent MPs and MLAs can avoid disqualification till pendency of the appeal against conviction in a higher court. The appeal has to be made within three months of the conviction.

Congress member in Rajya Sabha and a party Working Committee member, Masood is all set to be disqualified under the provisions of RP Act that disqualifies anybody who has been convicted under sections of various laws including the Prevention of Corruption Act, 1988.

The quantum of punishment on Masood will be pronounced on October 1. The provisions under which Masood has been convicted attract imprisonment upto seven years.

66-year-old Masood has been held guilty on same counts in two other similar cases.

The three cases in which the Congress leader has been convicted form part of the eleven similar cases registered by CBI in 1996.

Besides Masood, the court has convicted on similar counts former top bureaucrats Gurdial Singh and retired IAS official Amal Kumar Roy, the then secretary of Tripura Chief Minister Sudhir Ranjan Majumdar, in six and five similar cases respectively.

Nine students who had fradulently got admission in the medical colleges have also been convicted for cheating. Two of them, including Masood's nephew, were juvenile at the time of the offence and their case had been transferred to the juvenile justice board on January 25, 2007.

The then Chief Minister of Tripura Sudhir Ranjan Majumdar and then health minister of the state, Kashi Ram Reang were also accused in the case. They passed away pending trial.

Masood had between 1989-91 illegally and fraudulently, in conspiracy with the then resident commissioner of Tripura, Gurdial Singh, nominated his nephew (who was a juvenile at the time of the offence), one other (also a juvenile) and Sachidanand Dwivedi to seats allocated from central pool for students of Tripura.

Sachidanand, one of the three students who secured admission in medical college through Masood, has also been held guilty for conspiracy, cheating, forgery for purpose of cheating, and also under the provisions of PC Act.

He was, however, acquitted of section 471 IPC (using as genuine a forged document).

In its charge sheets against Masood and others, the CBI had said that Tripura does not have any medical college of its own.

"Consequently some MBBS and BDS seats are allocated every year from central Pool by the Ministry of Health & Family Welfare, Government of India in various medical colleges across the country like Bhagalpur medical college, Bihar, Patliputra college (Dhanbad) and Gwalior Medical College (MP) etc," CBI counsel V N Ojha had told the court.

These seats are made available to Tripura for allotment to eligible students from the state on the basis of merit and only those students are eligible for taking the examination who are permanent residents of the state or whose parents have been residing there or are employees of Tripura government.

New Delhi, Feb 11: With Election Commission">Election Commission's trends indicating a landslide victory for the Aam Aadmi Party (AAP), party chief Arvind Kejriwal expressed his gratitude towards the people of the national capital and said that this is the victory of the people who consider him as their son.

Making his first public appearance after the day's results, Kejriwal made a brief address to supporters in which, AAP chief thanked supporters, outlined his personal connection with citizens and party workers as well as credited his family for their continued support.

"I thank people of Delhi for reposing their faith in AAP for the third time. This is not my personal victory, this is the victory of Delhiites. This the victory of the people who consider me as their son and voted for us," Kejriwal said at party office here.

He also referred to the trends of the assembly polls, as the beginning of a new kind of politics.

"This is the beginning of a new kind of politics. This is a new sign. Only the party will get vote who will built mohalla clinics and good schools... This is the victory of mother India and India. Today is Tuesday, Hanuman-ji's day. Hanumanji ji blessed Delhi today, I thank him. We pray that Hanuman Ji keeps showing the right path to us so that we continue to serve people for the next five years," he said.

According to Election Commission", AAP won 5 seats while the party is leading on 58 seats in 70-member Delhi Assembly.

Feb 4: Amid the agitations against Citizenship Amendment Act, National register of Citizens and National Population Registration across the country, Prime Minister Narendra Modi on Monday said that there is a "political design" behind all these protests including in Delhi's Jamia and Shaheen Bagh to ruin the harmony of the nation.

"Be it Seelampur, Jamia or Shaheen Bagh, protests held over the past several days regarding the Citizenship Amendment Bill. Is this just a coincidence? No. This is an experiment," said Prime Minister Narendra Modi in his first election rally for Delhi polls at Karkardooma.

"There is a political design behind all these protests including Jamia and Shaheen Bagh. These protests are a conspiracy to divide India. These protests are going to ruin the harmony of the nation," he asserted.

Lambasting the opposition parties including Congress and Aam Aadmi Party for supporting the ongoing protests, he said: "But AAP and Congress are provoking people. Constitution and tricolor are being kept in front and attention is being diverted from the real conspiracy."

"These people were doubting the ability of our forces during surgical strikes. Do citizens of Delhi want such people in power? These people are saving those who want to break India into pieces," he added.

People have been protesting at Jamia and Shaheen Bagh against CAA, NRC and NPR. Members of the Opposition have deemed CAA "discriminatory and anti-Constitution" while the Centre has maintained that the new law has no effect on Indian citizens.

Recently, two firing incidents took place near Jamia Millia Islamia University.On Sunday night, the firing incident was reported near gate number five at the university following which people including some students of the varsity gathered outside the Jamia Nagar police station. They returned from the Jamia Nagar police station after their complaint was registered.

Earlier, a student sustained injuries after a young man fired at the protestors near Jamia.

Once again incorrect statement and only to divert people attention.  Every one knows who is ruining image of our nation.   this govt has completely failed in all aspects and trying to survive by misguiding the citizens.  Economy is reaching zero and GDP is coming down day by day, Banks and industries on getting closed. youths are unemployed due to no chance.   However, Govt is giving false statement that nothing to worry and our economy if growing.   this govt has brought black bills of CAA and MPR only to divide the society and keep them engaged and forget the falling economy.   If this situation continues, our nation will be one of the poorest countries in the world.   This govt is trying to sell all Govt hold units like Railway, Insurance, etc to private companies only to help the industrialists and to get commission from them.    LIC was running in profit till 4 to 5 years back, but now its running in loss.   Huge amount of money from LIC is taken by Govt to hide the downfall of economy.   Only God can save our country from the hands of present looters + decoits.

New Delhi, Jan 7: A fringe right-wing group calling itself the Hindu Raksha Dal has purportedly taken responsibility for the attack on students of Jawaharlal Nehru University (JNU) in a video posted on social media.

The video, which was posted on social media on Monday and has gone viral since then, shows a man identifying himself as Pinki Chaudhary saying that those who resort  to “anti-national activities” will be treated in the same way that JNU students and faculty were.

He later told news channels that others involved in "anti-national activities" would face similar attacks.

There was no immediate reaction from the police on Chaudhury's claims.

“For several years, JNU has been a bastion of communists and we will not tolerate it. Hindu Raksha Dal, Bhupendra Tomar, Pinki Chaudhury take the responsibility of what has happened in JNU...all of them were our volunteers. Those who cannot do such work for Mother India don't have the right to live in this country,” Chaudhary is seen saying in the video.

“We are always ready to sacrifice our lives for Mother India. We will not tolerate anyone who speaks against the religion,” he added.

Efforts to reach the man were unsuccessful: his phone was switched off.

More than 35 students were injured Sunday when a masked mob went on the rampage, attacking students and professors and vandalising property. The JNUSU has accused the RSS-affiliated ABVP volunteers of attacking the students.
