Coalgate: Ex-top bureaucrats back Parakh's accusation on PM

P_C_ParakhNew Delhi, Oct 17: Former top bureaucrats have come out in support of ex-Coal Secretary P C Parakh, who has been named by CBI in the coal blocks allocation scam, warning that harassment of honest officers will erode Government's credibility and stop senior officers from taking decisions.

"Parakh, as I have known him, is an honest, competent officer. While I do not wish to comment on the CBI investigation as such, as I do not have all the facts, I am at a loss to understand how an FIR has been filed only against him and no one in the PMO and no Minister," said E A S Sarma, former Coal Secretary.

If it is a case of conspiracy, all the conspirators should be taken into account. I hope there is no conspiracy!, said Sarma, a former IAS officer.

"I feel that investigations in such cases should be objective and uninfluenced by extraneous pressures. A clear distinction must be made between decisions taken in good faith and malafide decisions. It is unfortunate that dishonest Ministers, politicians and officers should be let off and honest officers harassed. It will only erode the credibility of the government which has already been on the decline in the recent times," he said.

Sarma said he has written to CVC on June 15 last year requesting it to initiate an investigation into the role of the PMO in the coalgate affair and three other scams.

"I reminded CVC at least two times after that. There has been no visible response from CVC on my letters," Sarma said.

Former Cabinet Secretary T S R Subramanian said such kind of action by CBI against Parakh will stop others from taking decisions.

"There are all kind of bureaucrats, good, bad, honest... There has to be a reasonable basis for any action by the agency," he said.

"According to the FIR, it was said Parakh met Kumar Mangalam Birla. As Cabinet Secretary, I used to meet ten bureaucrats, ten politicians and ten

businessmen daily. Should that mean that I be also made an accused?" he asked.

Parakh wanted the system to be changed for good, rued Subramanian. The former Cabinet Secretary also felt that there was an "ulterior motive" behind the move to name Parakh as an accused.

"If he has been made an accused, he could be crippled as a witness. There could be an ulterior motive," he said.

Former Central Vigilance Commissioner N Vittal accused CBI of not following its charter. "It is utterly unfair and incompetent on part of CBI (to name Parakh). They are not following their charter. I condemn CBI's action," he said.

"I have known Parakh. He is an honest person and has a good reputation," Vittal said.

The former CVC said going by CBI's logic as a minister in charge of coal ministry, Prime Minister should be held responsible for taking any decision on the matter.

Former IAS officer G Sundaram also condemned CBI's action. "I do not know him (Parakh). People who know him say he is an honest officer. But going by the charges, Prime Minister and senior officials in the PMO should also be named as the final decision was taken by them only," he said.

CBI has registered a case against Parakh and industrialist Kumar Mangalam Birla on charges of criminal conspiracy and corruption in connection with alleged irregularities in the allocation of two coal blocks in Odisha in 2005.

Parakh has dubbed as "baseless" allegations levelled against him by the CBI.

"There is absolutely nothing wrong with the decision. It was a very fair and correct decision that we took. I don't know why CBI thought that there is a conspiracy," Parakh has said.

"But, if there is a conspiracy, then there are different members in this conspiracy. There is K M Birla who made the representation, he is one conspirator. I, who examined the case and made a recommendation, I can be another conspirator and the Prime Minister, who as the Coal Minister, took the final decision, is the third conspirator.

"So, if the CBI thinks there is a conspiracy, why did they choose and select Mr Birla and me and not the PM. If conspiracy is there, then everyone is part of the conspiracy," he contended.

Jun 20: Congress leader Rahul Gandhi on Saturday attacked Prime Minister Narendra Modi over his remark that neither is anyone inside India's territory nor has any of its posts been captured, alleging that the PM has "surrendered" Indian territory to Chinese aggression.

In a statement on the all-party meeting called by Modi on Friday to discuss the situation at the India-China border, the government said, "At the outset, prime minister clarified that neither is anyone inside our territory nor is any of our post captured."

Tagging PM's remarks with his tweet, Gandhi said, "PM has surrendered Indian territory to Chinese aggression."

"If the land was Chinese: 1. Why were our soldiers killed? 2. Where were they killed?" Gandhi said.

The categorical statement by the prime minister came in the wake of reports that Chinese military has transgressed into the Indian side of the Line of Actual Control, the de-facto border, in several areas of eastern Ladakh including Pangong Tso and Galwan Valley.

Soon after Gandhi's tweet, Union Home Minister Amit Shah posted video of father of a soldier, who was injured in Galwan face-off, and hit out at the Congress leader, accusing him of indulging in "petty politics".

"A brave armyman’s father speaks and he has a very clear message for Mr. Rahul Gandhi. At a time when the entire nation is united, Mr. Rahul Gandhi should also rise above petty politics and stand in solidarity with national interest," Shah wrote.

The prime minister's assertion came even as Congress president Sonia Gandhi, at the all-party meet, questioned the government's handling of the situation, asking if there was any intelligence failure, and seeking assurance that China will "revert" to its original position.

Rahul Gandhi on Friday accused senior ministers in the government of "lying" to protect the prime minister and that the Centre was "fast asleep" while martyred jawans paid the price in Ladakh.

The former Congress chief also tagged a one-minute video of a jawan's father saying the Indian soldiers were unarmed when they were attacked by Chinese troops.

He has been questioning the government on the LAC standoff and asking how the Chinese occupied Indian territory and why Indian soldiers were sent "unarmed to martyrdom" in Ladakh.

Twenty Indian Army personnel, including a colonel, were killed in a clash with Chinese troops in the Galwan Valley in eastern Ladakh on Monday night, the biggest military confrontation in over five decades that has significantly escalated the already volatile border standoff in the region.

New Delhi, Jan 16: In trouble brewing for the Gautam Adani-led M/S Adani Enterprises, the Central Bureau of Investigation (CBI) on Thursday said that it has registered a case against former officials of the National Co-operative Consumer Federation (NCCF) and others over alleged irregularities in supply of coal to the Andhra Pradesh Power Generation Corporation (APGENCO) in 2010.

The CBI in its FIR has named Virendra Singh, the then Chairman of the NCCF, G P Gupta, the then MD of the NCCF, S C Singhal, the then Senior Advisor of NCCF, Adani Enterprises Ltd and other unknown public servants and others for criminal conspiracy, cheating and criminal misconduct by public servants.

According to CBI, the case was filed on Wednesday after the preliminary enquiry revealed the crime by the officials named in the FIR and the Adani Enterprises was found to be true.

The FIR alleged that on June 26, 2010, APGENCO floated a tender enquiry for supply of six lakh metric tonnes of imported coal "on free on rail destination" basis to Dr Narla Tata Rao Thermal Station (NTTPS), Vijaywada and Rayalasaleema Thermal Power Plant (RTTP), Kadapa, Andhra Pradesh/RTPP via Kakinada-Vizag-Chennai-Krishnapatnam or any other ports

The same was forwarded by the Chief Engineer, APGENCO to seven PSUs -- PEC Limited, STC Limited, MSTC Limited, NCCF, MMTC, Coal India Limited and SCCL Limited.

The FIR alleged that during the probe, the Adani Enterprises used a proxy company to get the supply contract. It said, "NCCF received bids from six companies -- Adani Enterprises Ltd, Maheshwari Brothers Coal Limited (MBCL), Vyom Trade Links Pvt. Ltd, Swarana Projects Pvt. Ltd, Gupta Coal India Ltd and Kyori Oremen Ltd.

During investigation it was found that Gupta Coal India Ltd had quoted the NCCF margin of 11.3 percent, while the MBCL quoted the margin of 2.25 percent and rest did not quote any margin to the NCCF.

The FIR said the quotes of the Gupta Coal India Ltd, Kyori Oremen Ltd and Swarana Projects Pvt. Ltd were rejected by the NCCF as they were not found to be fulfilling the tender conditions.

"Post tender negotiation was done by senior officials of NCCF to give undue favour to Adani Enterprises Ltd despite it not qualifing the tender (terms)," the FIR said, adding instead of cancelling the bid of Adani Enterprise Ltd, senior management of NCCF conveyed the offer margin to the company through one of its representative -- Munish Sehgal, who was sitting in the NCCF head office. It is prima facie evident that when the bids were being processed at NCCF head office in Delhi, a representative of Adani Enterprises Ltd. was informed regarding their imminent rejection due to non-submission of NCCF margin and also that MBCL was eligible bidder quoted 2.25 percent margin," it alleged.

The CBI in its FIR, further alleged that Adani Enterprises Ltd. had given an unsecured loan of Rs 16.81 crore to Vyom Trade Links Ltd in 2008-09. "And further it was revealed that the bank guarantees of the Adani Enterprises Ltd. and Vyom Trade Links Ltd. were issues by the same branch of the State Bank of India and at the same time," it said.

"It was clear that Adani Enterprises Ltd. presented Vyom Trade Links Ltd. as a proxy company in this particular tender and Vyom Trade Links Ltd. later withdrew its offer on flimsy ground," the CBI FIR said.

"The aforesaid acts of commissions and omissions on the part of the senior management of the NCCF disclose that during their tenure, they acted in a manner unbecoming of public servants and committed irregularities by way of manipulation in the selection of bidders, thereby giving undue favours to Adani Enterprises Ltd. in award of work for supply of coal to APGENCO despite its disqualification," it added.

Feb 9: The Electronic Voting Machines (EVMs) used in Delhi Assembly polls are kept under tight security, in the 'Strong Room' located at Atal Adarsh Bengali Balika Vidyalaya in Gol Market.

Voting for Delhi Assembly elections took place on Saturday with voters turnout well short of the 2015 election mark.

Counting of the votes will be on February 11.

Earlier, Deputy Election Commissioner Sudip Jain had said the Delhi elections took place peacefully and smoothly.
