No SC verdict on Ram temple before 2019 polls, say lawyers

Lucknow, Sept 21: The Ram temple issue, presently in the Supreme Court, could linger further and there is no chance of any verdict before the 2019 Lok Sabha polls, claims the lawyers involved in the case.

The current three-judge Bench headed by CJI Dipak Misra had been hearing the Ayodhya title dispute. Justice Misra is to retire on October 2 and those legally associated with the case say there is absolutely no possibility of any verdict coming in the case before that. In fact, the Bench has not entirely started with the actual hearing in the title case. 

Mr Jafarayeb Jilani, the convener of Babri Masjid Action committee and lawyer for the Muslim side in the Ram Janam Bhoomi-Babri Masjid dispute case, told UNI here on Friday that the bench concerned has so far heard and reserved its order only on an earlier ruling of the Apex court in 1994, which said, 'Mosque is not the essential requirement In Islam. Order on this was reserved on July 20 and is expected to be pronounced before Justice Mishra retires.”

Mr Jilani said, “If the bench thinks the 1994 ruling is required to be looked into, the issue will be recommended to be heard by a five-judge bench or above it. This, because the 1994 ruling of 'Mosque not being an essential requirement in Islam' was given by a five-judge bench.

He further explained that if a new bench is to be constituted, the matter will be subsequently heard by it." And if it's the other way around, even then a new bench—most likely comprising of the new Chief Justice of India—will hear it post Justice Mishra's retirement. Justice Ranjan Gogoi is set to take over as the new CJI.”

Mr Jilani feels that this 1994 observation doesn't makes any significant impact on the ongoing title suit case. However, since it's related to the Ayodhya dispute, the judgement on the ruling will certainly create a flutter.

Senior lawyer Hari Shankar Jain of the Hindu Mahasabha is more vocal in his observation. He says, “I don't see any solution coming from the Supreme Court even in the next two years. Forget about anything before the 2019 general elections.” He further says, “The actual hearing in the title suit has not yet started. First, the court will decide about the 1994 ruling. Only then will there be further progress.”

Now, amid this clarity of no verdict on the sensitive issue in the near future, the question arises about what the Narendra Modi government wishes to do.

The BJP leaders have been giving a mixed response in the matter. While BJP president Amit Shah and Prime Minister Modi have not spoken a word about the issue during their rallies and visits to Uttar Pradesh, the state’s Chief Minister Yogi Adityanath had earlier suggested that temple is not part of party's agendas for the 2019 elections. Mr Adityanath said, “Lord Rama will himself decide the date of the temple construction.”

This statement was widely read as BJP's tactical decision to not to make it an issue in the 2019 polls. However, UP's deputy CM Keshav Maurya had taken a different route. Mr Maurya had said, “We are committed about the Ram temple and the Centre will not be shy away from bringing in a legislation to pave way for the construction of Ram Temple at the disputed site in Ayodhya.”

Kozhikode: An Air India Express flight from Dubai with 190 people on board overshot the Kozhikode tabletop runway on landing there today. The Boeing 737 “fell off” the runway into the valley, broke into two causing death and devastation. 

According to reports, around 20 people were dead including two pilots.

An Air India spokesperson said: “Air India Express flight IX 1344 operated by Boeing 737 aircraft from Dubai to Calicut overshot the runway at Kozhikode at 7.41 pm Friday. No fire reported at the time of landing. There are 174 passengers, 10 infants, two pilots and five cabin crew on board. Rescue operations are on and passengers are being taken to hospital for medical care. We will soon share the update in this regard.”

The Directorate General of Civil Aviation (DGCA) is probing this accident. “Prima facie, the aircraft landed beyond the touchdown point and fell into a valley. It has broken into two. We suspect some casualties. More information is awaited,” said a senior DGCA official.

Taking to twitter, defence minister Rajnath Singh wrote: “Devastating news from Kozhikode, Kerala. I am deeply anguished by the loss of lives due to an accident carrying several passengers on Air India flight. In this hour of grief, my thoughts are with the bereaved families. I pray for the speedy recovery of the injured.”

Foreign minister S Jaishankar tweeted: “Deeply distressed to hear about the Air India Express tragedy at Kozhikode. Prayers are with the bereaved families and those injured. We are ascertaining further details.”

While, senior BJP leader from Kerala K J Alphons tweeted: “Second tragedy of the day in Kerala: Air India Express skids off the run way at Kozhikode, front portion splits , pilot dies and lots of passengers injured . All passengers evacuated. Very lucky the aircraft didn’t catch fire.”

More details are awaited.

Geneva, Jun 24: The global cumulative count of confirmed coronavirus cases is approaching nine million, with 133,326 cases recorded over the past day, the World Health Organisation (WHO) said in its daily situation report on Tuesday.

Over the past 24 hours, 3,847 people died from COVID-19 worldwide, taking the cumulative death toll to 469,587 fatalities, according to the report.

The global case total has now reached 8,993,659.

The Americas still account for the majority of cases and deaths -- 4.4 million and 224,207, respectively.

The United States remains the country with the highest count of cases and fatalities -- 2.3 million and 119,761, respectively.

Kanpur, Jul 10: Kanpur encounter main accused Vikas Dubey, who was injured in an encounter with the police, died on Friday, the police said.

"Gangster Vikas Dubey arrested for killing eight policemen is dead," confirmed the police.

According to SP Kanpur West Anil Kumar, gangster Vikas Dubey attempted to flee after the car overturned. Dubey attempted to flee by snatching pistol of the injured policemen. However, he was shot in the retaliatory firing.

"Vikas Dubey attempted to flee by snatching pistol of the injured policemen after the car overturned. Police tried to make him surrender, during which he fired at the policemen. He was injured in retaliatory firing by police. He was later rushed to the hospital," SP Kanpur West told reporters here.

Dubey, the main accused in the Kanpur encounter was arrested by the police in Ujjain on Thursday morning. He was on the run for the last six days and had come to Ujjain to offer prayers at Temple, where he was identified by a security guard at the shrine.

The gangster is the main accused in the encounter that took place in Bikru village in Chaubeypur area of Kanpur last week, in which a group of assailants allegedly opened fire on a police team, which had gone to arrest Dubey. Eight police personnel were killed in the encounter.

Dubey managed to escape after the killing.  The Uttar Pradesh police launched a hunt for him and raised the bounty on him to Rs 5 lakh.

Bahua Dubey and Prabhat Mishra, close aides of the main accused, were killed in separate encounters in Etawah and Kanpur respectively, on Thursday.

The main accused's other aide Shyamu Bajpai was arrested by the Chaubeypur police following an encounter. He carried a reward of Rs 25,000, the police informed on Wednesday. Earlier the same day, Uttar Pradesh's Special Task Force (STF) gunned down Vikas Dubey's close aide Amar Dubey in Hamirpur district.

One way this is a lesson to his and his chaddi society's followers that party can take their own soldiers life for the self benefit.
