Oscar Pistorius not guilty of murder, still faces culpable homicide charge

Sep 12: In a lengthy verdict phase climaxing Oscar Pistorius' trial, the judge said Thursday he can't be found guilty of murder but that he was negligent in the shooting death of girlfriend Reeva Steenkamp, raising the possibility he'll be convicted of culpable homicide.

In a moment of high-drama, she then stopped reading out her judgment in the six-month-long trial and adjourned until Friday. A formal judgment in the case that has riveted much of South Africa and the world is expected on Friday.

If Pistorius is acquitted of murder, he could still be sent to jail for years if convicted of culpable homicide.

While the judge did not announce a verdict, she said the prosecution had not proven beyond a reasonable doubt that Pistorius committed premeditated murder. She also ruled out a lesser murder charge, but said Pistorius may be vulnerable to being convicted of culpable homicide — in other words a negligent killing.

"I am of the view that the accused acted too hastily and with excessive force," Masipa said of Pistorius actions on the fatal night last year.

The world-famous athlete has acknowledged firing four shots through a toilet door in his home, hitting Steenkamp in the head, arm and hip area and killing her. He says he mistook her for an intruder. The prosecution alleges the athlete intentionally killed his girlfriend, a model and budding reality TV star, after a loud argument, which was heard by neighbors.

Culpable homicide normally carries a five-year jail sentence in South Africa when a firearm is used, but it can be changed by a judge depending on the specific circumstances of the killing.

"Culpable homicide is a competent verdict," the judge said.

Masipa said there were "just not enough facts" to support the finding of premeditated murder in Steenkamp's fatal shooting.

As the judge spoke, Pistorius wept quietly, his shoulders shaking as he sat on a wooden bench.

Masipa earlier told Pistorius, 27, he could remain seated on the bench while she read her verdict out and until she asked him to stand for the judgment.

Masipa described Pistorius as a "very poor witness" who had lost his composure on the stand and was at times "evasive," but she emphasized that did not mean he was guilty of murder.

Earlier, the 66-year-old judge cast doubt on witness accounts of hearing a woman's screams, a key part of the prosecution's case. Masipa said "none of the witnesses had ever heard the accused cry or scream, let alone when he was anxious," apparently acknowledging the possibility of the defense's argument that Pistorius had been the person screaming in a high-pitched voice after discovering he had fatally shot Steenkamp.

Masipa also cited testimony of an acoustics expert called by the defense, saying it cast "serious doubt" on whether witnesses who were hundreds of meters (yards) away in their homes — as some state witnesses were — could have differentiated between the screams of a man or a woman.

At one point, Masipa said: "I continue to explain why most witnesses got their facts wrong."

Masipa also said she was disregarding text messages between Steenkamp and Pistorius that had been entered as evidence. Prosecutors had submitted text messages that showed tension between them while the defense submitted messages that indicated mutual affection. That evidence, the judge said, doesn't prove anything.

"Normal relationships are dynamic and unpredictable most of the time, while human beings are fickle," she said.

Pistorius faced 25 years to life in prison if convicted of premeditated murder for fatally shooting Steenkamp through a toilet cubicle door in his home in the pre-dawn hours of Feb. 14, 2013. He also faced years in jail if found guilty of murder without pre-planning, or of negligent killing. Pistorius could also be acquitted if Masipa believes he made a tragic error and acted reasonably.

Earlier, Masipa began by outlining in detail the four charges against the Olympic runner: Murder, two counts of unlawfully firing a gun in a public place in unrelated incidents and one count of illegal possession of ammunition.

Before the session began, Pistorius hugged his brother Carl, who was seated in a wheelchair because of injuries suffered in a recent car crash.

The parents of Steenkamp were also in the packed gallery. Other members of Pistorius' family, including his father Henke, sat behind him.

If Pistorius is convicted on any charge, the case will likely be postponed until a later sentencing hearing.

There were many journalists at the courthouse, where the sensational trial has unfolded over the last six months.

Headingley, Jan 25: England have become the first team in the world to score 500,000 runs in Test cricket. They achieved the feat during the ongoing fourth and final Test against South Africa being played at The Wanderers.

On Friday - the opening day of the Test match -- England captain Joe Root's single through the covers took the Three Lions to a landmark 500,000 run-mark in the longest format of the game. They achieved the feat in their 1022nd Test match.

Australia comes second in the list, with 432,706 runs in 830 Tests. India, meanwhile, are third, with 273,518 runs in 540 Tests, followed by West Indies (270,441 runs in 545 Tests).

In the third Test played at St George's Park in Port Elizabeth, England had become the first team to play 500 Test matches on foreign soil. Australia are the second team to play the most away Test with 404 matches they have played so far.

India have played 268 Tests on foreign soil in which they have won 51, lost 113 and 104 have ended in a draw.

The Board of Control for Cricket in India (BCCI) will not end its partnership with Chinese companies. Vivo, the Chinese smartphone maker, is the main sponsor of the new IPL season as well. Apart from Vivo, PayTM and Dream 11 will also be at the helm of the 13th edition of the IPL. The IPL governing council meeting on Sunday decided to retain the old sponsors.

As soon as the IPL GC announced the decision of retaining the sponsors, a huge number of fans took to Twitter to slam the board for the same. #BoycottIPL started trending as the users urged others to boycott the tournament for the Chinese connection.

Earlier, the demand for exclusion of Chinese companies from the IPL was strong in the wake of the India-China border dispute. But the BCCI cannot abruptly end its collaboration with them. Because of the signed contract itself. And in this age of declining economy, it is difficult to find new sponsors quickly.

The current BCCI contract with Vivo is for five years. Vivo has invested Rs 2,199 crore to become the main sponsor of the IPL. The contract was signed in 2017. However, the BCCI’s move is paving the way for new discussions as calls are mounting across the country to boycott Chinese companies.

The BCCI announced other important decisions besides retaining sponsors. The IPL will be held from September 19 to November 10. The Indian government has given permission to the BCCI to hold the IPL in the UAE. With this, all obstacles in the way of organizing the tournament were removed.

The IPL matches will be played at 7.30 pm Indian time (6 pm UAE time). Most matches are about one match a day. There are a total of ten ‘double headers’ (two matches a day) in the tournament. Franchisees are allowed to appoint as many replacements as they want in the new season in view of the new health situation. At the same time, the maximum number of players a franchise can accommodate is 24. The BCCI is also planning to host a women’s IPL tournament.

New Delhi, Jul 1: After being named as India's 'Most Valuable Player' in Test cricket in the 21st century, all-rounder Ravindra Jadeja on Wednesday said that he will always aim to give his best for the country.

His remark came as Jadeja achieved an MVP rating of 97.3 and as a result, he was also rated as the second most valuable player Test player worldwide, only second to Sri Lanka's Muttiah Muralitharan.

"Thank you Wisden India for naming me the 'Most Valuable Player'. I would like to thank all my teammates, coaches, fans, and well-wishers for your support as I aim to give my best for our country. Jai Hind," Jadeja tweeted.

Based on CricViz's market-leading analytics, each player in world cricket was awarded an 'MVP rating' by Wisden using a statistical model to rank their 'match impact' compared to their peers.

Jadeja has played in 49 Tests from 2012, managing to score 1,869 runs and has also picked up 213 wickets.

"It might come as a surprise to see Ravindra Jadeja, India's spin-bowling all-rounder, feature as India's number one. After all, he's not even always an automatic pick in their Test team. However, when he does play he is picked as a frontline bowler and has batted as high as No.6 - contributing to a very high match involvement," the official website of Wisden quoted CricViz's Freddie Wilde as saying.

"But Jadeja's position is based on more than simply volume: it's what he does when he's involved that really counts. The 31-year-old's bowling average of 24.62 is better than Shane Warne's and his batting average of 35.26 is better than Shane Watson's. His batting and bowling average differential of 10.62 runs is the second-best of any player this century to have scored more than 1,000 runs and taken 150 wickets. He is an all-rounder of the very highest quality," he added.

With the bat in hand, Jadeja has managed to score one century and 14 fifties in the longest format of the game.

He was last seen in action during India's two-Test series against New Zealand earlier this year.

He would have been in action for the Chennai Super Kings (CSK) in the IPL had the tournament commenced from March 29.

However, the IPL has been postponed indefinitely due to the coronavirus pandemic.
