Pakistan using Jadhav's case as tool for propaganda: India at ICJ

New Delhi, Feb 19: Pakistan has failed to satisfy minimum due process in the Kulbhushan Jadhav case and is using the Indian, detained on alleged grounds of terrorism, as a propaganda tool, India said at the latest hearing at the International Court of Justice on Monday.

"Pakistan's story is solely based on rhetoric and not facts," said counsel Harish Salve, arguing India's case. He demanded India be provided consular access and said Jadhav's continued detention be declared unlawful. Pakistan "knowingly, brazenly and willingly" violated international law, said Salve.

Salve attacked Jadhav's trial by a secret military court in Pakistan which was opaque to the outside world. Pakistan provided no "credible evidence" to show his involvement in any act of terrorism and Jadhav's purported confession clearly appeared to be "coerced", the counsel said.

"There is no manner of doubt that Pakistan was using this as a propaganda tool. Pakistan was bound to grant consular access without delay," Salve demanded in a long submission.

India insisted, as it had earlier too, that Jadhav’s detention is unlawful under the Vienna Convention on Consular Relations. Salve demanded that the ICJ order Jadhav’s release immediately keeping in mind that Pakistan failed to observe even “the minimum standards of due process” in sentencing him to death.

“Military courts of Pakistan cannot command the confidence of this court and should not be sanctified by a direction to them to review and reconsider the case. India seeks annulment of Jadhav’s conviction, and directions that he be released forthwith,” said Salve.

The hearing comes in the middle of heightened tensions between India and Pakistan over the Pulwama attack. While India has based its case on the Vienna Convention, Pakistan is again likely to argue that the 2008 bilateral agreement on consular access supersedes the convention as Jadhav was held for espionage.

Salve argued that Pakistan did not uphold Article 36 of the Vienna Convention that states consular access applies to all nationals, regardless of espionage claims in Jadhav’s case. “This quite plainly is an egregious violation of Pakistan’s obligations under Article 36 of the Vienna Convention,” said Salve.Noting that military courts in Pakistan are not independent, Salve said the working of such courts have been censured by the European Parliament.

“A foreign detainee has the right to life, the right to a fair trial and an impartial judiciary. However, Pakistan has sentenced 161 civilians to death in their military courts in opaque proceedings in the last two years,” Salve said.

“Considering the trauma he (Jadhav) has been subjected to over the past three years, it would be in the interest of justice of making human rights a reality to direct his release,” Salve said on the first day of the hearing.

New Delhi, Jan 13: The Delhi High Court on Monday sought response of the city police, Delhi government, WhatsApp Inc, Google Inc and Apple Inc on a plea of three JNU professors to preserve data, CCTV footage and other evidence relating to the January 5 violence on the varsity campus.

The Delhi Police informed the court that it has asked the JNU administration to preserve and hand over CCTV footage of the violence.

Justice Brijesh Sethi listed the matter for further hearing on Tuesday.

The court was told by Delhi government Standing Counsel (criminal) Rahul Mehra that the police has not yet received any response from the university administration.

The counsel said police has also written to WhatsApp to preserve data of two groups "Unity Against Left" and "Friends of RSS" including messages, pictures and videos and phone numbers of members, related to JNU violence incident.

The petition was filed by JNU professors Ameet Parameswaran, Atul Sood and Shukla Vinayak Sawant seeking necessary directions to the Delhi Police Commissioner and Delhi government.

The petition also sought direction to the Delhi Police to retrieve all CCTV footage of JNU campus.

New Delhi, Jan 17: Deputy Chief Minister Manish Sisodia does not have any car on his name, according to information shared in the poll affidavit filed by him for Delhi elections.

In the affidavit, it is also shown that while his self-acquired immovable property remained roughly the same as in 2015. His wife's self-acquired immovable property is worth roughly about Rs 65 lakh, as per his latest affidavit.

In the papers submitted during the nomination for 2015 Delhi polls, the senior AAP leader had declared that he owned a Maruti Swift car of make 2013.

However, in his 2020 affidavit, he has mentioned "nil" in the column for motor vehicles and other means of transport.

In the affidavit submitted on Thursday, his moveable assets were declared worth Rs 4,74,888 for 2018-19, as against Rs 4,92,624 for 2013-14.

In 2015, Sisodia had informed in his affidavit that he had bought a property in Vasundhara, Ghaziabad, worth Rs 5.07 lakh in April 2001. The approximate current market value of self-acquired property in 2015 was Rs 12 lakh.

In his current affidavit, the AAP leader has mentioned the same property. However, the approximate current market value of self-acquired property in 2020 has increased to Rs 21 lakh.

In his affidavit for the 2015 polls, Sisodia had also said that his wife had purchased a property in March 2008 costing Rs 8.70 lakh. At that time, the approximate value of her self-acquired property was Rs 20 lakh.

Washington, Jan 2: The number of people killed in large commercial airplane crashes fell by more than 50% in 2019 despite a high-profile Boeing 737 MAX crash in Ethiopia in March, a Dutch consulting firm said on Wednesday. Aviation consulting firm To70 said there were 86 accidents involving large commercial planes - including eight fatal incidents - resulting in 257 fatalities last year. In 2018, there were 160 accidents, including 13 fatal ones, resulting in 534 deaths, the firm said.

To70 said the fatal accident rate for large airplanes in commercial passenger air transport was just 0.18 fatal accident per million flights in 2019, or an average one fatal accident every 5.58 million flights, a significant improvement over 2018. The fatality numbers include passengers, air crew such as flight attendants and any people on the ground killed in a plane accident

Large passenger airplanes in the study are aircraft used by nearly all travelers on airlines worldwide but excludes small commuter airplanes in service, including the Cessna Caravan and some smaller turboprop airplanes, according to To70.

On Dec. 23, Boeing's board said it had fired Chief Executive Dennis Muilenburg after a pair of fatal crashes involving the 737 MAX forced it to announce it was halting output of its best-selling jetliner. The 737 MAX has been grounded since March after an October 2018 crash in Indonesia and the crash of a MAX in Ethiopia in March killed a total of 346 people.

To70 said the aviation industry spent significant effort in 2019 "focusing on so-called 'future threats' such as drones." But the MAX crashes "are a reminder that we need to retain our focus on the basics that make civil aviation so safe: well-designed and well-built aircraft flown by fully informed and well-trained crews."

The Aviation Safety Network said on Wednesday that, despite the MAX crash, 2019 "was one of the safest years ever for commercial aviation." The 157 people killed in March on Ethiopian Airlines Flight 302 accounted for more than half of all deaths last year worldwide in passenger airline crashes.

Over the last two decades, aviation deaths around the world have been falling dramatically even as travel has increased. As recently as 2005, there were 1,015 deaths aboard commercial passenger flights worldwide, the Aviation Safety Network said.

Last week, 12 people were killed when a Fokker 100 operated by Kazakh carrier Bek Air crashed near Almaty after takeoff. In May, a Russian Sukhoi Superjet 100 aircraft caught fire as it made an emergency landing at Moscow’s Sheremetyevo airport, killing 41 people.

The figures do not include accidents involving military flights, training flights, private flights, cargo operations and helicopters.
