New Delhi, Mar 6: The Supreme Court on Wednesday reserved its order on the issue of going for negotiation and appointment of negotiators to resolve the vexed Ayodhya dispute involving Ram temple and Babri Masjid.

A five-judge Constitution bench presided over by Chief Justice Ranjan Gogoi sought to brush aside the reservations expressed by Uttar Pradesh and Hindu sides, barring 'Nirmohi Akhara', on carrying out negotiation to bring an end to the dispute.

"We understand this is a dispute about sentiments and faith. It is not a dispute upon a piece of land. We are conscious of the gravity of the dispute and its impact on the body politic. It is about heart and mind and healing of relation," the bench said as it heard arguments opposing any negotiation.

Senior advocate C S Vaidyanathan, appearing for 'Ram Lalla', a party to the dispute, contended the High Court had attempted Section 89 of Civil Procedure Code for alternate dispute mechanism after hearing of the parties but it failed.

"In a case like this, related to Ram Janmabhumi, faith and belief cannot be negotiated. What can be considered is an alternative place for mosque, which can be built by crowdfunding. Nobody can agree to any negotiation on Ram Janmabhumi," he said.

The bench, also comprising Justices

S A Bobde, D Y Chandrachud, Ashok Bhushan and S Abdul Nazeer, sought to discard a contention made by a counsel raising the issue of "atrocities by invaders", saying, "You don't have to repeat all these things."

"We have also read History. We don't have any control over what happened in the past. We can do what happens in the present," the bench added.

"Are you saying it is going to be a failure, even before it is attempted? You are prejudging," the bench further told the council.

The court asked the parties to present names of negotiators during the course of hearing. It said the orders would be passed shortly.

Senior advocate Rajeev Dhavan, appearing for the Muslim sides, said in all religious matters, there would always be sentiments. It will always be a matter of angst for some as seen in the case of Sabarimala temple. We are open to negotiation, he said.

A batch of appeals filed against the 2010 Allahabad High Court judgement is pending before the court.

New Delhi, May 31: Congress leader Kapil Sibal on Sunday questioned the Prime Minister on how much money has been given to labourers from the PM-CARES Fund.

"I would like to ask Prime Minister Modi, 'Can you tell us how much money did you give to labourers from your PM-CARES Fund?' I request him to answer this question. Many people died during this period, some died while walking, some died in the train, some died of hunger," Sibal said while addressing a virtual press conference.

The senior Congress leader further asked how much ex gratia did the Prime Minister give to the labourers who died in the corona crisis while negotiating the lockdown.

"I refer you to Section 12 of the Disaster Management Act. It says that ex gratia assistance on account of the loss of life and also assistance for the restoration of livelihood should be provided by the government. Did the government give ex gratia assistance to people who died in the crisis? The act also mentions special provisions for widows and orphans. The government should clarify how much assistance they gave to such people," he said.

Sibal said that the government should keep aside its agenda for the last six years and concentrate on making pro-poor policies.

"In the coming days, our economy is going to go into the negative territory as also confirmed by RBI. There are 45 crore labourers in our country. What will be their state? We have to look at our future. That is why we want to request the government that the agenda that they have run over the last six years should be kept aside and that government should care about the poor and draft policies for them," the Congress leader said.

New Delhi, May 23: India will try to restart a good percentage of international passenger flights before August, Civil Aviation Minister Hardeep Singh Puri said on Saturday, three days after announcing resumption of domestic flights from May 25.

All scheduled commercial passenger flights have been suspended in India since March 25 when the Modi government imposed a lockdown to contain the novel coronavirus pandemic.

"I am fully hopeful that before August or September, we will try to start a good percentage of international civil aviation operations, if not complete international operations," Puri said during a Facebook live session.

"I can't put a date on it (restarting international flights). But if somebody says can it be done by August or September, my response is why not earlier depending on what is the situation," he said.

New Delhi, May 9: The Supreme Court on Friday agreed to consider a plea raising the issue of mass termination and the illegal salary cut of employees in IT/ITES/BPO/KPI by their employers during the lockdown due to the spread of the coronavirus.

A bench comprising Justices Ashok Bhushan, S.K. Kaul and B.R. Gavai, taking up the matter through video conferencing, agreed to examine the issue and listed it for May 15.

The petition, argued by senior advocate Devadatt Kamat, was filed by National Information Technology Employees Sena (NITES) through advocate-on-record Amit Pai, and sought implementation of directions issued by the Centre on March 29 and similar advisories issued by several other states mandating payment of wages/salaries to the employees and also directed not to terminate them during the period of lockdown.

A directive was issued by the Union Ministry of Labour and Empowerment to all Chief Secretaries of state governments to issue advisories to public and private companies to not lay off employees or implement pay cuts during lockdown.

In the Centre for Monitoring Indian Economy (CMIE) report published on April 19, it was noted that "several companies across the country have started to terminate its employees without any reasonable cause and have started withholding their salaries. It is submitted that in such testing times, the rights of the employees ought to be protected by necessary orders/directions to the companies through the Respondents to effectively implement the lockdown and to contain the spread of the virus", said the plea.

On March 29, the Centre issued an order directing all states and Union Territories to issue orders, requiring all the employers in the industrial sector and shops and commercial establishments to pay wages on the due date without any deduction during their closure due to the lockdown.
