SC forms panel for probe charge against ex-judge

SC_formsNew Delhi, Nov 12: Hit by allegations of sexual misbehaviour by one of its judges, the Supreme Court on Tuesday constituted a three-judge committee to go into the charge of a woman intern that she was sexually harassed last December by a judge, who retired recently.

Observing that he was concerned as head of the institution (judiciary), Chief Justice P Sathasivam said, “In the cases of sexual harassment, we cannot take it lightly.”

“We are taking steps,” said the three-judge bench also comprising justices Ranjan Gogoi and Shiva Kirti Singh after Attorney General G.E. Vahavati mentioned the matter, saying, “Its an extremely serious matter."

The CJI said the matter was also mentioned at 10.30 am on Tuesday and during the lunch recess it was discussed with other judges. “I have constituted a committee comprising three judges — Justices R.M. Lodha, H.L. Dattu and Ranjana Prakash Desai.”

“The committee will go into the whole affair and find out the facts and prepare the report and from today evening they are going to start their work,” the CJI said.

“First, the committee will find out the correctness of the statement,” Justice Sathasivam said, observing that there are records about the interns or advocates who are associated with judges.

Further entries are made about persons coming to the Supreme Court and the committee will go into it, he said.

“As the head of the institution, I am also concerned about the allegation,” the CJI said, adding, “I am anxious whether the statement is true or not.”

The allegation of sexual assault hit the Supreme Court when a young woman intern accused a sitting judge, who retired recently, of having misbehaved with her in a hotel room last December when the nation was grappling with the gangrape of a 23-year-old woman in the capital.

The allegation, levelled by the woman lawyer against the unnamed judge, was raised in the apex court before the Chief Justice by advocate M.L. Sharma with a plea that the issue be taken note of suo motu on the basis of media reports and an inquiry be initiated.

While the bench was passing the order, advocate Sharma reminded the judges that he had mentioned the matter in the morning.

“Yes, you mentioned it in the morning at 10.30. It was lingering in my mind while I was hearing the submission made by a senior counsel in another matter,” the CJI said, adding, “We are conscious of the fact.”

Justice Sathasivam said guidelines have been framed and notified in the gazette to deal with issues of sexual harassment in the apex court premises and curb the evil.

Members are yet to be inducted in the committee for which communication has already been sent to Supreme Court Bar Association and Law Clerks Association to select the members, but they have not yet replied.

A deadline of November 30 has been set for them to nominate the members, the CJI said.

The bench had assembled 20 minutes late after the lunch break.

The Attorney General narrated the news report published in an English daily on Tuesday and said it was based on the blog written by the intern and a subsequent interview given by her.

He also said the matter has to be taken up very seriously in view of the apex court’s guidelnes laid down in the Visakha judgement dealing withe sexual harassment of women at work place.

After hearing the Attorney General, the bench told him that since it has already constituted a committee, it will keep the petition pending for two weeks.

The woman, who graduated from National University of Juridical Sciences (NUJS), Kolkata this year and a fellow with an organisation, Natural Justice: Lawyers for Communities and the Environment, wrote about the alleged sexual harassment incident in a blog.

In the blog written on November 6 for Journal of Indian Law and Society, the woman said the incident took place last year when she was interning with the apex court judge.

“Last December was momentous for the feminist movement in the country——almost an entire population seemed to rise up spontaneously against the violence on women, and the injustices of a seemingly apathetic government. In the strange irony of situations that our world is replete with, the protests were the backdrop of my own experience.

“In Delhi at that time, interning during the winter vacations of my final year in University, I dodged police barricades and fatigue to go to the assistance of a highly reputed, recently retired Supreme Court judge whom I was working under during my penultimate semester.

“For my supposed diligence, I was rewarded with sexual assault (not physically injurious, but nevertheless violating) from a man old enough to be my grandfather. I won’t go into the gory details, but suffice it to say that long after I’d left the room, the memory remained, in fact, still remains, with me,” she said in the blog.

The law graduate, also in an interview to a website, said she was harassed by the judge in a hotel room and there were no other witnesses to the incident.

"It was a hotel room, (people) saw me walking in voluntarily, saw me walking out very calmly. I didn’t even walk out (with) fear. At that moment I felt I needed to walk out very calmly. I never mentioned anything the same day to anybody,” she said while speaking to Legally India.

The woman, who did not mention the date of incident in her blog, has said in the interview with the website that it took place on December 24, last year.

Mumbai, Apr 22: Maharashtra Home Minister Anil Deshmukh on Wednesday said none of the 101 people arrested in connection with the Palghar lynching case is a Muslim, and accused the opposition of giving a communal colour to the incident.

Terming the incident as unfortunate and a blot on humanity, Deshmukh in a Facebook address said this is not the time to play politics, and urged all to engage in collective efforts to defeat the deadly coronavirus.

Without naming any leader or party, Deshmukh, who is an NCP leader, said some people were seeing Mungerilal ke haseen sapne (referring to a fictional character from a TV show who daydreams) of returning to power in the state.

He said in the run up to the incident, a rumour did rounds in Palghar that some people were lifting children during night.

The entire episode is being investigated by a special inspector general and the probe has been handed over to the Crime Investigation Department (CID), he said.

"The police arrested 101 people in connection with the incident within eight hours after it took place. They had run into neighbouring jungles, but were caught by police. There is no Muslim brother among these 101 people, Deshmukh said.

The minister said someone was heard as saying oye bas (please stop) in the video clip of the incident, but it was allegedly distorted as Shoaib.

An attempt was made to give a political colour to the incident. And this is very unfortunate...communal politics is being played, Deshmukh alleged.

He said such politics is being played at a time when the entire state is engaged in a battle against coronavirus.

"It is not the time to play politics, but to fight coronavirus collectively. It is unfortunate some people are seeing 'Mungerilal ke haseen sapne' at this juncture, the minister said.

The incident took place on the night of April 16 when three men - two seers and their driver - were going from Mumbai in a car towards Surat in Gujarat to attend a funeral.

Their vehicle was stopped near a village in Palghar district where the three were dragged out of the car and beaten to death with sticks by a mob on suspicion that they were child-lifters.

The deceased were identified as Chikne Maharaj Kalpavrukshagiri (70), Sushilgiri Maharaj (35), and driver Nilesh Telgade (30).

The Maharashtra government earlier ordered a high- level probe into the incident, and two policemen from Palghar were suspended on Monday for alleged dereliction of duty.

Sitamarhi, Jun 15: Eyewitness accounts from locals in Bihar's Sitamarhi district recount the brutality and intimidation by Nepal's security personnel who on June 12 had resorted to unprovoked firing on a group of people at the international border, which left one Indian dead and two others injured.

"18-20 shots were fired for over one hour and everyone is in shock even now," said Nitish Kumar, a resident of Jankinagar recalling the incident that took place early on Friday morning.

Nepal's Armed Police Force (APF) opened fire at the Lalbandi-Jankinagar border in which three men - Vikesh Yadav, Umesh Ram and Uday Thakur - suffered gunshot injuries. Vikash Yadav succumbed to his injuries on Friday itself.

Another person Lagan Kishore, who was at the border with his family to meet his daughter-in-law, a Nepali national and her family, said he was detained by the APF personnel who dragged him to the other side of the border.

Lagan Kishore said that the Nepali personnel abused and hit him with rifle butts and even abused his son and later resorted to firing.

Several residents of Jankinagar, who spoke to media, termed the incident as "unfortunate and shocking".

Nitish Kumar recalled: "A family was here to meet their in-laws (Nepali nationals). The daughter-in-law was talking to her family while her husband and her father-in-law sat a little distance away. Suddenly I saw Nepali personnel abusing her husband who complained about it to his father. All of a sudden the Nepali forces started thrashing them and then opened fire. They also took the father into custody."

"We were all shocked. I could hear about 18-20 gunshots fired over a period of one hour," Kumar said.

Another local, Ajit Kumar, said he was perplexed with the behaviour of the Nepali Police.

"There used to be no problems earlier. We don't understand what happened to the Nepal Police that day. The firing is unfortunate. If this continues, how will people in the border area live?" he questioned.

Ajit Kumar stated that such an incident has taken place for the first time. "People from here go to work in fields in Nepal and their people come to work in our fields. Such a thing has happened for the first time. About 80 per cent of our people are married to Nepalis," he said.

Many people who live in the adjoining districts of Bihar, which shares over 600 kilometres of border with Nepal, have relatives on either side of the border.

Meanwhile, Nepali police have claimed that Lagan Kishore, who was taken into custody following the firing by APF and handed over to Indian Security Forces at no man's land on June 13, was detained for trying to snatch a weapon from one of their personnel during an altercation.

However, both Kishore and his family have denied the claims and said he was "dragged" across the border and was beaten.

Kishore said that during the firing he had rushed towards the Indian side but Nepalese personnel hit him with rifle butt and took him to Nepal's Sangrampur. He was also asked to confess that he was taken into custody from the Nepali side.

"We ran to return to India when they started firing, but they dragged me from the Indian side, hit me with a rifle butt and took me to Nepal's Sangrampur. They told me to confess that I was brought there from Nepal. I told them you can kill me but I was brought there from India," said Kishore.

Kishore's son also said that Nepali personnel started abusing them and hit him and his father.

Speaking to ANI, Kishore's son said, "We went to meet my brother-in-law. Security personnel started abusing me but I could not understand their language. However, my brother's wife asked them to not abuse. After that, they came to the Indian side and hit me. I told my father about the incident and he confronted them."

"They started beating him and called fellow personnel who started firing and dragged my father from the Indian side, hit him with a rifle butt and took him to Nepal''s Sangrampur," he said.

Relations have become strained between India and Nepal after the latter released a map showing parts of Indian Territory-Lipulekh, Kalapani and Limpiyadhura as its own.

Jan 31: Twenty-three children aged between six months and 15 years, who had been taken hostage by a murder accused after inviting them to his daughter's birthday party, were rescued late on Thursday night after police killed their captor in a village here.

The hostage drama began at Kasaria village in the afternoon and continued for about eight hours.

"The accused was killed and there were about 23 children who were rescued safely," Additional Chief Secretary (Home) Awanish Awasthi told reporters at a hurriedly called press conference at 1.20 am.

"The accused had invited the children for the birthday party of his daughter and held them hostage. It started about 5.45 pm on January 30 and continued for about eight hours," Director General of Police (DGP) O P Singh said, adding that in the entire operation they had tried to "engage" the accused and were successful.

He said the accused, identified as Subhash Batham, had initially released a six-month-old girl by handing her over to his neighbour from a balcony.

Eyewitnesses said a restive crowd gathered outside the house where the children were kept with some women wailing and praying for their safe release.

The crowd broke open the door of the house to rescue the children, they said.

As the accused opened fire, the police retaliated killing him on the spot.

In the exchange of fire, the captor's wife was injured, but none of the children suffered any injury.

A man and two policemen also suffered bullet injuries.

The motive of the accused was not known immediately.

Chief Minister Yogi Adityanath monitored the situation in Farrukhabad, which is nearly 200 km from state capital Lucknow.

"The CM as soon as he got to know about the incident called a meeting of the crisis management group and personally monitored the situation and ensured children are rescued safely," Awasthi said.

Earlier, a team of NSG (National Security Guard) commandos had taken a special aircraft to reach Farukhabad, a senior security official in Delhi said.

Police said Batham, a murder accused, seemed to be mentally unstable.

Inspector-General of Police, Kanpur Range, Mohit Agarwal, said, "The man called the children for a birthday party and held them hostage in the basement of the house. He fired six shots from inside the building."

Batham initially wanted to talk to the local MLA, but refused to speak to the leader when he arrived, Agarwal said.
