Bombay high court upholds BCCI's decision to terminate Deccan Chargers

Mumbai, October 18: The cash-strapped Deccan Chargers will remain terminated from the IPL after the Bombay high court on Thursday set aside a status quo order passed by an arbitrator on cessation of its membership in the league.

Hearing a petition filed by the Cricket Board, Justice RD Dhanuka quashed the status quo order passed by the arbitrator appointed by the high court to resolve the dispute between BCCI and Deccan Chronicles Holdings Limited (DCHL).

On another petition filed by DCHL against termination of the contract of its IPL franchise, the court refused to grant any interim relief, but said the legality of the termination would be decided by the arbitrator.

The court's orders on the two petitions effectively means that the termination of Deccan Chargers' IPL membership would stand, according to legal circles.

The arbitrator, retired supreme court judge CK Thakker, had last week passed an order for status quo to be maintained following which BCCI had moved the high court in appeal.

"Arbitrator had no jurisdiction to grant status quo. On the same day (October 12), the high court had denied extension of time to DCHL to furnish Rs 100 crore bank guarantee as directed by the court on October 1," Justice Dhanuka said.


He further said the arbitrator is not "superior" to the high court and hence cannot pass an order which overrides the high court's direction.


Criticising the plea made by DCHL before the arbitrator for status quo, the court said, "Once the high court has rejected relief, the plea made before the arbitrator is not maintainable."


Justice Dhanuka noted that the order passed by another judge of the court on October 1 directing DCHL to furnish bank guarantee was "self operative and protective of the interests of both DCHL and BCCI".

The court also refused interim stay on termination of IPL franchise as sought by DCHL in a separate petition.

"DCHL has still not furnished bank guarantee. Hence there is no change in circumstances to grant relief to DCHL. No case is made out for interim relief for granting stay on termination. The application seeking stay is a gross abuse of law," Justice Dhanuka said.


The court, however, observed that the legality and validity of the termination would be a subject matter before the arbitrator.

The Deccan Chargers had lost its place in the IPL on October 13 after the high court stayed the arbitrator's order for maintaining status quo in the matter till further hearing, while BCCI declared that the termination of the IPL franchise stands following the court's order.

A day after ending the Deccan Chargers' franchise, the BCCI had begun the process of finding a new IPL team inviting bids in respect of 12 cities -- Ahmedabad, Cuttack, Noida Dharamsala, Indore, Hyderabad, Kanpur, Kochi, Nagpur, Rajkot, RanchI and Vizag.

BCCI Counsel Raju Subramaniam argued "IPL season 6 is going to commence from April next year. There are several good international players from the Deccan Chargers team who will be left high and dry if they are not included in the auction list".

The BCCI Counsel argued that DCHL was given sufficient time to submit the bank guarantee of Rs 100 crore as directed by another judge of the high court. He said "Justice Kathawala had kept DCHL and BCCI's interest in mind and asked them to submit bank guarantee if they wanted to participate in the IPL 6 season."

However, DCHL's failure to submit bank guarantee of Rs 100 crore of a nationalised bank allowed BCCI to initiate action in furtherance to the termination.


Senior counsel S U Kamdar, appearing for DCHL, told the court that the company, which is in financial difficulty, should be allowed to sell the team. "To help BCCI, the company decided to go out of IPL 6 by selling the team. But the cricket board has a problem with that also," he said.

Kamla Landmarc Realty, which had shown interest in buying the IPL franchise, submitted that no prejudice would be caused to BCCI if DCHL was allowed to sell the team and go out of the IPL 6.

Ratnakar Bank, which has lent Rs 55 crores to DCHL, urged the court to give DCHL a chance so that they can negotiate with prospective buyers for the IPL franchise instead of terminating the contract. If they are allowed to sell the franchise then the rights of lenders will be protected, Bank's Counsel Anjan Dasgupta submitted.

BCCI had on September 15 decided to terminate the contract at an emergency IPL Governing Council meeting in Chennai, which was challenged by DCHL in Bombay high court.

The court had on October 1 ordered DCHL to furnish a bank guarantee of Es 100 crore, bear all expenses for IPL 6, including making payments to BCCI towards franchise, players and support team costs. Besides, it was asked to bear the costs of conducting matches and other expenses.


In the event of any default on part of DCHL, BCCI shall be entitled to invoke the bank guarantee to the extent necessary, Justice Kathawala had ruled.

The Deccan Chargers had failed to produce Rs 100-crore bank guarantee before the court on October 12, the condition set by the court for the team's continuance in the IPL, effectively meaning the end of the road for the beleaguered team.

The DCHL, however, approached the same day and secured an order that status quo be maintained. The arbitrator's order had prevented BCCI from going ahead with the termination.

Aggrieved, the Cricket Board then moved the Bombay high court, which stayed the arbitrator's order on October 13, paving the way for the BCCI to go ahead with the termination of the franchise and invite bids for a new team.

Jeddah, Jan 3: Spanish driver Fernando Alonso is aiming to create history as the first Formula One world champion to win the Dakar Rally when the 12-day marathon gets underway in Saudi Arabia on Sunday.

Alonso, who won the F1 championship with Renault in 2005 and 2006, is one of 351 starters in this year's 7,500 km race which has moved from South America to Saudi Arabia, both venues a long way from the original 1979 route between Paris and the Senegalese capital Dakar.

Among the starters will be motorbikes, quad bikes and trucks but Alonso, who will have five-time bike champion Marc Coma navigating his Toyota, will be in the car category as he bids to become one of the greatest all-round drivers of all time.

Apart from his success in F1, the 38-year-old Spaniard has also won the Le Mans 24-hour race and has singled out the Indianapolis 500 as his priority for 2020. He describes Dakar as “the biggest challenge of my career”.

Alonso is not the first F1 driver to take part in the race, however.

The Belgian Jacky Ickx, a winner of eight grand prix and six-time winner of Le Mans, won Dakar in 1983 and came second in 1986 and 1989. Frenchman Patrick Tambay, who had two wins in his 114 grand prix, came third in 1988 and 1989.

Given the treacherous conditions--long stretches of sand dunes--Alonso is not overly confident of challenging for victory, noting that even the nine-time world rally champion Sebastien Loeb was unable to deliver when he raced the Dakar. Loeb won 13 stages but could only finish second in 2017 and third in 2019.

“If Loeb still hasn't won the Dakar, imagine me, who is coming from asphalt,” Alonso told RTVE. “I think the goal is more to approach the rally as an enriching experience for us.”

Fellow Toyota driver Nasser Al-Attiyah is a more likely candidate, not least because the Qatari is a three-time winner and reigning champion.

"Give me some sand and I'm happy," Al-Attiyah told dakar.com.

He will be pressed, however, by the Minis of Carlos Sainz and 'Monsieur Dakar' aka Stephane Peterhansel who has won 13 Dakars across bikes and cars in 30 races.

“We are obviously very excited about the Dakar in Saudi Arabia. It will be a new challenge for everyone,” said Peterhansel who will be partnered by Paulo Fiuza after the Frenchman's wife Andrea pulled out for health reasons.

“Unfortunately, it is not possible to contest the rally with Andrea, as was planned, however I have known Paulo Fiuza for a very long time. According to the organisers, the navigation will be very complicated and play a major role this time.”

Cyril Despres, a five-time winner on bikes, is also back with a new teammate -- explorer Mike Horn.

“I was stuck in the ice for a month, and now I'm heading to Jeddah. For the first time, the Dakar Rally is in Saudi Arabia and I'm doing it with a very good friend of mine, Cyril Despres,” tweeted Horn whose adventures include an 18-month solo journey around the equator without using any motorised transport.

Horn is also the first man to travel without dogs or transport to the North Pole during winter, in permanent darkness.

Across the dunes of Saudi Arabia that experience may come in handy.

Bengaluru, Jun 2: Bangladesh opening batsman Tamim Iqbal has said that he was ashamed on seeing the training regime of Indian skipper Virat Kohli.

Iqbal said that the incident happened two-three years back as he thought to himself that why he cannot do the same even when he is the same age as Kohli.

"I must say this, it is not because I am talking to an Indian commentator, India is our neighbour so whatever things they do, it affects Bangladesh as well. We follow what is happening in India, when India changed its approach towards fitness, it impacted Bangladesh the most," Iqbal told Sanjay Manjrekar in a videocast hosted by ESPNCricinfo.

"I have no shame in admitting this, when I saw Virat Kohli running around two-three years ago, I was ashamed of myself, I thought this is a guy who is probably my age, but he is training so much and I have not doing even half of it. We have a great example in our team as well, Mushfiqur Rahim manages himself well regarding fitness," he added.

During his initial days of international cricket, Kohli was fond of chicken which he has admitted several times during media interaction.

But in 2013, the 31-year-old batsman intentionally shifted his focus to fitness, diet, and training.

Now he has become punctual about his diet which has given him a different character on and off the field.

The comparisons between Kohli and Sachin Tendulkar have also kept on growing and many have picked the current Indian skipper to break the records set by Tendulkar.

Tendulkar managed to call time on his career after registering 100 international centuries, while Kohli currently has 70 centuries across all formats.

Currently, Kohli is ranked at the top spot in the ICC ODI rankings while he is in the second place in Tests rankings.

New Delhi, Jun 11: BCCI president Sourav Ganguly has indicated that this year's IPL could be conducted in empty stadiums, insisting that all possible options are being explored to ensure that the suspended event does take place despite the COVID-19 pandemic.

In a letter to all the affiliated units sent late on Wednesday after the ICC Board meeting, Ganguly seemed confident of an IPL this year despite its current status of being indefinitely suspended because of the raging pandemic, which has claimed more than 8,000 lives in India.

"The BCCI is working on all possible options to ensure that we are able to stage IPL this year, even if it means playing the tournament in empty stadiums," Ganguly wrote.

"The fans, franchises, players, broadcasters, sponsors and all other stakeholders are keenly looking forward to the possibility of IPL being hosted this year.

"Recently, a lot of players both from India and other countries, participating in the IPL have shown keenness on being part of this year's IPL. We are optimistic and the BCCI will shortly decide on the future course of action on this," the former India captain said.

It is widely speculated that the IPL is eyeing the October event if the T20 World Cup scheduled to be held in Australia at that time is postponed. The ICC has deferred a decision on the World Cup's fate until next month.

Ganguly also said that the BCCI is working on the domestic schedule while exploring various formats which would make tournaments like Ranji Trophy, Duleep Trophy and Vijay Hazare "competitive and feasible".

"Moving ahead, the BCCI is in process of planning the domestic competitions for the next cricketing season. We are working on various options and formats in our endeavour to ensure that various domestic tournaments are held, they stay competitive and participation feasible," said the former India captain.

"The BCCI will come up with more details in next couple of weeks," he added.

He also informed that BCCI is preparing a Standard Operating Procedure (SOP) for resumption of cricket in all state units to ensure medical safety of those involved.

The president also informed that the BCCI has made "all efforts to release funds/grants to its various members."

"Associations which have made proper submission of their accounts and funds utilization certificates have already received their grants," he said.

The other units will also receive their grants once they submit relevant documents, the president assured while informing that vendors have also been paid.
